However, we all should know that this is legal, and the problem are the officers specifically the female which simply does not understand the law. This is a case, like many others, that could end before it begins. If the information the 911 call taker is accurate and the call taker knows the statute then no LEO's would need to be dispatched. That said you would need a Supervisor ( LEO )to issue final approval to send out the troops. That sounds easy enough to me.

That first cop on scene sounded absolutely foolish to not know the laws. When the sarge realised that the call actually came from a passing motorist, he knew he had no case. He was trying it on when he said the call came from the staff in the building. Shame that the police do such things.

Now to sum this up, if the Sargent investigated when he first arrived they wouldn’t have gone back and forth. He never bothered to find out where he was standing or recording from, never learned if he trespassed or not, instead he immediately backs up the officer and her unlawful orders. All of the officers get an F- for not knowing the law and for unlawful detainment.
But the point here is, how can they "investigate" a non crime? Basically, they cant. They can only conduct enquiries when there is no RAS of a crime, to try to find RAS of a crime. This is the first time I've ever heard them openly say they can detain and identify a person who they admit they have no probable cause to suspect of a crime. The officer and the supervisor both clearly stated no crime had been committed and they had no probable cause to believe there was a crime but they needed to detain and identify him to conduct an investigation to see if they could find probable cause. This takes it to a whole new level of stupidity. After that I was actually kind of hoping they would force the issue and arrest the guy. His attorney would have probably sent them thank you cards for handing them such a slam dunk win.

I'm an ex police officer and also worked with the Sheriff's dept. In this day and age, I'm completely shocked that officers still don't know the law on this ... especially with all the 1st Amendment Auditors out there. It not only makes the officer look bad, but the department as well. I've always said, "Law Enforcement is the enforcing of laws. If you don't know the laws, how can you enforce them?". Police need additional training on this, e-bikes and drone laws.

@@bbigrocker1 I understand what you're saying, but in the police academy (OPOTA - Ohio) we only received 6 months of training and there's just too much stuff to pack in that short amount of time. A lot of the laws you have to learn by experience. State Troopers here in Ohio have to ride with a senior officer for a year before they can go out on their own (if I'm not mistaken). In that time, they will have seen many different scenarios and laws. If the rookie oversteps, the senior officer will correct him. Not every agency has this policy and it's where officers get into trouble. Most of police think they're right while a few know the law and try to trick it out of you. The Police Academy should be increased to a year. 6 months of just knowing the laws you are sworn to protect and enforce. There would be little need for discipline if the officers were properly trained. Where I do agree with you, if after extended training and they still try this crap, they deserve discipline, suspension and/or being fired. Most answers to problems are not single sided solutions. Multiple things have to be fixed to correct things.

Until these highly informative UA-cam channels came out, police and government agents didn't think about knowing the ins-and-outs. Whatever they would command, the sheep would follow. I'm always amazed by the excessive police resources wasted to speak to someone doing nothing wrong. The auditor's innocence was established very quickly. If the auditor had been hiding in the trees filming that's a different matter. As the engagement becomes extended, however, it becomes more about police egos in their desperation to 'win'. They're used to calling the shots and don't like dissent. These things usually begin with one officer, then others arrive one by one and you can see them trying to outdo their colleagues in an effort to gain the prized ID. The funniest nonsense was the boss-man supervisor who really wanted everyone to believe that their only concern was for the safety of the juvenile detainees. Wow, that must be one hell of a camera!

