    What do you think? Was Day 29 strong for the defense, or did you see weaknesses I may have missed?

      In general, I felt that Lally’s crosses tried to elicit the same results as Jackson/yanetti, but he seemed to lack receipts. It’s been a few days, so I’m forgetting exactly where that happened, other than the 18 month subscription (which seemed silly of all things)

      So with regards to tech savvy and the search, it doesn’t really apply here. I say this as an experienced IT professional.
      At the end of the day the knowledge required to make an informed analysis of this particular issue is so INCREDIBLY specialised, that even most very tech savvy people would come up short.
      What all the specialists said could make sense, but who is right can only be taken on faith for anyone without experience with analysis of data from this exact part of iOS, for this exact version. That’s the problem.
      So were I in the jury, I too would say: This is almost completely irrelevant to the question of Karen’s guilt, I’m gonna ignore it.

      21:29 - Just so you know... You were referring to the 2:27.am search from Jen McCabe's phone but you referenced it as John's phone. Just a little mistake that could cause some confusion. 😉

      Also with Lucky, Lally tried to impeach him on the timing of the other passes, like the first one being earlier, and Lucky said no we didn't even get the call till later so that would be wrong. It felt like to me Lucky was like having his feelings hurt that Lally was insinuating that he lied or was wrong.

    I audibly gasped at the end, when you mentioned the deleted google search for an attorney. I’ve rewatched this several times and didn’t pick it up. Absolutely disgusting behaviour.

      I also didn’t pick up on it but I saw it as a way to discredit the witness. As in of course you didn’t scrutinize the defendant’s phone as you were hired by the defendant so all of your analysis is biased and therefore shouldn’t be trusted. And to be honest that kind of worked on me but I also didn’t know that what was deleted was just Read deleting hiring a lawyer. So yeah it was very much a dirty tactic by Lally that I think in most part worked.

    I didn't like Lally trying to use an article from 2008 about bite ID. You cannot identify an indivual person biting another, but you can say a human did bite. He was misconstruing the research and article there. The same applies to dogs and other animals - you can determine likely size and creature but not the exact breed.

      Unfortunately the evidence of matching bite marks to individuals is still admissible evidence in court. It's also been so perpetuated in the media thanks to cases like Ted Bundy that I would say most of the public doesn't realise how inaccurate it is or the context of why its accurate in some cases and some not.

    The monotonic clock is almost certainly the worst clock to rely on for the purpose of forming a timeline. It can only count upward (hence monotonic) and is therefore used primarily for calculating durations of time, rather than telling you the time.
    For example, you wouldn’t want a 15-minute timer to run for 1 hour 15 minutes just because of daylight saving time. I’m glad this was brought up.

      To be explicit: a phone with a fast internal clock could result in the monotonic time drifting apart from the display time. The display time will be corrected periodically by cellular and other networks, but the monotonic time will not (since it by definition is not allowed to go backwards).

    I caught that with Lally asking about any deleted searches. I thought it backfired in that she (read) didnt delete anything whereas the prosecutions witness (mccabe) had deleted stuff.

    Love these recaps. For many trials I have the time and mindset to follow along with the live streams. However, this case was soooo long. The only time I was engaged in the live streamings was when the defense was doing their cross. Before this case, a part of me was looking forward to jury duty, but this case made me apprehensive about it actually happening. If I was on this jury, I don't know if I'd be able to stay awake and focus. These recaps are the main reason I've stayed engaged in this case. EDBs recaps are short and sweet but I enjoy the length and detail of your recaps. Great job!

      You are kind. I am a peaceful man, but at different points listening to Lally go on and on… I thought that if I were on this jury, even I might have considered homicide: against him! I would’ve considered it self-defense-because I’m afraid he might have bored the whole jury-to death. I do have jury duty coming up next month, and now I have no idea how I’m going to feel about it.

    The ARCCA report was made available to the Commonwealth MONTHS ago and the district attorney didn't like the truth. So they ignored it and went ahead with this absurd prosecution. It's mind-boggling. It's an utter disgrace.

    I love watching your channel. You give great commentary and you don’t talk non stop over the live trial. I appreciate that! Some UA-camrs don’t even try to pause the feed when commenting and It’s hard to hear anything at all. Especially when you have ADD like I do.

