Phoenix tried to bring the 8 feet "law" for recording police. But that 8 feet "law" was struct down by a judge as they deemed it violating the 1st amendment. The female cop straight up lied. Also, what's wrong with standing at the back of that "officer"? It's not illegal to stand behind a cop. I'm sure a lot of ppl stand at their back when they go to Starbucks. This is why you ALWAYS record any interaction with law enforcement. They will do whatever or say whatever for their little reports and 99% of the time they will get away with nothing more than a slap on the wrist.

This lady gave an accurate and honest account of what transpired. I'm so happy she spoke with him prior to entering the bank, and explained that he introduced himself and explained the story he was preparing. Her courage for not hiding and giving an interview is a heroic act seeing that the weirdo's will try and discredit her.

Not sure if you could give a honest and accurate account. She also said the guy was not doing anything but someone had to call the police.. She observed the police talking to the branch manager but she does not know what was said or what happened between the police or the victim while she was inside… I’m not saying who’s right or who’s wrong but you should have all sides of the story before making a conclusion, not just 1 side.. that my friend is being called guilty before proven innocent.

If the reporter never went in the bank and stayed on the sidewalk, he wasn't trespassing. Also, it sounds like the first officer went into the bank and solicited a trespass. It sounds like it was a illegal detainment from the beginning.

I organized the copwatch program in my city. Every single time I have stopped to do copwatch, I've been threatened with arrest. Every single time. I always take a few steps back and then continue observing. If they threaten again, I react by silently holding out my arms to be cuffed. In all the years I've been doing this, not a single cop, not the dumbest meathead on the force, has ever taken me up on my offer. That's because they all know who I am, and that there will be a press release, a professional standards complaint, and a lawsuit before the cuffs finish ratcheting shut.
It's not because I'm some kind of super-radical, but because I've built a supportive network of mutual aid before I went and painted a target on myself. We can fight and we can win, but we have to be cautious, and we have to work to build resistance _before_ it becomes necessary.
The hero police officer was clearly in fear for his life as he threatened arrest. Officer safety is paramount. Back the blue!

If the officer was so justified in his arrest, why'd he release him without incident literally minutes later? Seems like the handcuffing was just intimidation, hoping he could get the guy to confess something, retaliate in some way and book him for resisting, or find something on him. Anybody who is a customer of Chase Bank and is appalled by this behavior, should complain to Chase and change financial institutions. This man was simply doing a story on Chase, as a reporter, that would be his job. I am more interested as to why Chase seems to be hiding something. What is it that they didn't want him to find out about.? Shame on Chase for facilitating the violation of an innocent citizens rights.
Amazing how police body cam footage mysteriously deletes itself when it's time for court.
There are laws and rights the police department is not adhering to. Reporters can be asked to leave business private property but must be given the opportunity to leave. If a reporter refuses to leave then they can be detained, identified, and formally trespassed. This Wall Street Journal reporter agreed to leave and the officer stepped in front of him to impede his movement. The officer then quickly detained him in handcuffs to ID, trespass, and possibly arrest (had the witness not been recording). The trespassing law is very clear here as well as the 1st Amendment that the officer violated.

I wonder how that cop reports measurements on a crime scene? "The suspect was 9 feet away", when there's clear evidence that it was more like 25 feet.

