while I appreciate your sentiment, the fact is that with the reported fact pattern there is no way a prosecutor could charge terrorism, hate crime, or even an attempt murder charge, much less actually win such a case in court. We don't want the guy walking out of court free because the MCAO over-charged the case, so they should charge appropriately and win in court, and then demand the maximum at sentencing.
Tampering with food is a class 6 felony in Arizona. If it's his first offense he'll likely get probation, but max punishment is up to two years in prison. They need to set an example with this jackass.

It's also worth noting that walmart knows exactly who bought any of the affected products, given the high levels of surveillance (and credit card data that will show them purchasers data).
