So, I am guessing the boy was supposed to look in a crystal ball and say to himself, well I guess I will just hold off from taking out the trash because I think the police will be hunting a suspect in my area who might be wearing something close to what I am wearing???     The cop that arrested him, was one of those 'hero' cops who wants to be the first on the scene, the first to detain. He's probably looking for some sort of promotion. All he had to do was watch which apartment he returned to after dropping off the trash and then approach a parent.

      WTF…..Watching this as a brown man from Europe this is so obviously racism. What was the identity of person he was mistaken for-another 12 year old prowling cars? The police approached the situation with weak info from dispatch, ready to violate his rights and with arrest in mind whatever. The kid, yes…kid was always guilty before any investigation and quickly in cuffs. Disgusting

    The officers were so wrong for treating this baby like he was a criminal when in all reality he was doing his chores by taking out the trash in obedience to his dad. Now, he has been traumatized by what happened to him in an innocent situation by doing what his dad told him to do. A lawsuit most definitely needs to be filed on behalf of this baby. The police needs to be held accountable for their actions. This is bigger than a simple apology from the officers. It could have turned deadly for this baby for something that he hadn't done. This is all wrong on so many levels.

    The initial suspect fled and eluded the police. Another officer sees a young Black male, dressed somewhat similar to the original suspect, casually walking in a parking lot and assumes it is the same person who fled. The fact that the innocent young man did not flee should have been the first hint to the officer that this young male was not the suspect. A few intelligent questions would have prevented this.

      No, that doesn't occur when you have a potentially violent criminal on the loose who can be holding a weapon like a gun and can shoot within milliseconds of the cop coming out of the car. In order to show reasonable threat of force the police pulls out his gun (not aiming it at the boy) to show the suspect that he can potentially harm him if he chooses to retaliate and shoot him. THere are COUNTLESS examples, where a criminal feels cornered and takes out his gun to start shooting at police. It is proven over thousands of cases that pulling out your gun or having your hand on your gun gives you milliseconds of a jump start to point and aim your firearm at a criminal who chooses to shoot at you. Calling for his parents is ridiculous. How the hell would the police know his parents are right there in the apartment at the time of the scene? Only YOU know that because you just sat and watched a video giving you all the evidence of the case. There is no way a normal police surveying an area should just automatically know that a suspect is underage, innocent, and has his parents waiting a few steps away without treating each potential unpredictable situation the same regardless of age, build or race. Learn how to think for longer than 5 seconds and THINK about what actually is involved with life threatening police work.

    He was NOT a teenager as the AP stated. Hes a kid. His family was not located. He was handcuffed when he was not trying to resist. And alone. Most likely totally afraid. It is not a case of "wrong place, wrong time" it is profiling! Its a case of wrong judgment, wrongful arrest/detainment, wrongful process (failure to locate his family), and unnecessary, drastic treatment of a minor!!! Furthermore, it was NOT a few seconds, it was several minutes... even after his father came out to demand an explanation. No excuse!!!

    Pulling a gun on an obvious elementary school child. Look again at the photos, that is obviously a fully grown male in the suspect photo. How the hell do you mistake that for the size of an elmentary school child? Even if it was the kid why the hell do you pull a gun?

The detention to ensure that the suspect is in fact truly apprehended is normal protocol. Gun is drawn because knowing the suspect is actively being searched the police understand that when cornered criminals have a tendency to "fight or flight". If the suspect had already ran away there's a chance if he's caught again he can put up a fight to ensure he isn't arrested. Just 5 minutes of thinking instead of reacting with some knee jerk race bait will do you justice

      @@jenkor513you're going to play internet CSI by a grainy, blurry photo and invalidate a cop's justification for ensuring all suspects in the area are confirmed until the dangerous criminal is caught? First off, if you listened to the story, there was only ONE cop on the other side of the neighborhood that SAW the real perp in the neon green and white shirt. The cop who saw this young boy did not see the original criminal, so all he really had to go off of was that he had neon green shorts and was black. How the hell is he supposed to know hold old the perp was compared to this boy? You do realize the description they give over the radio is also just a best case estimate of what they see at the time right? So even if the first cop stated, he's an adult male, he could have very well misjudged his age and it could have been a teenager instead. The second cop did not have a picture to verify the perps age or build. ONLY YOU have the advantage of sitting behind your screen and make post judgements about what the cop should do or not do well after you have the facts of the case. It's not so easy when you're actually on the ground and working a live case not knowing who has a gun or how unpredictable they can get if cornered and they feel the need to escape from the situation. Secondly, he didnt aim the gun at the boy, He pulled it out of his holster IN CASE, that was the real perp and he decided to act irrationally and shoot the cop instead. By pulling the gun out of the holster first, the cop has milliseconds ahead of the potential perp they are trying to arrest. Those few milliseconds are a LIFETIME if you have a potential shooter on your hands. And this is basic knowledge from the various cases that you can easily research yourself where criminals attack police when they have located them by surprise.