    Lally’s a disgrace. Admittedly I have only this case to go on, but the man is a poor lawyer, his approach to some of the evidence has either been incompetent or deliberately misleading, he has no charisma or ability to connect with people on the stand, his questions read like a rambling Reddit reply, and apparently he couldn’t give a toss about people’s right to search for an attorney. Man’s a disgrace.

      I agree but I genuinely think his bitterness came from the entire internet making fun of his intelligence and how outmatched he is against the defendant’s Hollywood team. I should say this has nothing to do with why on earth he prosecuted KR and his dirty tactics but just an observation.

      Just the fact that he brought this case to trial and is wasting resources that could have been used elsewhere make me question his ethics. Jon O'Keefe does deserve justice, but Lally should have known this wasn't going to get him that justice.

    I had a lot of questions after the CWs experts testified. They didn’t use the same operating system, they didn’t have access to the whole phone, and they both spent time discrediting Mr Greene.
    Mr. Greene however, answered honestly, in terms easily understood, and conclusive.
    The CW spent way too much time and resources to discredit that search, I am apt to think it did happen, and Mr Greene solidified that for me.
    I knew nothing of this case before it started, and I have been not guilty since Matt McCabe was on the stand.

    Loved Dr Russell. Eminently qualified and experienced. From the first time I saw the photo of the arm wounds I thought dog bite. I’ve seen a few dog attack patients in my years as an Emergency RN, and that was my first thought seeing those wounds. Dr Russell was able to explain why, especially the small roundish ‘punctate’ marks from the point of a tooth.
    I can’t wait for the ARCCA experts. I’ve also seen and cared for pedestrians hit by all manner of motor vehicles at varying speeds. I have never ever seen such localised injuries. Ever. Nothing else other than severe head injuries, arm abrasions and another minor abrasion on one knee. Rib fractures consistent with active CPR (have felt that happen myself, it’s not pleasant). I know I’m not an expert, but this just hasn’t been my experience with vehicle v/ pedestrian injuries.

    LYK tried to say that at the end the forensic expert looked bad because he agreed with Lally's "people can misinterpret celebrite data like you have now". But I agree with your assessment about how in the end he looks credible. The witness seemed like a sweet old man who is trying to answer the question without taking offense at the small digs from Lally. His explanation that with the different celebrite updates was good, but still in the end I don't care if Jen made the search at 2:27 nor does it matter. All the witnesses on that point cancel each other out in my mind.

      Exactly. I thought at first that the 'hos long to die in cold' search was a big deal but it's not really that relevant in the grand scheme of things.
      Having said that, if it wasn't really such a big deal, why has Lally spent so much time trying to prove she didn't make that search at that time?

      The other thing that really stood out to me with this witness for non-tech me was that he did all his things with the same phone and same iOS. The CW tech experts each used different phones/OS. That resonated common sense with me - apples compared with apples. Much more credible imo.

    it will be a great injustice if Reed is convicted - it’s an injustice she had to pay high dollar attys and suffer through being charged in the first place! Shame she can’t SUE

      She may be able to bring a civil suit IF the real story comes out and the real perpetrator gets charged. If it comes out that it was colin and everyone is covering for him, she could probably file a civil suit against the parties that lied. One would think she'd be aloud to at least recoup some of what she spent to defend herself

    Green plainly enjoyed his work on this case . Dr Russell was getting annoyed with Lally’s rudeness . I could see her jaw pushing out and she went into a very professional mode . She was very impressive .

    @Alyte, did you get a chance to see the videos of @Turtle boy in Canton yesterday? He went there to do an experiment on the "ascending/descending" theory on Oakdale Rd? after he debunked it (as it's "the flattest surface in the world") in his words, he went to the bar/restaurant where KR & JOK were (to have dinner) & basically pictures were taken, suddenly he & Melissa were ambushed/ had phone smacked out his hand, then taken from him. He was threatened & lots of bad words & accusations were made but all caught on multiple phones. Not sure if it's all over UA-cam but im sure it will be. Sorry for long message, just wanted to know your take on the whole thing?

