    Nick got so much more comfortable talking as the podcast went on. He was sweating bullets at first but then he got more relaxed and it was the best interview u had yet Spanian. Nick's a good guy. Cheers to u both!

      @Jump Countaz pulling the piss mate, this podcast alone I’ve learnt a lot about the justice system and civilian rights. Also he’s had a few guests on that have opened up my eyes to mental illness and other things that school doesn’t teach you. Each to their own, I find his podcast a great platform of information on things I had no idea about and more importantly things regular learning curriculums like school don’t teach you. I’m 24 btw, I just find his podcast intelligent and intellectual. He isn’t just using it as a place to have yarns with other rappers etc he’s using it as a platform to teach people about all different walks of life. Merry Christmas 🎄

    Getting randomly searched on the street, yeah they have to have reasonable suspicion. But reasonable suspicion can be many things, things you cant disprove. Such as an officer claiming they could smell drugs.
    As for The FPO sounds somewhat similar to the anti consorting laws up here in Queensland. Something the police often use to abuse their power. I was flagged a few years ago under these laws and had my car torn apart 13 times in 2.5 months. On the way to work one morning I told the officers they know there's nothing in my car. They admitted that, but told me they were doing it "...because we can...".
    I've only ever been pinched for trespass and resist arrest. I'm not mates with any club members, just associated with a couple of people with criminal records, yet was still copping the bullshit.

      Same here. I have friends that have a history, one has a FPO. If he sets foot in my house or sits in my car, it’s open season for the cops.

      Smelling drugs alone is not reasonable suspicion in NSW. Ordinarily it will be accompanied by other suspicions, but there's case law out there that says the smell is not enough

    This is actually really great. There's a lot of good content on your rights with police but it's mostly American that doesn't really apply here in Australia so kudos for teaching this to the people who really need it. The way you encouraged the guest to really open up just by being positive and receptive to what he was saying was exactly how a host should conduct these interviews so well done

    Spanian as always a great listen and props to Nick for his forthright answers and conversation. I was surprised to hear that you weren't up with the knowledge on those things you have been convicted of Span.
    And dealing with legal aid is a fine line I've found that self representation in a lot of case's can and has worked for me. Police prosecution will use any tactics like intimidation even of solicitors (especially junior defence representative) I've had charges dropped from my legal aid pushing for me to plead guilty to fronting them myself in a confident but polite manner that I know the brief is totally untrue inaccurate and I am adjourning today as I am currently working on producing the evidence for this.
    Or just drop 6 to 14 and I cop 1 to 5. Without even reading 3 lines of the brief the answer is yes and thank fuck it was as mandatory sentences with assault on public worker's (police) walking out with fines. Lucky
    Sometimes hard to convince your representative of your inasence immediately notify them of their firing regardless of whether or not they believe you. They must represent your side to the best of capacity and if there really telling you to plead guilty and the actual truth's your story it's probably best to cover yourself as they not going to do it if already not believe your truth. Next time I want to see the filth across the desk to answer some questions about the system.

    I was full waiting for TRG/RAPTOR to come flying through the door when Span and Nick start discussing the FPO situation. I can imagine the fear and paranoia that FPO’s cause.... to those with an FPO in place, and anyone who knows how they can affect people’s lives in such drastic ways...
    Cops having the capability to use/abuse those powers is absolutely the most putrid of the putrid going...

    The way cops talk!! Ya not paranoid this is so spot on it’s not funny. I’ve dealt with this 99% of my interactions with them I know EXACTLY what you mean.
    They incriminate everything you say before you say it. It’s like their entire interaction with people is built of the potential that they have to hold a case against the person in court.

    To anyone out there, always conduct yourself with respect and do not get upset or belligerent.
    It may be used in court to assess your character, regardless of innocence.
    Ask 'am i under arrest?' If they say no you are likely free to immediately leave.
    BUT if they say you ARE under arrest, you must immediately ask for legal counsel.
    Do not make any statement. Police are performing a function and they are not your friends.
    They want to know if you commited a crime.
    Talking to police without counsel has incriminated alot of people & even innocent people can set themselves up for disaster by naively helping police.
    JCS criminal psychology is a fantastic and entertaining channel that breaks down notorious cases and he highlights all the interesting details of a case.
    I highly recommend, its not like a regular lawyer channel...
    This guy makes them extremely entertaining and insightful.
    The last video feature a school chooter and got like 55 million views coz its made so well.
    Think it was the parkland chooter but he has like 15 on his 2 youtube channels.
    Theres like 100 on his patreon

