    I believe that in California a hospital drawn, blood sample is not admissible in court for DUI mainly due to alcohol wipes, used for prep before blood draw taken that can skew the result outcome when testing for alcohol. The arresting agency has to provide a blood draw kit to the medical personnel, and has to be drawn a specific way with specific tubes and typically uses iodine to sanitize the area before the blood draw.

    I have a traumatic brain injury from a freak accident at work and sadly all these symptoms happen to me at random times. I start walking like a robot short-ciruiting. I never drive while brain fatigued because it is like driving out of your mind. I take it serious and will never put people in danger because I try to keep up with the rest of the world. Also that reaction to the curtain air bad is also how people like me react. Not sure why, I have done so much work to be able to stop and think before freaking out like him.
    Also the minute i am approached by anyone while having a rough time i announce that i have a traumatic brain injury and i dont do drugs or drunk to avoid people being scared that i might be high out of my mind.

    I think with the severity of the accident, Police should have taken Charlie to the hospital to be checked out there. As you said, some things can only be diagnosed properly with XRays, MRI, ultrasound, etc. What if he had internal bleeding in his head? That could have potentially killed him. And while he's sitting there, the hospital is going to collect blood for all sorts of tests. It's not that hard to for the phlebotomist to draw one more sample for the police to send to their labs. And even if they don't, the hospital is going to run a complete tox screen so they don't accidentally prescribe something that could adversely affect Charlie. And HIPAA does allow the Police and DA to subpoena Charlie's medical records. And those medical records would be closer to the time of the accident than any labs the state would have run.

      Yes!!! That man could have had spinal cord or head injuries (bleeding in his head could kill him). Besides, the cop's reaction was clearly because of the, "F*** you," and half kick. It had NOTHING to do with displacing three families. Besides, you had no clue at the time, of what happened. What if a person ran into the road and he swerved to avoid him? What if he had a stroke? Yes, it was most likely DWI, but at the time they did not know why, and did NOT know about his injuries. The EMS can't know that at the scene either and should be fired for supposedly clearing him.

      It was popular in my high school, and that was about 10 years ago. I can't tell you how many times I would be walking up the stairs and happen to look up and see some guys' boxers in my face. When I asked them to pull up their pants, they told me not to look.

    When responding to a serious accident the first priority should always be safety. Not the cops safety, the driver and any passangers or people hurt in the accident. This cop had it right to keep him in the car until ems and or fire responded but at some point they decided to pull him out.
    Here's what I learned about going hands on- it's always dangerous to me and the client. Both or one of us is likely to get hurt. So it's always a last resort.

    Regarding the hospital vs the station I think the situation was, they think he was impaired so they wanted to do a DUI test, the EMTs had checked him over so he was good to go to the station, the bit about take him to the hospital if the DUI tests are refused would be to do a blood draw. At that point they would probably wake up a judge to get a warrant.

    He could’ve had seizure. My best friend as a boy had epilepsy. He’d come out of a seizure not knowing the date, year, president etc with extremely slurred speech.

    In those circumstances in Germany a DWI would be mandatory - by having the EMT's draw blood for analysis. No but or ifs.

    Well if there's pain and someone is drunk, that's indicative of far too excessive of a force because generally drunk people don't feel so much pain.

    Soft velcro restraints is much wiser than handcuffs.
    Unless you can hit the right angle and depending on the trapping system you would not be able to, you're just not going to get out of velcro restraints.
    In addition rather than bruises and cuts abrasions from any rubbing of a cloth style velcro restraint

    No, putting him in handcuffs behind his back when he could have spinal cord injuries and head injuries (likely does) definitely does NOT keep him safe. They were no longer worried about that because he said F*** you with a half kick??? They can NOT clear him medically from an ambulance. An ambulance has NO CLUE if he has a spinal cord injury or internal bleeding. Those EMS personnel should be fired. They SHOULD have said he needed to go to a hospital.

    Like you said about Midway of the video here that in Illinois blood that is drawn after an accident call juicy what might be wrong with a patient who is in a hospital, again if that blood is drawn anywhere past the 2-hour mark, the evidence is not usable.
    It may be admissible but I doubt a judge would allow for the time length to then have it be admissible.
    Put a severe accident and a patient in, you can probably get the blood drawn within an hour.

