- James Preston Green was sentenced to six years behind bars, the maximum allowed, after he violated his probation on multiple occasions in December.
I had my last drink on Nov. 22, 1989 -- the day I began a 60-day sentence for my third DUI in 10 months. It was the worst day of my life -- but turned out to be one of the best as it started me down a road I wouldn't change for anything. I was 25 then. I'm 56 now and just celebrated 31 years of sobriety.

@@coltonc8894 Thank you. I guess it is amazing in some sense, but I was so done at that point. Jail has a way of putting a mirror up to your soul and giving you an ultimatum. For me, it came down to, "Do you want to live or do you want to die?" I honestly didn't know if I wanted to live right then -- but I was pretty sure I didn't want to die. I never thought I'd be grateful to be sent to jail but I was -- and still am. It saved my life.

It was midnite Oct 31, 1975 I was in an American Legion Bar. I turned my glass upside down and Doug the bartender asked, "another one, Joe?" No, I said and Doug that's my last drink, you'll never see me in here again. People around me heard what I said and they laughed. I left and never went back. That's the last alcoholic drink I ever had almost 46 years ago. Think of all the money I have saved instead of pissing it away.
It's a decision that has many positives other than just saving money ! I've never driven drunk but I came close .....I woke up in my driver's seat after passing out with the key in the ignition , I didn't remember getting in the car and it made me sick to think about what could have happened !
Back when a beer cost a shekel and a home cost $50k and there was no such thing as a DWI charge
I'll be looking at 33 years of sobriety on Jan. 1, 2020. It really was a wise decision for me.

@John Smith Damn straight. Wealthy parents who believe more toys will make up for not playing with a child. That a kid will be just as satisfied and feel emotionally cared for in the care of a nanny as it will in their own. Also one I see a lot is harsher punishments for minor infractions, justified because the child is privileged and they don't want it to be a spoilt brat. Also through spending little time with the child, they don't put the breaks on when it starts acting out to get their attention. By the time they get involved the child is already waaaaay down the wrong path. So they blame everyone else. They blame their friends and their parents as a bad influence, so ban them from seeing them. They blame the school for poor grades and so they move them. etc etc. They don't realise they are just isolating their already attention starved child from it's only support groups. There is no substitute for the time and love a parent should give.

I know kids who are spoilt rotten with toys but those kids would be much happier with a $10 fake plastic toolkit if they could play mechanic with their dad. And all the naughtiest kids where I work, you find they don't have dads or are in a care situation.

@@indy_go_blue6048 yes I know there are RDAP classes for opiate users, surely there are alcoholic classes inside too? they do all sorts, anger management courses, impulse control etc. I know if someone doesn't want to get clean and take the program seriously then it's pointless but lets hope this 6 years awakened something in him.
Sadly sometimes I've seen bigger sentences make an addict just lose all faith in themselves and so they stop caring about what reckless behaviour they do.

I’ve been sober for 16 years and I can honestly say that I’ll never drink again . I’m guilty of driving while I was drinking and I thank God that I didn’t hurt an innocent person or family while doing so . Praise God that I don’t even have the urge to want to drink anymore .

In Tennessee, everytime you are convicted of DUI/DWI your sentence gets worse and worse. Needs to be like that everywhere apparently.

FYI, the term 'off the wagon' means you have stopped drinking. 'On the wagon' means you ARE drinking. In the pioneer days the alcohol was kept 'on the wagon' as they traveled.

Kathy Demartino He'll sober up in prison. But sometimes they get out and STILL drive drunk. A person can be genetically alcoholic. His Daddy bailed him out since he's a jeweler and has PLENTY of money. I had an accident with a drunk driver and he had MULTIPLE DUI'S. and prior arrests. His Step-Dad was a landlord and had money. The drunk guy was adopted. He was 36. His Step-Dad sold an apartment building to pay his son's hospital bills and lawyer fees. The courts just want money. Probation officers just want money.
Each time you text and drive, drink and drive, drug and drive; be comfortable with this. When you wake up from your blackout you could be told you killed someone.