    this is excellent. Thank you Spanian! I was literally chatting with some friends the other day about this. the cops take advantage of people that don't know their rights! good on you for spreading this information.
    when I was living in QLD I had some "police" turn up at my apartment asking for some woman because of a random traffic offence. over the intercom I told them they had the wrong address - they insisted that they speak to me. Thank god I was smart enough to meet them at the entrance of the building instead of letting them up. They tried to push past me when I went down and I started up...they figured that it was going to be more trouble that it was worth and ended up leaving.
    At the time I was shaking because they didn't 'look' like cops (except for the uniform) so I then phoned fortitude valley cop shop and asked if anyone had been dispatched to my address. It really upset me because of the intimidation and I would have been noticeably shaken on the phone. to this day, never received a call back.
    I now know what it would have been related to. It had zero to do with me, but I believe a taskforce wanted information about a client of mine but had zero grounds to arrest me and so decided to try run a dodge. The taskforce detective then laster tried to call me in for a voluntary interview (trying to exploit thinking I had no idea of my rights). They then received a letter from my lawyer to cease and desist.
    Either way, lawyer or no lawyer, don't trust them, do not give an inch and educate yourself about your rights. Had I let them to my apartment door that day, they could have done/planted ANYTHING and because there was two of them and one of me...this stuff DOES happen.
    I'd have been up s##t creek.

      Spot on it certainly does happen daily basis. People seem to forget to there very first right given in the Miranda is silence. Name and address is all the popo need to hear. It's not up to you to do the job for them. Guilty or not only a magistrate can decide on the coarse or justice. He's the one that you have to make sure of your inasence.

    First thing you do when you go to court, is to get the magistrate/judge, to prove he is an officer of the court/Has been commissioned by the crown.
    Don't be surprised if they flea the court room after you ask them.
    Courts have an ABN. Consider what that means!

    As to the last question. They raided me 3 times in one year. No drugs. Not a $5 note. But they took a phone. Went back a year and a half and ever message that was just helping a mate or saying just "bro sesh?" They came and charged me with 123 supply charges which turned into trafficking. I did 3 years, got immediate parole but just because my sentencing news the day before the first lockdown . March 23 2020 Qld

    Of course it happens! I paid for a QC who happened to be friends with the judge and I got an absolute crazy outcome but I had to pay close to 100k . These guys play golf or go shooting rifles together they have known each other for years their kids know each other its only common sense . People say oh lucky ur not in Thailand but that is bullshit it cost me alot less over there to escape trouble because 5k to them is alot of money . People who go to jail over there don't have or won't pay the money to pay off the police that is THE ONLY reason they go to jail or get put to death over there. Spanian is not stupid he knows exactly how it works .

    i need this lawyer in perth, i got trial in july for possessing pepper spray while walking by myself through the assault capital of WA (northbridge) at 3am on a weekend even though Perth is the only state where it's legal to posses pepper spray. Gonna cost me an arm and a leg to fight these bs charges

      Well yeah that’s how it works, a solicitor deals with the client and instructs a barrister if they go to trial

    At the end of a case, in court, this judge said it was eets for me to refuse to give my ID to these cops and then run away from them after being grabbed and pinned to the ground, just because they didn't identify themselves or tell me why they stopped me. yeeeee booooiii

    HEY Spanian Thank U so so much Totally appreciate u doing/asking these questions bloody gold. U probs won’t see this cause U actually are a super STAR. My son in jail going thru Court he was living here b4 he went in cops been here 4 times since he’s been In searching for evidence. I know they have been in my house when I’m out I set hidden cameras n little traps n drones follow me walking dog n when outside. some cops are corrupt I’m single so it’s only me that sees this stuff my family n friends think I’m loosing it but No I’m not. It’s a lonely world living this cops shit by myself I CANT RING COPS TO ASK FOR HELP as there who I’m complaining about cops want my son plead guilty n they will drop 3 also if his charges REALLY u can’t defeat them as they change the rules as they go to suit them. I always had respect for them but Fffff NOW I’m just totally blown away at there style or lack of respect for me his mum that’s innocent trying to break me so I tell my son what there trying to do n he does what they want just to get them of my back n his mates. CORRUPT UNFAIR FOR ME ….. THEY WONT BREAK ME …. So I’m so grateful to have found this now I don’t feel so alone in this Ffff up battle. Your a bloody Guru. Thanks💯🤩🏆🔥🔥

    FPO's need to be seriously looked at as they have no place in 80% of the time. They should also have a expiry date, lets say 3 year which is a far timeline. It's is like giving a junki unlimited access to whatever drugs they feel like. Just absolutely ridiculous.

    If you get a legal aid lawyer, they will not represent you on a not guilty plea (In the majority of cases). Because they don't get paid enough.
    They'll tell you to plea guilty because to represent you on a guilty plea, they can make that stuff up on the spot. They're just pleading with the court to take it easy on you. There's no time, effort, or research necessary to do that.
    If you plea not guilty, they actually have to work for their money, and to represent a person on a not guilty plea is a lot of work and research, they have to speak with witness', they have to read all of the witness statements, police statements, etc etc etc.
    Regardless if you plea not guilty, or guilty, they get the exact same amount of money. They do not get anymore money to represent you on a not guilty plea. It's just a whole lot more work and time they have to commit to get the same amount of money.