    First Devils Advocates here Accident Speed estimate of 60mph impact residential area 25 to 35 mph zone. He is still 25mph over speed limit reckless driving. Isn't that a felony speeding citation.

    I think the one thing I was expecting a reaction about and didn't hear. Was from the title we were all expecting nepotism, and there didn't appear to be any indication that they were gojng to let him off easy because they know his dad.

    I agree with the Queen, the kid didn't understand anything around him when he kicked at the cop. Seems most cops are just looking for an excuse to become violent, the kid gave them the excuse and they happily went hands on. They honestly have zero concern if they hurt someone by becoming violent when they perceive the person's actions allow them to.

    If he’s injured in ways they are unaware of, putting him in handcuffs is probably not a great idea. Just like moving someone who may have a neck or head injury is a bad idea unless it’s a matter of life or death.

    Hospital should have been the first stop. They were discussing how bad the crash was, saw the state he was in, and still were like lets skip the hospital. Obviously it would seem medically he was okay, but if he had any health issues as a result of this it could have been very bad for the departments image and maybe its pocketbook.

    When the police pulled Charlie out of the car and handcuffed him, I assumed that they did that for safety reasons because the vehicle was smoking, and Charlie was showing signs of being disoriented and was a danger to himself. It was odd that they did not say why they were putting cuffs on him. In every body cam video I have seen, they normally do. I was manly disappointed that they did not take him to the hospital first. In a collision like this, that seems like the thing they would do.

    From what I watched it looked like the officer’s initial hesitation to move the suspect was based on the scene, condition of the car and the airbags deployed. Not wanting to risk further life altering medical issues was weighed against the risks of the vehicle going up in exploding/flames. What I’m wondering is why, when the suspect kicked the officer, all of that rationale and logical evaluation went out the window? What invalidated the officers initial evaluation of the suspect and the scene conditions? The suspect clearly couldn’t make sound decisions whether it’s a medical condition or intoxication. I imagine you could still charge them with assault but possibly risking additionally life altering injuries for a kick, knowing this person has an altered mental status doesn’t seem reasonable at the point where they cuffed him. I feel that the scene was safe from fire/explosion at that time, based on the bystanders. Had there been that risk, removing him immediately, outweighed the decrease in quality/loss of life. Not to mention, residents in the vicinity were still in homes. Had there been a risk of fire/explosion evacuation should/would been in progress. EMS first rule is to never enter an unsafe scene. I imagine it’s the same with fire with officers unless absolutely necessary and obtainable. I wonder how often chain of custody issues arise from using a medical BAT? (I ❤/enjoy the channel! 😊)

    I think when you analyze these clips, you have to look at it from the eyes of a juror. What's wrong with him? Well, they found drugs in the car. Ok, that explains that, all the arguments you do for him prior to them finding the drugs don't matter to the jury, if they get to hear the drug possession charges.

    Video was not complete but I missed seeing them secure the scene, applying measures against the car catching fire. Also, you never drag someone out of a vehicle that has been in an accident before having accessed the person's potential injuries. Dragging him out could potentially have paralyzed him if he had neck injuries or even be life threatening. The whole thing seems at best untrained and unprofessional.

    def overreacted to the kick, at that point he was constrained by the seatbelt, no reason to go hands on, rip him out of the car, throw him to the ground, just to put him in cuffs. Very dangerous move considering he was in a serious car crash

    I understand about the blood drive is going to have to happen unless you want to lose your license but I think if anybody who agrees to do an FST these days is should just alone be evidence that they're probably intoxicated.

    No at the hospital also that adds time from the scene of the accident, plus they don't know may not know exactly when the accident occurred save for the people that live in the house that can tell them what time it happened.
    Traffic cameras many of them don't have running video so that's kind of a problem.
    You only need 2 hours for the time of an accident to when you can measure appropriately how drunk someone was at the time of the accident, once you hit the 2-hour Mark that evidence is not going to be admissible. Nor at least usable.