If he didn't learn after the second one he prolly never will. I watched a buddy of mine blow into an ignition interlock to start his car for years until he wised up. Now he doin good and has a kid on the way. Some learn, some never will.

Judge in Sauk County Wisconsin just gave a guy a 1.5 year sentence with 2 years ankle monitor when he was caught for his 11th OWI

In Delaware, you can be arrested nine times for DUI before getting jail time.

Should be zero-tolerance! Period! Get caught once, 18 months in jail, permanently lose your driving privileges for the state you were convicted in, $25,000 fine, and mandatory 6 months AA!

That's what happened to a woman I used to know. 1st, she got license revoked for 30 days and a fine, but kept driving. 2nd, she got her license revoked for a year and a bigger fine, kept driving. 3rd, she got her license revoked for 2 years, kept driving and killed a guy, did 13 months in prison (I don't recall what the sentence was, but she actually did only 13 months. Got out, is somehow driving again, and living in her huge expensive home in one of the elite communities. Earning big money as a medical specialist. The guy she killed had 3 minor kids, and his wife and kids never got a dime. Here is what gets me- if she had robbed a store with a gun, even if she did not hurt anyone at all, it would have been automatic 5 years for use of a gun in commission of a felony, PLUS time for the robbery. Lesson is if you want to kill someone, just get drunk and do it with your car.

Since this seems to be the forum for everyone to announce how long they've been sober, I'd like to say that I've been drinking responsibly for 40 years now, with no DWIs or alcohol related incidents. Some of us understand the concept of moderation and self-control.
That judge probably almost certainly saved some potential victims of that guy’s future drunken driving.
6 years is not enough for this piece of trash. With his history, he needs to spend the next 30 years behind bars.

Arkansas is a different world, old Huck's son was caught boarding an airplane with a loaded firearm, arrested, took to court and dismissed all in 18 hours.
Thanks to Bexar County for placing the general public in jeopardy time and time again before someone with balls found that the law provides penalties for such behavior.
The first four judges that never sentenced him to jail should be removed from the bence immediately.
I grew up in an extended family that had more than its share of alcoholics. I saw what it was capable of doing to people and that cured me on the spot.

Me too on my Dad's side of the family of which were a lot of aunts and uncles. We children grew up to not be alcoholics. We broke the chain. We do wish that were able to help them, but back in those days there were no ways to help.
20 years sober for me. But, unfortunately for me, by that time it was already too late to salvage much of my life. I had already lost everything and everyone that was important to me. I just feel fortunate that I never killed any one on the highway.

Jeeze, times sure have changed. My uncle had like 8 DWIs and he only lost his truck, home, and license.
This seems to happen with young repeat offenders. They get off easy several times, often for the same crime. Then they see the wrong judge at the wrong time and reality hits them like a sledgehammer.

It's the only place. The first DUI, probably better to have treatment outside prison. The second time, maybe. The third time, no. This fourth time, not only no, but Hell, no. Treatment outside prison was a total failure; he may not get clean inside prison, either, but it's no worse than outside treatment has proven to be.
It doesn't matter if jail is the appropriate place to get treatment, as his attorney suggested. Prison is appropriate to protect the public from people who repeatedly engage in behavior that puts others at risk.
My cousin at 19 was hit by a drunk driver and has been in a wheel chair for the past 22 years. Even if I've had 1 drink, I won't drive. I'm glad this man never injured anyone when he was behind the wheel. I hope he turns his life around. Apparently daddy's money and influence kept him from consequences for far too long.

I was lucky to be a drunk in NYC. I never owned a car, or got behind the wheel. I am sober many years and whenever I watch these DUI stories where innocent people have died from a DUI driver plowing through a light, or an intersection and then killing someone, I am saddened, then enraged.
While driving Uber I picked up a passenger at 9:00 a.m. on a Sunday morning he was already drunk. It was fifteen-minute trip to a local's bar that he knew would sell him a case of beer on a dry day, like most drunks he told me his life story in fifteen minutes. Turns out he had four DUI's along with four kids from four different women and he had spent four years in prison all by age twenty-five. I told him he had a drinking problem and then advised him to bet the number four horse in the fourth race at Churchill downs today. He didn't leave a tip.
Imagine a world where everyone, no matter their race or economic background, received the same sentence.
Not every case is the same and every person isn’t the same.

