Second degree murder. It doesn't matter if you he had no intention. Without such laws people would just place in a fall guy for a group effort and other elaborate schemes. And a great deterant having criminals plan with safety in mind instead of destroying anything in their way. Will be charged but will be helped by mitigating circumstances as there was absolutely no intent at all to even lay a finger on anyone.
Why would he have been arrested for murder though? He didn't kill the kill the housekeeper, the goons he hired did. The goons didn't kill her on purpose, it was an accidental killing. His crime was conspiracy to commit burglary. If that implicates him in the killing, it still wouldn't be murder, it would be manslaughter.
Any death that occurs during the commission of a felony is murder. It’s called the felony murder rule. There was a case a few years ago where three teenage boys broke into someone’s house and the owner of the house shot and killed one in the boys. The other two boys were charged with felony murder even though they didn’t shoot anyone.
@@adamrobinson6951 That's the myth. The truth is that firearms are used more often to prevent crimes than committed with them. For every accidental death (802), suicide (16,869) or homicide (11,348) with a firearm (29,019), 13 lives (390,000) are preserved through defensive use.
Confidence with handling a weapon doesn't directly translate to confidence with shooting someone. Even if you're confident that you can shoot the person it doesn't mean that you'll actually be willing to, even if you think it's the right thing to do, even if you know that it will save someone's life, even if you're backed into a corner--even if you regret not doing it for the rest of your life. Sometimes there are situations where there's no right answer and no matter what you do, you'll have the specter of your decision haunting you in your nightmares for the rest of your life.
I just had an epiphany… Sherry *DID* steal the Bake Sale money; here’s what happened Sherry was hard up for cash so she could keep her flower hair clip collection growing and knew that that bad boy kid was an easy mark… She put on the magic during the bake sale to get him to buy something with the money that he had surely obtained from various nerds… nerds like Monk, who she KNEW was low-key stalking her and she’d noticed him looking at her dial lock on several occasions… As I mentioned, getting that bully to buy something was the easy part and she knew that all she needed was for him to have a $5 bill at worst or a $10 bill at best… more likely he had a $5 given the early 70’s economy The bully gets charmed in to buying something and give her the $5, which she sleight-of-hand put under the “Good Luck” $5 that the principal gave as a nice encouraging gesture Slipping the marked $5 into his change was the easy part, but so was setting him up when he helped her carry the money box to her locker Sherry KNEW that he was going to try to steal the money, that’s obvious by the sleeveless denim vest… a vest he wears to mask the fact that his home life, it ain’t so good you see, but that’s not important here… just know that it ain’t so grand over at that boys home what with the screaming and the stuff being thrown all the time and the lack of a positive or supporting parental environment; he really could’ve used a friend, but instead he crossed paths with Sherry… 😔 Anyway, after he “stole” the money (she let him) she stole it back immediately after he rounded the corner. Sherry knew that he wasn’t so good with the remembering things what with the distress of his home life causing stunted learning patterns which affected his grades creating a downward spiral of low self esteem and crippled confidence, hence the sleeveless denim vest… and that he always left his lock on the last number of the combination so he didn’t have to worry about forgetting the first 2 numbers… she saw him “phantom spinning” the dial on several occasions as well as many others where he walked right up to his locker and pulled the padlock down right away to gain access… With the money box back in her possession, it was just a matter of tricking the affable Monk, who she KNEW had eyes for her and would absolutely give her the benefit of the doubt. All she had to do set her padlock to ~any~ number other than zero, which she did… though it took a little to resist the temptation to set it to zero as she usually did, she was still able to refrain She correctly assessed that the bully would never admit to initially stealing the money box because if he did then it wouldn’t matter what he said after since he would have already painted himself as being involved at all What the bully didn’t count on was having had the marked $5 bill slipped in with his change after making a legitimate purchase with his ill-gotten lunch money from the various nerds He’s still not innocent overall since he still torments nerds and *DID* in fact steal the money box, but these factors only served to make him the perfect patsy Remember that he’s not so good with the numbers, so he didn’t think to double-count his change… if he had then he MIGHT have had a chance to present a reason why he had that marked $5 bill. But he assumed that his change was correct, though even if he’d seen the $5 bill, odds are minimal that he tells Sherry that she gave him too much back on accident Poor kid didn’t have a chance against Sherry’s brilliance, and Monks bias’ were played against him like a fiddle 🙁 ------ Edit: oh, and to those wondering why she’d give Monk one of her precious flower clips as a thank you back in the day; it was an extremely inexpensive one that she had a spare of which is why she wore that particular one that day; she’d never miss it and it even if she wanted to get another backup of it, it was very cheap; like 15¢…
Justice can be a little cockeyed. Knew someone once who was in prison. He and 2 other men robbed a liquor store and he went back out to the car with one of them. After they were outside, without their knowledge, the third shot and killed the clerk. They got more time than the actual killer.
From a legal point of view, the 2 men murdering the housekeeper wasn't on the man who hired them. Sure, planning a breaking in and destruction of private property is still a crime, but he planned it on a day that no one should have been there. So he's only guilty of conspiracy, but the housekeepers death is on the 2 that broke in, not on him. A good lawyer could argue that he had every intent that the 2 who broke in was to flee if someone was home to prevent this outcome.
@@gringossa that doesn't work. You can't have guilt by association or they would be arresting whole neighborhoods at once. If a friend asks you to key someone's car after they messed up his burger order, he's not responsible if you walk into burger world and kill everyone inside.
@@Ratharian They would look at the situation. In this case the man tasked two others to break into a house and created a situation that is known to escalate to violence. It would probably be some manslaughter charge. If the maid had killed one or both the men, he'd still be on the hook for their deaths. In your burger world scenario, it's unlikely someone would kill another human being over it. It's possible but it's far less likely. So if that person proceeds to escalate, at best it's really a civil suit that has a chance at success. The scenario would be more in line if you were told to take a bat and smash up the place but don't physically attack. In that situation the likelihood of a violent engagement shoots up.
@@DesignIncase someone wasn't watching the same show as I apparently. The vandalism was purposely scheduled when no one was supposed t0 be there so this situation wouldn't happen. He said so, the guys even admitted as much when she confronted them. So as far burger world, you're wrong. So at best, he's on the hook for conspiracy to commit vandalism. He can't control what they do, and he sure didn't tell them to murder anyone who got int jowr way, especially since he specifically planned it for a time the house was meant to be vacant.