    I think you can look at the fact that as far as context goes this could speak to Charlie's demeanor whether drunk or not, not saying anything that can help or hurt him, just be generically upset 10 points are the fact that because he is the son of a police officer, we all know that every police officer or probably every lawyer as well sits their son or daughter down at the age of 10 or 11 and explains very very much to never never talk to the police.
    That can point to family parental training or the higher level of cognizance that the person has to remember to not talk to the police or at least not say anything anywhere pertinent.

      The offspring of a police officer would also be told by their police officer mom or dad _never_ to assault a police officer.
      Charlie was too out of it to remember any piece of advice. Not talking to the cops had nothing to do with parental training.
      I also suspect parental training included keeping away from heroin and cocaine. Charlie doesn't seem to be a good learner.

    As far as holds go, squeezing hard just below the elbow between wrist and elbow, can cause permanent nerve damage especially to the little and ring finger.
    This is not a recommended hold.

    So what would happen if the police called the ambulance, then the person says they have no medical insurance or means of paying?
    Could the police force someone to get medical treatment?
    I'm from the UK, trying to understand why he wasn't properly medically cleared. He snapped a pole and moved a house in the crash. Definitely chance of unseen injuries

      If a person is alert and oriented and mentally able to consent or refuse (which this guy was not) they can elect to refuse care, if they do get taken in I do believe they get billed, however I'm not 100% sure about this so someone correct me if I'm wrong, but I would think if someone is under arrest and they are taken to get medical care that would be paid for by whoever's custody their in, city, county, or state meaning taxpayers would be pay it, right? Also how much they ultimately pay also depends on if they have insurance or not and what kind

      Although him being "medically cleared" and not taken to the hospital just seems like lazy work to me, if I was an EMT or paramedic and someone was in an accident that bad I would for sure take them to the hospital because there is so much you can't see, I'm in an Emergency Medical Responder class now and we're always told to assume the worst until proven otherwise basically

      @@nicolemarcak9021 thank you, in the UK we don't pay for hospital visits. I've heard EMTs will leave you where you are if you don't have insurance. That's probably been exaggerated though

      @@mossy8885 that's definitely not true, no EMT will leave you with no insurance and no hospital will treat you with no insurance, they have an obligation to treat its just unfortunately if you don't have insurance you get a big bill and have medical debt

    I think their previou run ins with Charlie definitely clouded the process in which the officers went with their investigation. To me, without knowing Charlie, I would try to rule out diabetes. Especially if they don't smell alcohol, a diabetic with a sugar crash could seem very similar to what Charlie was experiencing. If the officers had signaled their worries about that and then found the heroine, I would give them a A until they did something to give a poorer grade.

    Stop defending his actions , he was high as F and to the officers who may have already known his drug issues and knew from seeing how he was reacting to k ow that he was under the influence of his drug of .... He was not at all acting like someone with a brain injury and he had his seat belt on as well as hit airbag being deployed

    I felt d was a bit harsh of a grade, c+ or B- was more fair, of a grade.
    This persons propensity to comit a crime doesnt justify probable cause however it does justify extra precautions against charlie "this person is likely to drugged up and has a history of being violent when high" after he kicked at the officer with that being more of the same handcuffing him and putting him in the back of the squad car is justified, granted cops are always too violent in how they go about that.
    No reasonable attempt at securing the cooperation of the suspect was made and any physical escalation always puts all parties involved in danger.
    The police should try harder to avoid any use of force.

    I wish lawyers also would train our law-enforcement officers on how to handle every investigation and I wish qualified immunity was not a thing I feel like it gives police officers the right to do anything they want without no repercussions

    Officers do not have a right to search the vehicle just by virtue of it needing to be towed. They can do an inventory of course, and yes if they find items in an inventory they're really supposed to just described it visually, not open it up and test it for any type of substance.
    Switch the person under arrest, that of course I can do a search on the vehicle. Whether it's on the scene or in the impound lot.

      She mentioned that the officers would've done an inventory inspection for the vehicle to be towed. But, the way these officers handled themselves in what we are shown, I wouldn't be surprised if that never crossed their minds as they went rummaging through the pick-up.