Stop arguing with cops and stop trying to tell them what the law says. But when a cop says they have a "right" to detain and ID you, inform them they have no such right, they only have limited authority. Just tell the cop he/she is exceeding their authority and you have nothing to say and will not ID, and to either arrest or release you.
This auditor was too damn nice. Tell them, "How is my ID going to tell u I'm committing a crime?" Second, "By detaining me without RAS, u are violating my civil rights." Last, "Pls Honor the Oath u took to the Constitution!!" I know all that will most likely go right over the Leo's head, but a sergeant should know better. Now the auditor is being harassed by the police.
The problem with this stop is that the cops know the law, they just thought they could bullshit their way into getting his ID because it works for them so often. He called their bluff and they knew they couldn't intimidate him into giving up his rights. Rather than just admit defeat, their egos forced them to stick around till he left. Had he been a little more sure of himself, he could have told them, "I'm not leaving till you leave." And in fact, that would have at least taught them a lesson. They need to understand that people are waking up and exercising their rights, and the bullshit doesn't work anymore. This movement is about educating cops. Not educating them about what the law is, they KNOW what the law is. It's about making them understand that they can't scare, intimidate or bullshit us out of giving up our rights anymore. In doing so while recording we are also educating the people who watch so they don't fall for the bullshit either...
Auditing is more than picking up a camera and Filming . It’s a movement. It’s not for the uneducated, faint of heart; or the easily intimidated . People that cave hurt the movement. They'd have charged him, without cameras - he'd have to take a plea deal Their body cams are not submitted as evidence if it doesn't support their allegations. He's kind of covered so long as prosecutor doesn't block the video from being shown. You take plea deals because they throw so many charges on you, that risking it just isn't worth it. From my POV, they are creating criminals. I know I am significantly more 'criminal' than before interactions with police. No thug could ever teach me like police can, because you can hit thugs back. About a year ago this car drove up on my block and parked. He remained in his car while my dog went potty as I was smoking. It’s was around midnight. An hour later he was still in his car. So I grabbed a flashlight, went out front, shined my light and confronted him and we had a good conversation. Apparently he was stressed out by his family and needed some time to himself. I responded he wasn’t breaking any laws, and I only wanted to make sure this guy had a reason to be parked for so long and remain in his car. All was well and I went to bed comfortably. Majority of people call the police instead of having some balls.
And if someone calls the police because they have a “problem”…..then guess what? When the cops show up, they then have 2 problems. People need to quit calling on other people for petty things….because when the cops get there, it’s worse for everybody.

This is a case, like many others, that could end before it begins. If the information the 911 call taker is accurate and the call taker knows the statute then no LEO's would need to be dispatched. That said you would need a Supervisor ( LEO )to issue final approval to send out the troops. That sounds easy enough to me.

This is the first time I've ever heard them openly say they can detain and identify a person who they admit they have no probable cause to suspect of a crime. The officer and the supervisor both clearly stated no crime had been committed and they had no probable cause to believe there was a crime but they needed to detain and identify him to conduct an investigation to see if they could find probable cause. This takes it to a whole new level of stupidity. After that I was actually kind of hoping they would force the issue and arrest the guy. His attorney would have probably sent them thank you cards for handing them such a slam dunk win.

I'm an ex police officer and also worked with the Sheriff's dept. In this day and age, I'm completely shocked that officers still don't know the law on this ... especially with all the 1st Amendment Auditors out there. It not only makes the officer look bad, but the department as well. I've always said, "Law Enforcement is the enforcing of laws. If you don't know the laws, how can you enforce them?". Police need additional training on this, e-bikes and drone laws.
No, not "training" what is needed is ACCOUNTABILITY and DISCIPLINE. Would you go to a doctor that doesn't know what medicine to prescribe for YOU? Of course not. How long would he remain a doctor? I'm an arborist, if I come to your how and drop a tree across it, would YOU be OK with me getting TRAINING, or would you FIRE ME ON THE SPOT? Think about it. @@bbigrocker1 I understand what you're saying, but in the police academy (OPOTA - Ohio) we only received 6 months of training and there's just too much stuff to pack in that short amount of time. A lot of the laws you have to learn by experience. State Troopers here in Ohio have to ride with a senior officer for a year before they can go out on their own (if I'm not mistaken). In that time, they will have seen many different scenarios and laws. If the rookie oversteps, the senior officer will correct him. Not every agency has this policy and it's where officers get into trouble. Most of police think they're right while a few know the law and try to trick it out of you. The Police Academy should be increased to a year. 6 months of just knowing the laws you are sworn to protect and enforce. There would be little need for discipline if the officers were properly trained. Where I do agree with you, if after extended training and they still try this crap, they deserve discipline, suspension and/or being fired. Most answers to problems are not single sided solutions. Multiple things have to be fixed to correct things.

