- The world is awaiting a decision by the International Court of Justice (ICJ), on whether or not Israel has indeed committed acts of genocide in Gaza. Last week the International Court of Justice heard South Africa's case accusing Israel of breaching the UN Genocide Convention in the Gaza war, during a three-month conflict that has seen more than 20 000 people killed, and scores displaced. South Africa took Israel to the International Court of Justice accusing it of carrying out a genocide in Gaza. Israel's legal team on the other hand- said South Africa's claim was baseless and they had failed to make the case. To look at the ICJ's next move we're joined in the studio by the head of diplomacy and foreign policy at the University of Johannesburg, Professor Chris Landsberg and virtual by the Senior Lecturer Department of Political Science University of Pretoria, Dr Sithembile Mbete.

The problem is, it is very difficult to distinguish Genuine Moral concerns from a political power play. If South Africa took both Hamas and Israel to court, it would certainly be seen as a genuine moral action, rather than a political power play.

Hamas is not a member of the UN as Palestine is not a sovereign state. As such, they haven't signed the Geneva Convention. South Africa is unable to take them to trial. If Israel wants to take them to ICJ, they first need to allow the creation of a Palestinian state. Give them their sovereignty. Then they can take them to ICJ. Although, I can't see that ending well for Israel. South Africa is motivated by their own experiences overcoming Apartheid and their commitment to honouring the legacy of Mandela, who was a staunch supporter of Palestine.
