I've personally had this happen once before and that was back in Horizon 3. When I saw it happen, I simply used a different car the next race to force the game to re-roll the drivatar list.
I just tried running this again. I got second in the first race, first in the second, for a total of 36 points. The other car that won the first, got 2nd this one, also getting a total of 36 points. There's a completely different car that has 41 points in first. Even if you come in first in both races, you can only get 40 points yet this drivatar has 41, despite not coming in first or second in either race.