If it isn’t reasonable to suspect that a crime has been committed, then they don’t have authority to ID. Really really easy. No excuses on that.
@@JR-kc8jx It's very necessary to know this being a police officer and it is a simple thing, but unfortunately some do not take the time to educate themselves. Until these highly informative UA-cam channels came out, police and government agents didn't think about knowing the ins-and-outs. Whatever they would command, the sheep would follow. You can even say that the people themselves didn't know their rights either. I applaud most Auditors for educating us all. I've learned more by watching these videos than all of my time as being a police officer. It's the sad truth.

I'm always amazed by the excessive police resources wasted to speak to someone doing nothing wrong. The auditor's innocence was established very quickly. If the auditor had been hiding in the trees filming that's a different matter.
As the engagement becomes extended, however, it becomes more about police egos in their desperation to 'win'. They're used to calling the shots and don't like dissent.
These things usually begin with one officer, then others arrive one by one and you can see them trying to outdo their colleagues in an effort to gain the prized ID.

Stop arguing with cops and stop trying to tell them what the law says.
But when a cop says they have a "right" to detain and ID you, inform them they have no such right, they only have limited authority.
Just tell the cop he/she is exceeding their authority and you have nothing to say and will not ID, and to either arrest or release you.
California is not a stop and ID state. Even then you need reasonable suspicion.

This auditor was too damn nice. Tell them, "How is my ID going to tell u I'm committing a crime?" Second, "By detaining me without RAS, u are violating my civil rights." Last, "Pls Honor the Oath u took to the Constitution!!" I know all that will most likely go right over the Leo's head, but a sergeant should know better. Now the auditor is being harassed by the police.

“I am detaining you to find out who you are” When did they stop being law enforcement and become the figure out who you are police?
The problem with this stop is that the cops know the law, they just thought they could bullshit their way into getting his ID because it works for them so often. He called their bluff and they knew they couldn't intimidate him into giving up his rights. Rather than just admit defeat, their egos forced them to stick around till he left. Had he been a little more sure of himself, he could have told them, "I'm not leaving till you leave." And in fact, that would have at least taught them a lesson. They need to understand that people are waking up and exercising their rights, and the bullshit doesn't work anymore.
This movement is about educating cops. Not educating them about what the law is, they KNOW what the law is. It's about making them understand that they can't scare, intimidate or bullshit us out of giving up our rights anymore. In doing so while recording we are also educating the people who watch so they don't fall for the bullshit either...
Auditing is more than picking up a camera and Filming . It’s a movement. It’s not for the uneducated, faint of heart; or the easily intimidated . People that cave hurt the movement. Their body cams are not submitted as evidence if it doesn't support their allegations. He's kind of covered so long as prosecutor doesn't block the video from being shown.
You take plea deals because they throw so many charges on you, that risking it just isn't worth it. From my POV, they are creating criminals. I know I am significantly more 'criminal' than before interactions with police. No thug could ever teach me like police can, because you can hit thugs back. Police will just charge you more. It really bugs the heck out of me when I hear these officers say things like, I have the right to detain you. Officer, the detention of an individual is not a right. You have duties. So try that out, I have a duty to detain you. Doesn't quite sound right, now does it?

About a year ago this car drove up on my block and parked. He remained in his car while my dog went potty as I was smoking. It’s was around midnight. An hour later he was still in his car. So I grabbed a flashlight, went out front, shined my light and confronted him and we had a good conversation. Apparently he was stressed out by his family and needed some time to himself. I responded he wasn’t breaking any laws, and I only wanted to make sure this guy had a reason to be parked for so long and remain in his car. All was well and I went to bed comfortably. Majority of people call the police instead of having some balls.
And if someone calls the police because they have a “problem”…..then guess what? When the cops show up, they then have 2 problems. People need to quit calling on other people for petty things….because when the cops get there, it’s worse for everybody.