Can he be held guilty for murder though?
He hired them to deface the painting.
They choose to kill.
This was a Natalie-Case? Weird, I could've sworn that this episode happened during Sharona's tenure.
No, no it was with Nathalie
This is why you always get a Prenup kids

What interest me the most is how after divorce she kept a house and get alimony monthly payment of 26 k until she remarry?! 😮
Anybody need a wife?
Lol
How did Monk figure out they defaced the painting after the housekeeper was killed?
Here's what happened...
I wonder what happened to the bully monk exposed as a kid
So, despite of what the large kid did to her many years ago, she still fell for him one time?
I should have watched Monk when it was on air
This wasn't a murder, maybe complicity to manslaughter at worst.
hey, go back to Albuquerque Saul, leave San Francisco alone
Will she keep receiving money after he gets in jail? Or all of his wealth? It's a nice system for the ex-wife to receive money after divorce.
Yeah, I can't believe any prosecutor would charge Shery's ex with murder. Let alone a jury convict him.
Any deaths that occur as a result of the premeditated commission of a felony are counted as murder, even if there was no intent to kill.
They never said why the housekeeper didn’t go on her day off
Second degree murder.
I will sad for monk he was about to make a move when Sherri and jimmy met
@@rony41165 true and even as an adult, he could

Ill be honest I don’t think he’s liable for the murder. For the breaking and entering yes but not the murder. Could be wrong though

Why she married the bully? Like that still did not make sense to me lmao
@@Yugo_Reyes it's not the bully but the little blonde guy
If you have a gun for self defense, practice with it so you're actually confident with it.
If you have a gun for self defense, it just means you're more likely to be seriously hurt or killed. Just don't have a gun, it's safer that way.