    Waze, for security reasons has a 5 min delay on people’s GPS location. If you use Waze you can see other Wazers on the road. There is a delay so you cannot stalk someone. I believe Waze has this on a FAQ page

    Jen's search doesn't matter to me, either way. I've thought all along Lally doing all the direct and cross extremely unusual. Especially in a case this long and complicated. Now I think it was so the CW could control all the witnesses to stay the course. Another prosecutor, especially from a different DA district might have viewed the "evidence" differently and raised the red flag. Or maybe the other prosecutors were smart enough not to get involved. Just saying!

    When I first saw lucky loughran come up to the stand I was quite concerned and then he started speaking and I thought oh my goodness I'm really worried for this guy Lolly is going to be so mean to him and the cool part is is that he really held his own even with the basketball hoop thing I was so impressed with his testimony when he was done but the best part of all was absolutely when he said that God forbid any animals, I cried out with joy that he was such a kind person because it seems like there are a surprising number of kind people in Canton in spite of some of the ugliness that goes on. Of course that's everywhere but after watching the whole thing with Turtle Boy last night in Canton at CF McCarthy's when the entire family was harassing him and two of them assaulted him by snatching and hitting his phone out of his hand the best part is is that at the end when it was all over there was like the last half of the video was like the whole town of Canton showing up and waiting in this huge line and in the parking lot with all these people waiting to take pictures with turtle boy he was signing teenage boys chests and all kinds of stuff it was great there were so many people out there in support of him. It really said a lot

    Ultimately the defense’s witnesses so far seem much more credible as a whole than the slew of witnesses the prosecution presented. I think they came across as open, not defensive, not evasive as if they had something to hide, and not manipulative as if still in the act of hiding something. If there was a major problem with their testimonies, I think it resides more with Lally’s questions than it does with the substance of their testimony. If I were a juror and had to do a side-by-side by what I saw from the witness stand from these three as compared to, say, Proctor, Paul, and Jen McCabe, for example, those experiences are worlds apart.

Was glad for your response...as a juror, there are far more important points to ponder, so I'd probably not concentrate on this one so much

    Huge difference when you have witnesses lying and being confrontational while trying to defend their narrative and then then witnesses who are being truthful and honrst come across polite and helping.

    Lally citing an NAS report which strictly analyses human bite mark impressions only was absolutely ridiculous. Whilst the premise could be considered similar, at no point did Dr. Russell ever claim she could match the impressions to one particular dog and when she attempted to say she’d read an abstract of the report Lally ‘barked’ 😂 her down about never reading the whole thing. Why would she Lally, dogs are not humans and she has never published a paper on matching dog bites to a particular dog…all in all entirely irrelevant and she despatched his buffoonery with grace IMO. The jury will certainly remember his tone with her however…he’s not scoring any points there!

    I'm not sure whether this stood out to anyone else, but when asked whether she /felt/ pressured to deliver a certain finding, Dr. Scordi-Bello unequivocally answered that she didn't. When asked a hypothetical question to the effect of "What would you have done if someone tried to pressure you," her answer started with something like "I told them...," not "I would have told them..." So, the question was hypothetical, but the way she answered it wasn't hypothetical.
    I think most people believe Dr. Scordi-Bello testified honestly. I believe that, too. All of her answers make sense if she recognizes that MSP tried to pressure her, but she didn't feel pressured.

      It is unbelievable how many people do not see the impossibility of Karen doing it . She was at John’s house when they said he was hit . Plus lots of other evidence including the dodgy manner of evidence given by most of the prosecution.

      It doesn’t have to be binary, you can back the blue, the good blue and still be disgusted by Proctor, Higgins etc. Their supervisors allow this to happen and should be fired.

    I totally missed that Lally had tried to introduce that someone was looking for a lawyer as proof of guilt. If that arguement was allowed in cases, then everyone would be guilty of just showing up to court with a lawyer representing them.

    Just getting into this case today. Best clip was the first with the cheer from the crowd. From the little I know just watching the defendant Karen, today w last 3 witnesses, she's innocent and being vindicated. I know as I've been in her place.

    Pokémon go uses distance walked. If you don’t turn on step counter through the health app it will give you distance walked if just have the app open. Idk if they fixed that but that’s why I don’t trust gps to be that precise.