    Okay highlights from this video indicate that they saw the kid put the trash into the dumpster and went directly into an uninformed arrest. There was no actual detaining to verify anything. Right to arrest and into the police car. Then, the blurred photo to protect who? Not the kid, but maybe the actual possible perp. Then the weak apology asking to put yourself into our shoes. If I was in their shoes, mine would be not pestering a kid in his own lot. I hope the police have a good server for the FOIA requests coming at them.

    I know how this family feels. Last year I was inside my home when my son called from outside yelling moms come tell these cops i live here. I rush out cop & cops have my 20 yrs old son in cuffs. I told them this is his home im his mother I own this new home its paid in full whats the problems? They said he had a smart mouth when my son spoke his rights. A few months down the road my 22yr old truck driver was home visiting was taking out the trash I was also cooking & heard voices raising. Go outside cop got a call 911 call about a child assumed my so could give him info. My son said he didn't no anything and the cop starting calling my son rude asshole. I have it on video tape. This year that white cop was fired for indecent behavior with colleges & other things.

      Irrelevant to whether the stop was good or not. Damn even with those pictures and the description of the circumstances people are acting like drama queens with no brains. How do you think policing and searching for a suspect works? This was actually handled very professionally by the book and well. Turning this into more than it was makes it more traumatic. How does that help the kid unless the family and some lawyers just want to make some money. I'm glad the father interceded for his son but now he's making it worse.

    It's a good thing that the boy remained calm and didn't resist, otherwise he would have been savagely beaten and probably murdered.

      No one's rights were violated. That's a good investigative stop. Perfectly legal and seemingly polite. Considering how vague many descriptions are, this was a really good match. A mistaken identity does not make this a mistake in police work. The police work seems to have been textbook correct.

      @@WillW91 It is absolutely legal and acceptable. Police work - especially when actively searching for a suspect in the field - is not a tea party. Procedures and protocols are there for the safety of police, the community and the suspect stopped. People get offended and that can't be helped. You cannot ignore a match to a LO because you are worried about offending someone or "traumatizing" someone. LO descriptions ae often vague and can be incorrect in some aspect. This was a really good clothing description and the police would have been negligent NOT to stop and detain this kid.
      This is a "mistaken identity" issue, it was not a mistake in police procedure or practice. Big difference. I have been a criminal defense attorney for 35 years. This was clean. I'm sorry if the reality of law and practice is not always pleasant looking and often not understood by citizens.

    This is insane, this is not mistaken identity, this is pure incompetence and stupidity… They didn’t even ask proper questions try to try to assess the situation in a logical manner… They did they just allegedly saw the same shirt and shorts as the “suspect”, and just grabbed this poor child. … Size, clothing, aside, it doesn’t matter… They should’ve properly assessed better… If they had to, they could’ve maybe asked a cpl of questions to that poor boy and saw that he obviously didn’t fit that profile. But now just impulsive and not thinking, overreacting, and now embarrassment and trauma on the kid… Issuing an intense your apology, thinking that people just move on, and super under the rug… No, the family has every right to be outraged, lawsuits, and terminations all around

No one is excusing unlawful bad behavior & committing crimes- obvi anyone of any age &/or any background that is involved in unlawful bad behavior and criminal activity should obviously atone for their actions! No one is unnecessarily pulling the race card, no one is marinating in victim hood. That was not the point of my comment 🙄, so miss me with the BS of twisting my comment into something that is not. You act like in this situation, the child & the family have no right to be outraged and questioning everything. This is a highly disrespectful & traumatizing experience to endure. If this was a personal experience , you would prob change your tune. People are tired of this type of situation, it’s not OK to normalize this type of situation, and the fam have every right to be upset & express their frustration, hell even pursue legal action! Even if footage was released, probably would corroborate the bad decision making & embarrassment of the officers- the dept should properly & personally apologize ( not just issuing a public statement/apology, and not addressing the family privately and directly), plus there needs to be some retraining. Like I said, even in law enforcement, there’s a proper way to asses & handle this type of situation- this was not it! It’s not always an act first/ think- question later situation. This young man was calm, spoke very eloquently, articulate, and is intelligent- do you think that if they actually logically approached him to properly assess the situation, to confirm if he actually fit the profile, that he would’ve ended up like this in handcuffs? More than likely not… Obviously they have to do their job and inquire if someone fits a profile, but if they actually did their job the properly- discover & absorb he’s under age- at his residence of all places- emptying the trash 😳, they should’ve connected with his parents to go from there- before just detaining a child- in which it spiraled & escalated into this circus! With that comes logic, intelligence, and proper training- which these officers are clearly lacking. There is a clear difference between this young boy VS a grown ass man, regardless of similar outfit. In this situation, the racial bias was clear ( “ well they both look similar & outfit similar”) smh! … Generally, a suspect on the run-who committed a crime within the same day-in the same clothes- wouldn’t be even more stupid to be so out in the open- this calm & nonchalant- wouldn’t you think they would be lowkey in hiding? … The situation is horrible and their actions are ridiculous, these officers need to do better period! In this type of situation, it’s very clear how things should’ve been handled, so miss me & move on with your close-minded “whatabout-isms” & ignorance… 🙄