You ever have that feeling that your not being given the full story?
I'm not a reporter, but I wanted to see if I could look for more information on this story. I first went to Broadcastify to find a recording of the dispatch, but the archives were hard to understand so I did a search for the police report that this video showed excerpts from. I actually was able to find it on the ABC15 website so I printed it out.
Karen (which I will use to refer to Katelyn Parady) said it was untrue that Dion was asked to leave. So I was wondering how she knew this. Looking at the printed report of the incident, the call to police occurred at 2:40pm and was dispatched at 2:43pm. The officer arrived at the scene at 3:08pm and first went into the bank to talk to the manager who made the call. She said that she asked this man to leave and also explained that approaching customers entering the bank was making some customers uncomfortable. The manager said he refuse her request with the excuse that he is a reporter. The bank manager told the police she wanted him trespassed from the property.
So, the request from the bank management happened 30 minutes before Karen showed up, but the interviewer from ABC15 gives Karen's side of the story that he was not asked to leave. ABC15 had the police report that showed he was asked to leave, but only reported Karen's side of the story that he was not asked to leave. If the Incident Report said he was, by the bank manager, why didn't the news reporter call the bank to confirm? Maybe that didn't fit their narrative or “why bother, that sounds like work and reporting 'police bad' is a better story”....
Next, the officer went outside to confront Dion while Karen was doing her banking. The police report states that the officer explained that Dion is being trespassed. Upon the officers request for Dion to supply ID, Dion refused. Multiple times. At this point as we all know, Dion was placed under arrest in order for the officer to complete his investigation and fill out the necessary paperwork for trespassing. However, Dion didn't like this idea and refused to put his hands behind his back. Dion did try to pull away, resisting arrest until the officer was ultimately successful in applying the cuffs.
As we see from the video, Karen comes out of the bank and sees Dion being handcuffed. Karen said it was egregious to handcuff a reporter. I'm not sure why she would say this, reporters can break the law you know. They are not immune from being arrested after all. Until you hear Karen's claim this is racist, then it's understood why she called this egregious. It's because he is a reporter, we all know that reporters can't break the law. Ok, let's move on from this most ridiculous point.
The video and the reporter then suggest that the officer was doing something wrong to suggest that Karen may be arrested if she does not back away from the officer. If you look at Karen's video, she is within three feet of the officers gun and she is standing 180 degrees from Dion so if the officer faces Dion, Karen would be directly behind the officer out of sight of the officer. He is feeling threatened from both sides, so he called for backup.
Now this is an interesting moment that ABC15 edited out. It does not show the entire incident. You see, Dion was not done resisting the officer. The Incident Report says he was put in the back seat of the police car and asked to put his feet inside so the officer could close the door. Dion refused. Multiple times. Karen's video shows this resulted in the door remaining open preventing the officer completing his investigation until back up could assist in escorting Karen away from hovering over the officer's back. I don't know about this eight foot request and I don't care, a police officer is only human and it is common courtesy to not hover over someone doing their job without there permission and without knowing your intentions. For all he knew, you could have a knife that you intend to shove in his back the moment he turns away from you. But it seems in Karen's world, police are sub-human and don't deserve common courtesy.
Also at the car, the report indicates that the officer tried unsuccessfully to explain the situation to Dion. The report stated “Attempting to have a conversation with Dion to explain what was happening, but he continued to make it difficult by arguing with me and speaking over me.” Of course, ABC15's video shows nothing of this, edited away as if it never happened.
So what is my take-away.
I think the bank manager had the best interest in mind for protecting the confidence of her customers.
As a business owner, at a different bank, I appreciate this bank managers concerns. I have other business owners as friends and I know from personal experience that carrying in a bank envelope with thousands of dollars to deposit, I share their anxiety when having to pass a stranger who seems hell bent on getting in front of you before you enter the bank for an unknown reason.
I think Karen had her mind made up as soon as the officer pulled out his hand cuffs. “This must be racist!” and made up the facts afterwords, such as “he wasn't told to leave”, “he said he would leave”, “the officer had no right”... In other words, my mind is made up, don't confuse me with the facts. She goes on to state without proving any other interaction with the police that “this is a pattern of really poor, really racist and really aggressive policing.” ABC15 makes a point to include this statement in their report.
I think Dion is looking for a payday. Probably encouraged by and egged on by Karen's attention and video (also aided by ABC15) to pursue legal action as a victim of his own misbehavior.
The ABC15 reporter, David Biscobing, one word, credulous.
The worst actor in this whole saga is ABC15 who willfully edited the video to not show any of the antics of Dion resisting presenting his ID, resisting being arrested, resisting being cuffed, resisting being put in the police car, resisting putting his feet in the car to close the door, and resisting having a conversation that would lead to his release. To not disclose this information from the police Incident Report that they had, which disputes Karen's skewed perspective of reality, obviously putting their preconceived narrative of the story in front of the facts. This is another example of the media first choosing a narrative of a story, then lining up their edited talking points that only subscribe to their preconceived conclusions. Reprehensible!
I hope a true reporter will do a Freedom Of Information Request on the body cam footage to better understand the situation. I believe in the eventual supremacy of reason.

