Whilst this was possibly a covid breach from what I saw that had a lawful reason to contact him. If an offence has been established (regardless if 90% of Australia’s population including most police officers don’t agree with it) then they had the right to request his details and conduct an investigation. Had he been compliant Police would not have placed their hands on him or arrest/cuff him. He chose to make that situation into the court trial however that’s not how our system works. These officers were extremely calm and yes she repeated herself but it’s because she knew this was a nothing incident so was trying to reason with him. And the people saying they should have just let him go or let him calm down then again you don’t understand how the legal system works. Then does that set the precedent for other arrests? So Someone is being arrested for house burglary (yes a much higher offence but the police actions are the same, contact, interview/arrest, charge/not charge) but that person then says let me go. Should the officers do that? And once someone is under arrest (again regardless of who believes that particular offence should be one or not but it is) they are in your custody and you have a duty of care. If the officers give him space to breathe and he decides to run and get away then they are disciplined and the subject will get an escape custody charge which is huge compared to a simple covid breach. Had these officers been battening him and getting really aggressive with their actions then yes that’s disgusting as not needed. But they decided to play it out and get backup so he could be taken into custody safer. Knowing how wishy washy the covid laws were Police unfortunately had to try and learn a new bit of legislation then from that every arrest or public contact was handled differently because the federal and state governments as well as police hierarchy would daily alter the way they wanted their officers to handle the covid breaches.

The cops slam the brakes on and the guy smashes his head on the front of the cage and breaks his neck. He is a quadriplegic now. Will never walk again. No money will ever fix him. Great duty of care. It can happen anywhere in the world. Getting arrested and charged for peaceably going for a swim? Australia is supposed to be a first world country, not where someone can have their freedom taken away for going for a swim, no matter how he got to the beach. Sometimes when you realise you've made yourself look stupid the worst thing you can do is keep going in the same way. I know that once the police have placed someone under arrest they are obliged to put the person in handcuffs but common sense could have made this much easier for everyone.
NSWP can only handcuff someone if they have attempted to flee, an officer safety issue or to prevent injury to themselves or others. There is no "Obligation" to handcuff.
There is no obligation to handcuff, quite the opposite actually, they need to be able to justify why they used handcuffs, and they must have a good reason to do so.

In QLD handcuffs can be used as a use of force to ensure the safety of officers, the person's in the handcuffs and others. The witnesses confirmed he never set foot in the zone they claimed he did. So this is lawful resisting. AS the police were in fact lying for the sake of getting to manhandle someone. The right that was infringed is his right to feel safe in public. Even if his original goal was to pass the boundaries. He never did. And police tried to lie and say he did. When it was proved he did not. The court awarded him 90 thousand dollars in compensation for being attacked by the officers unduly.
Just to be more specific the charges were initially dropped and the police ordered to pay his legal fees after it was revealed the police were just making the offence up. He then sued the police for their transgressions, this is a quote from his lawyer ( in the context of fabricated offence) 'This meant that the arrest of Mr Moskovich was unlawful and so he could not be guilty of resisting arrest.' And the judge agreed forcing the police force into a settlement.
@@spf50sunscreen80 all the officers involved should be fired or at least forced to undergo 6 months training to figure out what a threat actually is! I wish it didn't end in a private settlement. I wish it continued until he was completely proven in court that those police officers wrongfully arrested him and that the officers had to publically apologise on TV. And I wish it forced the Police to review their policies regarding arrests and understanding threatenting behaviour. Maybe we shouldn't have so many weak cops. Eg. Force them to do Juijitsu and regular firearms training, this way they won't be so afraid when someone larger than them questions their motives.

