The explanation about beam splitter splitting light to the left and right is incorrect. It spilts light to the right and down. The down light is lost. When reflected from mirror light goes back, it splits on the splitter again, and goes to the left and up. The up light is lost. The system is designed in such way that the image of the objective reticle is imaged exactly to the eye-piece reticle. So when you look through eye-piece, you see two reticles: the eye-piece reticle itself and the imaged objective reticle. If they shifted with respect to each other, then the mirror is not reflecting exactly back, but at angle theta.