    I think Lucky and Lally got their wires crossed, he looked down Fairview while going to another road to make sure he didn’t need to clear it again. He’s seen going back along Cedarcrest? at 6:10 by the troopers cam. He passed Fairview often but only made three passes I think.

    I know who I’d rather have on my team and for me, it comes down to who has prepared better for trial, whose case makes way more sense and who doesn’t come across like this isn’t “just” a point scoring game but rather for justice for a fallen Officer and his family.
    But I do have a bit of a soft spot for Lucky and Mr Green!!

    I think if the defense had just rested without calling any witnesses, they'd still get a not guilty verdict because the state failed to prove their case. I get why they didn't do that, but it would have been a big balls move.

      The jurors don’t have any say as far as dismissing a case. They decide if she’s Guilty or Not Guilty… ! At this point, the case will not get dismissed. If it results in a hung jury, a mistrial will be declared. They will more than likely try the case again !

    The judge asked Lally how long it would take to find someone to give rebuttal to Dr Russell's testimony and he said it would take about a week. Then she testified just a few days later. Now that the CW have rested does that mean they can no longer bring someone in, or can someone still be brought in under special permission due to Dr Russell entering the trial so late on?

    I would've been lost on day one if it weren't for LegalBytes' analysis. During opening arguments it sounded at first like 3 couples were involved in the who, what, where and then all of the sudden it was somebody's cousins' boyfriend and some neighbors' kids and some other person's kid who was the godchild because the dad died. Then 2 adult couples were at a house, but wait it was actually 10 random people who didn't know each other, and before that the adults were at a bar, but something about somebody's uncles' pizza parlor and they had met at the waterfall, but it really all started in Aruba where siblings were vacationing but didn't see each other because they were on opposite sides of the island and some of the people in Aruba were at the waterfall.
    How could anyone follow any of that? I would've been so frustrated if I were a juror. I need a diagram of who these 50 people are and a timeline on day one, then tell me what matters. Lally never did that, he just threw information, relevant or not, at the jury for 29 days. He has spent all this time throwing every strand of spaghetti he has at the wall and none of it is sticking. If I were a juror I would be so angry that I had spent over a month listening to all of this and there's no evidence of a motive, how he was hit, where he was hit or that he was even hit at all! They can't even prove that she hit him! Before this case started I thought they would be able to prove that and it would be a question of if it was accidental or intentional. But this is like looking for a smoking gun when there's no bullet. Unbelievable. 🤯

    based on all the things that Lally (sp?) is not doing well, it makes me wonder if he is doing that on purpose. I wonder if he personally doesn't believe she is guilty, but has been told he has to prosecute her.

      The waters are basically just muddy but I personally believe that she did.
      Prosecution has a few people who claim that it somehow retroactively logged the data.
      Defense has a person who says that that WAS the browser state at 227AM and performed an experiment with a similar phone to duplicate the results.

      Yes. She did. An actual expert explained why.
      The prosecution tried to muddy the waters. But just look at the pattern of deception and lies from most of the CW witnesses. They’ve shown that they can’t be trusted. Especially any of them in law enforcement.

      According to the defense expert yes. He texted it with the same IOS she used, and found it would have to be don’t at 2;27am. It’s irrelevant at this point but does point to a third party. It also explains the multitude of butt dials and deleted calls. The McAlbert’s behaviour was very strange.

    Lally made some crosses and comments that I believe he was pulled up on by the judge, " ask in a way where you will get a response." I believe were her words. his comments where dripping with undeserved sacasum and very unpleasant. He was coming off as extremely unlikable. i think he knows he's lost and is somewhat humiliated at this point. hence the taking it personally and increased bitterness. what I cant understand is his lack of any self awareness seemingly doubling down on a case so flawed it should never have been brought to trial. imaging being angry that your evidence is exposed as flawed, weak and the investigation corrupt. To me that makes him complicit in the corruption. if you can look at what trooper proctor has said and how the investigation was carried out and still be enraged when your 'evidence' is destroyed then sir you are as dirty and unaware as the cops that carry'd out this 'investigation'. He would do far better to just be professional and treat witness with respect regardless. it should be about the truth not personal. Seems like everyone in the case from day one hasn't ever been aware of this most basic principal. sorry rant over... Lally is the worst.