Dunno if I call this murder. Manslaughter is more like it
Wow! Chris Pratt is one of the bad guys!
Is it just me or did they use the wrong $5 for 1972
I just had an epiphany… Sherry *DID* steal the Bake Sale money; here’s what happened
Sherry was hard up for cash so she could keep her flower hair clip collection growing and knew that that bad boy kid was an easy mark…
She put on the magic during the bake sale to get him to buy something with the money that he had surely obtained from various nerds… nerds like Monk, who she KNEW was low-key stalking her and she’d noticed him looking at her dial lock on several occasions…
As I mentioned, getting that bully to buy something was the easy part and she knew that all she needed was for him to have a $5 bill at worst or a $10 bill at best… more likely he had a $5 given the early 70’s economy
The bully gets charmed in to buying something and give her the $5, which she sleight-of-hand put under the “Good Luck” $5 that the principal gave as a nice encouraging gesture
Slipping the marked $5 into his change was the easy part, but so was setting him up when he helped her carry the money box to her locker
Sherry KNEW that he was going to try to steal the money, that’s obvious by the sleeveless denim vest… a vest he wears to mask the fact that his home life, it ain’t so good you see, but that’s not important here… just know that it ain’t so grand over at that boys home what with the screaming and the stuff being thrown all the time and the lack of a positive or supporting parental environment; he really could’ve used a friend, but instead he crossed paths with Sherry… 😔
Anyway, after he “stole” the money (she let him) she stole it back immediately after he rounded the corner.
Sherry knew that he wasn’t so good with the remembering things what with the distress of his home life causing stunted learning patterns which affected his grades creating a downward spiral of low self esteem and crippled confidence, hence the sleeveless denim vest… and that he always left his lock on the last number of the combination so he didn’t have to worry about forgetting the first 2 numbers… she saw him “phantom spinning” the dial on several occasions as well as many others where he walked right up to his locker and pulled the padlock down right away to gain access…
With the money box back in her possession, it was just a matter of tricking the affable Monk, who she KNEW had eyes for her and would absolutely give her the benefit of the doubt. All she had to do set her padlock to ~any~ number other than zero, which she did… though it took a little to resist the temptation to set it to zero as she usually did, she was still able to refrain
She correctly assessed that the bully would never admit to initially stealing the money box because if he did then it wouldn’t matter what he said after since he would have already painted himself as being involved at all
What the bully didn’t count on was having had the marked $5 bill slipped in with his change after making a legitimate purchase with his ill-gotten lunch money from the various nerds
He’s still not innocent overall since he still torments nerds and *DID* in fact steal the money box, but these factors only served to make him the perfect patsy
Remember that he’s not so good with the numbers, so he didn’t think to double-count his change… if he had then he MIGHT have had a chance to present a reason why he had that marked $5 bill. But he assumed that his change was correct, though even if he’d seen the $5 bill, odds are minimal that he tells Sherry that she gave him too much back on accident
Poor kid didn’t have a chance against Sherry’s brilliance, and Monks bias’ were played against him like a fiddle 🙁
------
Edit: oh, and to those wondering why she’d give Monk one of her precious flower clips as a thank you back in the day; it was an extremely inexpensive one that she had a spare of which is why she wore that particular one that day; she’d never miss it and it even if she wanted to get another backup of it, it was very cheap; like 15¢…
Seriously?
This has got to be one of the worst things I have ever seen, the acting is atrocious 😂
I don't think they could charge him with murder based on that could they? At best manslaughter.
Agreed. Feels like a bit of a stretch. Not like he WANTED anyone dead.
No, he is still guiltu of te murder since it was commited doing a crime he was part of.
No. when you're in a criminal association everyone os responsable (in different levels) for all the crimes, planned or not
@@gringossa that doesn't work.
If Sherry got a job, got a smaller apartment and wasn’t living off of alimony money, Gladys wouldn’t have died🙃

That little boy looks exactly like monk 😂😂😂.
A latina with two strangers in her living room is fearful of using a gun?
Seems to me that once intruders are inside of a person's house, they are totally within their legal rights to use deadly force.
Technically I think that would be considered accident and not a murder case.
The organizer of this crime haven't made request to kill anyone.
He requested that they break into his ex wife’s house. That’s a crime. When someone dies during the commission of a crime, it’s murder.
Trudy doesn't know what Monk's smile means? Did she just start working for him?