Of course the likelihood is they investigate themselves and find no wrong doing. In general though if your misuse of force causes the force to pay 115k to a private individual for mistreating him. Comprehensive retraining and psychological assessment should be mandatory. And of course in egregious circumstances the officer should be stood down. I think we are a long way off that happening though.
What the public need to know is; Just how many people were wrongfully arrested and got payouts like this- they are usually forced into signing non-disclosure agreements, so that they can't publically talk about the details... Good on this bloke, I'm glad he finally got some justice

A frustrated officer is far more likely to rack up mild offences during an already unreasonable detainment. Of course this all only matters if the individual can maintain their calm so as to avoid the same potential thing happening to them.

There is a video here on youtube that shows camera footage of an american man getting the "rough ride" to the station in the back of a van. He has his hands cuffed behind his back. The cops slam the brakes on and the guy smashes his head on the front of the cage and breaks his neck. He is a quadriplegic now. Will never walk again. No money will ever fix him. Great duty of care. It can happen anywhere in the world. Getting arrested and charged for peaceably going for a swim? Australia is supposed to be a first world country, not where someone can have their freedom taken away for going for a swim, no matter how he got to the beach. An old bloke going to do what he likes to do to keep fit and healthy. Not good. Not good at all. You or I may be next when we go to the library or to get some take away.

The law these cops are enforcing is ridiculous but it's not their fault, they don't make the rules they just get paid to enforce them. They'd probably agree with us all under different circumstances, can't knock them for doing their job. This guy did nothing wrong but he is also being an obnoxious prick about it for what it's worth. Would've been solved much more civilly if he acted as such.

You can knock them for doing their job if they do it incorrectly. Evidently the police investigators/prosecutors thought they did their job incorrectly otherwise they would’ve kept the charges and wouldn’t have settled out of court. I will agree with your comment about behaviour though. So many people seem to think their life is ending and flip out when they get arrested ultimately make it worse.

Sometimes when you realise you've made yourself look stupid the worst thing you can do is keep going in the same way. I know that once the police have placed someone under arrest they are obliged to put the person in handcuffs but common sense could have made this much easier for everyone.
NSWP can only handcuff someone if they have attempted to flee, an officer safety issue or to prevent injury to themselves or others. There is no "Obligation" to handcuff.

The witnesses confirmed he never set foot in the zone they claimed he did. So this is lawful resisting. AS the police were in fact lying for the sake of getting to manhandle someone. The right that was infringed is his right to feel safe in public. Even if his original goal was to pass the boundaries. He never did. And police tried to lie and say he did. When it was proved he did not. The court awarded him 90 thousand dollars in compensation for being attacked by the officers unduly.
Just to be more specific the charges were initially dropped and the police ordered to pay his legal fees after it was revealed the police were just making the offence up. He then sued the police for their transgressions, this is a quote from his lawyer ( in the context of fabricated offence) 'This meant that the arrest of Mr Moskovich was unlawful and so he could not be guilty of resisting arrest.' And the judge agreed forcing the police force into a settlement.

I wish it didn't end in a private settlement. I wish it continued until he was completely proven in court that those police officers wrongfully arrested him and that the officers had to publically apologise on TV.
And I wish it forced the Police to review their policies regarding arrests and understanding threatenting behaviour.
Maybe we shouldn't have so many weak cops. Eg. Force them to do Juijitsu and regular firearms training, this way they won't be so afraid when someone larger than them questions their motives.
@@ilovejobbo I agree with the larger concept there. It is worth noting the officers actions are currently under investigation so we won't know how that turns out for a while.
Of course the likelihood is they investigate themselves and find no wrong doing. In general though if your misuse of force causes the force to pay 115k to a private individual for mistreating him. Comprehensive retraining and psychological assessment should be mandatory.
And of course in egregious circumstances the officer should be stood down. I think we are a long way off that happening though.

They were found to be unlawful. The same legal precedent can and will be used in Vic whenever someone challenges unlawful covid era police charges and fines.

@@oceanz4me While I agree to an extent there is motivation to extend these interactions in case officers breach any laws or their code of conduct further. A frustrated officer is far more likely to rack up mild offences during an already unreasonable detainment. Of course this all only matters if the individual can maintain their calm so as to avoid the same potential thing happening to them.
