Copyright Claims on Medieval Dynasty(My Opinions)

My channel and many others have apparently been impacted by what seems to be false copyright claims. I just wanted to share my thoughts on that and Toplitz Productions, Render Cube, and Elina Ungarova all getting involved to help all creators. If you have been impacted by this. They have a post on social media(i.e. Twitter) and a post on steam to help you get in contact with them about what to do next. I think its great that they are getting involved in this. As creators we are limited to what we can do on our own. With the publisher, dev team and music creator all in, I hope to see this situation fixed sooner rather than later. Thanks to all the teams. And I hope all content creators affected can get some relief soon. To help out your favorite creators, be sure to share their videos. Also, like and comment, as that help boost their content in the UA-cam algorithm.

UPDATE: As of this morning just before the release of this video, all claims on MD have been released. From 632am to 640am, all claims we released. We beat them this time. But how long before more fake claims take days or weeks of revenue. To add, sometimes with older videos especially, its hard to know right away if the claim is fake or not. Sometimes older songs or music gets copyrighted years later. The ease at which claims can be filled needs an overhaul.
I just got hit with a few this morning.. I also agree it's great the the whole dev and production team has everyone's backs!

@DeuceMS I'm still waiting on that to happen. I was only hit with 30 strikes. Hopefully, it gets resolved soon, not that it matters revenue wise for me, but it's still a pain
My copyrights on Medieval are slowly being being released, starting yesterday (July 10th) so it seems they are working on it.
Seems that all 140 of mine were released at 630-640am this morning. So at least that part is fixed. Hope we can see some change in how copyright claims are applied at some point. Im not holding my breath though. Lol

UA-cam should automatically strip every copyright claim that is associated to MD content. They should have databases that they can query and find all of them.
They should have a data base of official copyright holders/companies. It silly to me that anyone can claim/strike any other channel. Now, if you do it with malice, and use it to abuse the system, you can get your channel deleted or even face jail time as I mentioned. But, it seems like that is very rare. If people try to claim/strike some one else's channel, they should have to prove, without a doubt, that it belongs to them. Instead, it seems like anyone gets to put a claim out, then its on the channel to prove its false/wrong copyright. Its crazy honestly. But, UA-cam seems to the be the place of guilty until proven innocent.
@@DeuceMS I suspect that this is going to become more and more common as it seems to be a way for a quick buck. It is just another scam that is being done, just like those Microsoft scams coming from call centers. As they are getting busted from those scams and people are becoming aware, they are probably diverting and doing this kind of thing with their manpower instead. YT needs to fix it requiring proof prior to issuing claims against videos. That would stop the false claims drastically.
This to me makes no sense. I thought only the content creator or person(s) owning the rights to content could file a copyright claim. Since neither Toplitz or developers associated with Medieval Dynasty have done this, how could a copyright claim even be considered by UA-cam or other platforms? Maybe I'm missing something because I don't create content but it just seems to me to be a moot issue.
Thats the exact problem. And my biggest complaint about the copyright system on UA-cam at least. The fact that anyone can claim anything with little to no proof. Its a terrible system that needs fixing.
Thank you for putting this info out there . I hate to hear that so many creators were hit by this troll. I agree that the YT "CR" system is definitely backwards and it is too easy for someone to but a false claim on your content.
It is, and it’s going to continue I feel. I’m not sure what steps would help fix it and I’m not sure YT cares. They get their cut no matter what channel is getting the ad rev.

I appreciate that! I try to be as honest as possible while keeping in mind what is said effects others. Not sugar coating, but aware.

The copyright is always to the creator and not the publisher. So, render cube would own the copyright. The Publishers' duties are to seek out copyright infringement. They would most likely, with music created in-house, not seek restitution with content creators as it benefit them to sell more copies. This is why most games are able to be streamed without any penalties. Now, music created outside and with needed licenses to use in games are not safe to use in streaming as all royalties would go to the creator and not the publisher. Background music is not copyright free. You do not have a license or agreement to use, so the creator and / or publisher can claim copyright infringement. Anyone can claim a copyright infringement, but it is against the law to file false claims in the United States. I know a little about copyright vs publisher rights.
All this is very true. I think where the fine line and kind of blurry, grey line in this is Fair Use. If it has been modified or is not the focus of the video, it could fall under fair use. Not always, but it should as that is the way Fair Use agreement reads. It a video has been modified, i.e. reaction videos, it would also seem(in my understanding) fall under Fair Use. I think that would include gaming videos that the game is the focus, not the music in game. So either way, again in my understanding, even in game music when its not the focus should fall under Fair Use. Not a lawyer, and not a legal argument, just my understanding.
I should also add, the music Im using in the background of this video, is MidnightPlayTime. He makes copyright and royalty free music as long as his bandcamp is linked. So thanks to DantotheFuture on twitch.

@DeuceMS This is something that the owner of the copyright can do. I think under his music, it should be a statement like this...CC BY-SA
Right, this is what I was trying to say. This exactly. Anything that is transformative in a manner that is used for any of the options you listed would be what gaming content(mostly) is.
Most of my copyright claims got released today. So they are working on it and getting results

Fun fact: developers keep going on about releasing coop late this year but we’re almost in September I got blocked from there page asking if this might be the reason why the update is being delayed and they failed to be honest even tho we know this is def the reason why coop hasn’t came out yet I’m here to tell you the developers give no fucks about this it’s why they got trolled in the first place 🤳🏽💯
You presented this as fact. But All I saw from the get go when this started was the devs and Toplitz Productions reaching out to help clear it up. Which they did in only a few days. Keep in mind, I had nearly 100 claims. Im just 1 small channel. I think they did a great job in contacting creators as a group and helping out. Most games actually do not care. A lot of games use blatantly use mainstream or copyrighted music. All in all, I dont think, the co-op was pushed back due to this. Seems like a reach. Im not sure why it was pushed back, and dont really care. As the dev team has delivered everything and more, that was promised. Im no fan boy. I have had plenty of criticisms of toplitz productions over the years. I had the opportunity in the past to stream to their steam page and get early access to LumberJacks Dynasty. But, I had my pretty harsh comments about the game. I have not been contacted since. That doesnt bother me. So when I show praise, I do not do it from a place of blind spots. I have plenty to say about Wild West as well. Again, I just dont think this week and a half copyright issue is why the co-op was pushed back.
One more reason to support this game and its creators!
Not necessarily getting accused of this is not something to accept for all you know this can be your last time playing the game why you think the new update hasn’t released yet…. For coop