It does. However, you fail to realize that not every case has the same circumstances. Factors such as malice, premeditation and the like are considered in sentencing. You can’t make everything even across the board.
It'll never happen. A high priced lawyer can make all the difference. Just like money can hire an accountant to do your taxes. They know the ins and outs of the tax system. The list of things your economic background affords you is endless. Some earn it and worked their way up but others are born into it. Like this child.

I use to drive a taxi. I had one passenger tell me he's on his 10th DUI and an older lady told me she's from Texas but back here in Iowa to fight her 18th DUI. How is that even possible.

Way back I dated a girl who's dad was a judge. Her brother was often arrested for DUI. Every judge accepted bribes for his probation.
When it comes to dui at least, the majority of judges can be bought. Sadly, the people who could really use the break can't afford the cost of the bribe.
Our justice system isn't broken, but close.

In finland if you're driving under influence, its an automatic one year jail sentence fr first time offenses. They seem to have solved the problem.
I'm 67 years old and havent had a drink since i was 35. Only reason I've made it to 67. I'm grateful and lucky.
My FATHER is 86 YEARS OLD and still alive , and been drinking all his Adult life. So i guess to each is own

He was paroled early and now has gotten an additional DUI......this time they really punished him, they sent to a corner for a time out AND no milk with his cookies!
6 yrs was too light for felonious assault with a motor vehicle and that's what every DUI involved in an accident should be charged with after the first one

The courts themselves are guilty for being lenient with DWI offenders. The first offense should be loss off driver's license for five years and car impounded for a year. DWI should be a federal offense and not handled be lenient courts where the "good old boy" treatments do not fit the crime. The thought that he had been arrested FOUR times is a travesty!
Parens really don't understand that by spoiling kids and having no discipline for them will hurt them and others more in the long run. This guy is lucky to be alive, never getting in a fatal accident, and avoiding spending the rest of his life in jail. Please don't do this to your kids.

His attorney questions if jail is the answer. YES YES YES while he's inside innocent people's lives are safe to go about their daily routine safely. It's about time attorneys realised they are also responsible for the citizens in their community. How many years have they been trying to crackdown on offenders. They make their choice but anyone injured or killed dont have that luxury.
It's they job to defend they client. Period. No matter what kind of person they are. Everyone in this country is entitled to a defense attorney.

Permanent loss of drivers license, 1 year in county jail, 500 hours community service, court ordered rehad, 3 years supervised probation with alcohol testing weekl that includes 5 year suspended sentence upon positive test for alcohol or getting behind the wheel with or without alcohol.
Being a victim of a drunk driver, they almost NEVER get what they deserve. My particular offender did get some prison time the first time, but it was because he damn near killed me. I constantly hear about 7-8 time offenders getting cut lose again. Many were in Cali and when they walked out before sentencing, ran to Mexico to stay out of jail.

Took four DWI's to get this guy behind bars , FOUR ! His attorney said , he didn't think his client would get treatment in jail .
Well , two other things he won't get there make it the right place for him , he won't get booze and he won't get the opportunity to drive drunk .
Was in court for minor infraction & a DUI prisoner was before the judge. The judge said " your license is suspended FOREVER " & you start DUI court TONIGHT, it will be one of the hardest things you've ever had to do in your life, for 6 months every single day you will have an appointment, whether it be class, meeting here with me, community service, alcohol test, probation office, you sir. Are booked " not to mention thousands in fines. - hearing that was enough for me lol. I will never get behind the wheel after a drink.
I expected physical book throwing in court.
Highly disappointed.

Driving drunk on a first offence should be an automatic jail sentence of a year. Far to many innocent lives are taken from these people.