News reports: Loehmann jumps out of the car and immediately shoots Rice from a distance of less than 10 feet. The entire incident happened within a span of two seconds. According to Judge Ronald B. Adrine, in a judgement entry on the case, "this court is still thunderstruck by how quickly this event turned deadly.... On the video the zone car containing Patrol Officers Loehmann and Garmback is still in the process of stopping when Rice is shot. Loehmann, the officer who killed Rice, joined Cleveland's police force in March 2013. From July to December 2012, he worked with the police department in Independence, about 13 miles south of Cleveland, with four of those months spent in the police academy.
      In a memo to Independence's human resources manager, released by the city in the aftermath of the shooting, Independence deputy police chief Jim Polak wrote that Loehmann had resigned rather than face certain termination due to the concern that he lacked the emotional stability to be a police officer. Polak said that Loehmann was unable to follow "basic functions as instructed" and specifically cited a "dangerous loss of composure" that occurred in a weapons training exercise. Polak said that Loehmann's weapons handling was "dismal" and he became visibly "distracted and weepy" as a result of relationship problems. The memo concluded, "Individually, these events would not be considered major situations, but when taken together they show a pattern of a lack of maturity, indiscretion and not following instructions, I do not believe time, nor training, will be able to change or correct these deficiencies." It was subsequently revealed that Cleveland police officials never reviewed Loehmann's personnel file from Independence prior to hiring him. He had been hired in Cleveland despite listing his primary source of income for the prior six months having been derived from "under-the-table jobs".
      On May 30, 2017, the mayor of Cleveland announced that Loehmann had been fired for concealing details about his past employment in his job application. On his application, Loehmann said that he had left the Independence Police Department for "personal reasons" and did not reveal the Independence police's determination that he had "an inability to emotionally function" as an officer."

      Improper use of a quote. Who has blind belief? The video shows that the police did the least violent thing possible to ensure their safety and the boy's safety was protected. While also navigating an unpredictable situation as he could have been the perp they were trying to locate. I would hate for you to try and figure out what you would do if you have to locate this neon green shorts boy that was on the loose.

What was the identity of person he was mistaken for-another 12 year old prowling cars? The police approached the situation with weak info from dispatch, ready to violate his rights and with arrest in mind whatever. The kid, yes…kid was always guilty before any investigation and quickly in cuffs. He’s traumatised for life and will never trust law enforcement again. Most disgusting

    Again, incidents like this show the ignorance (and evil) of many of those in blue uniforms. This was a minor, taking out trash near his residence, posing no current threat. Why didn't the cops initially approach the parents first with their claim that this young man is a suspect before handcuffing him. It would have been different if the kid was apprehended away from his home. Why not have a little consideration! Man...I am so sick of seeing how people of color are treated as third-class citizens just because of the color of skin. Give us the same consideration you give to non-black people! Every black person is not a thug or a threat as the media and society tries to purport; just like every non-black person is not free from corruption as the media and society tries to make us believe!

    There is literally no situation that a cop can't make worse. Never call them, never speak to them. The thugs who hide behind their thin blue line need to be stripped of their qualified immunity and forced to self-insure (like a doctor) so that the public no longer has to pay for their thoughtlessness and, sometimes intentional, violations of our constitutional rights.

    Thankfully, the cops didn't attack or shoot Tashawn's dad for inquiring about his son's wrongful detention. All it would have taken was a late arriving thug sergeant or another ignoramus in uniform, rushing to judgement and blasting away.
    Had that happened, you know they would run to the Qualified Immunity Curtain and hide behind it. It's sad to know that not too long ago, racist cops would have done serious harm to both the father and the son just for talking back to them in defense of themselves.