He was not on the bank's property. The bank cannot trespass someone from the sidewalk.

In other words, the parking lot in question IS part of the property of the bank, not a public or city property. It was private property and this question of public vs private property was never in question. It is and was private property. If he moved 50 feet to the left of where he was standing this would be a different question.
Unlike what you may think, the police are not stupid. They know the difference between public property and private property. They would not initiate a cause for trespass if the perpetrator was on public property.

Clearly that officer had her move back until she felt there was no clear visibility of the reporter and no chance of their conversation being picked up. The reporter would've legit been detained, arrested, and charged had this woman not had the conviction to record this travesty. It's very encouraging seeing strangers help each other. Simple things make the world a better place

I was taught the Constitution in elementary school. I remember how it somehow freed me. And I was only a kid. I feel that learning the Constitution helped me mature into the man that I am today. It teaches us responsibility. It's simple and to the point. Small talk if I may. And this seems to be written this way on purpose. What tyrant's do is complicate things so the common man cannot easily defend himself. And or make it difficult to defend from a tyrannical attack of any kind what so ever. Especially with local police. And because of this. Cops don't abide by their oath.

I haven't see a video where an officer knows the law. They don't even know the difference between public and private property. With Qualified Immunity they don't need to know the law. Officer are allowed to give "lawful orders". They are also allow to lie. But if you lie to an officer that's totally a different story! Perhaps she knows the law or perhaps she just said something the average person would not challenge in attempt to get her away from filming. Who knows? But no legal consequences will happen for that part. Hopefully the reporter will sue for the rights violation.

I watch tons of police body-worn camera footage right here on UA-cam every week, both flattering and not so flattering of police. Various police departments release it for transparency after controversial arrests. You also pay for military equipment, Medicaid, Secret Service, disease research, etc., none of which you get to access just because you want to.
All I can say is thank God for cell phones being able to record, I'm sure cops are starting to realize they can not continue arresting

Respectfully, can we please stop unreasonably thinking that she saved this reporters life. Cops absolutely have problems but a cop almost never hurts a citizen Who complies. And just because someone doesn’t comply 100% doesn’t mean they’re supposed to be hurt, but if you look at the situation then you’ll clearly see if you comply you’re rarely ever hurt. This reporter complied with what he was being instructed. So claiming that this reporter could have been a risk of losing his life is like the boy who cried wolf, and it just makes other allegations seem ridiculous when stuff like this is sad.

Well…frankly I think this journalist isn’t playing with a full deck. How you present yourself to the world (and then tell them what you do) will get you judged accordingly. With no credentials (I couldn’t catch that part if he said he had them) it’s hard to believe he is in fact a reporter. I’m a fitness trainer but I wouldn’t train my clients while I’m wearing a suit and tie.
Every other species has an instinct that tells them ‘if something doesn’t look/seem right, it probably isn’t’ and leave the situation. Only people end up feeling guilted or sucked into these situations, often to be manipulated and flat out lied to by the very people they were trying to advocate for.
Who is the female cop violating her rights and making up lies! She should be prosecuted and fired, for bullying the young lady! Hold them accountable! The bank should be sued as well for emotional distress! Thank god for this young lady! She gives me hope!

I'm glad you interviewed the witness who assisted the reporter by capturing this incident on video.
I think it was important that she persisted throughout the event because it was obvious the police officer had escalated the situation and the reporter was not resisting but trying to appease the officer.

I want to make something 100% clear. I seen that actual officer at a suns game last year yelling at a black man to keep walking or he was going to get arrested while he was walking among other people. The officer was on the eastside of the building and stepped out towards the man.
So the cop tried to tell someone, they will be arrested for using their first amendment lol. When you keep quite when they want you to answer their question, they call using your 4th amendment obstruction lol.
It's sad to think the police are supposed to protect us but instead are actually liars and bullies in so many cases.
