As a Licensed Cosmetologist, she should have had her to sign an " Assumption of Risk" Contract. The Plaintiff had pre- existing damaged hair & didn't go back for follow up treatments. The defendant could have Won the case if, she could have Professionally expressed what happened 🤔

As a fellow licensed cosmetologist I totally agree and, I tip my hats to the stylists who deal with color. It's too tedious of a process for me personally I specialize is hair cuts.

As a licensed stylist, if you KNEW it’ll be damaging to your clients hair, WHY proceed?! Even if the client insist, you say “no” for the betterment of your client & your license. The salon owner is actually correct, but she didn't explain it right, to the client or the judge. A colorist can only speculate on how long or how many sessions it will take to lighten the hair, it's science and everyone's hair type is different and responds different, and there's no guarantee of anything, the only guarantee your hair will be damaged when bleaching the hair, but there are products like "Olaplex" that can help to protect & restore and while re-bonding the hair. Next time someone wants to go that extreme, have them sign a document that protects the colorist from being sued, then maybe the client will rethink going that blonde. Regardless if it's even the best case scenario, the hair will never feel the same.

Very valid point regarding signing a contract to protect the colorist. In addition, it may be a great method to utilize for clients/ customers to rethink or respect the process and possible outcomes.
@@endiarapier5663 in professional settings if u stick to the state boards rules she would have avoided this. All products of these kind require a patch test. A patch test is then recorded n should be saved on file and updated once every two years or more. The state has procedures in place but u get lazy n then this happens.

Bottom line bleach is damaging to anyone’s hair whoever said otherwise is lying to you . I lost my hair plenty of times because I wanted to bleach it , I knew the risks prior to getting it done and still did it . Hair grows back , I don’t even dye my hair anymore . It’s life

Sorry, he got this one wrong. The lack of confidence that the defendant displayed, lost her the case. She was trying to explain why this happened. Ultimately the plaintiff had damaged, compromised hair to begin with and the procedure melted her cuticle. The hair stylist will only know what the client has done to the hair previously if the client informs them. A client can arrive with healthy shiny looking hair, that is coated with silicones or flat ironed and that will mask the damage. The plaintiff ultimately assumes the risk and it’s her and more accountability should have been placed on her for non healthy hair habits. Box dye deposits so deep and is near impossible to lift. It was clear she was there with box dye on.

I believe the defendant’s lack of professionalism was the beginning of the end. She does not take her job seriously. She had difficulty explaining the process and risks to the judge. Therefore, I must assume she did not adequately explain it to the client/plaintiff. She failed to have the plaintiff sign a waiver stating her understanding of risks and assuming responsibility. She left in the process of a risky service instead of rescheduling. This caused the plaintiff to lose faith in her and book with the second stylist to finish lifting her color to platinum blonde. The second stylist was not there for the initial consultation. Therefore, she might not have all the pertinent information about the clients hair. Honestly, I think the original stylist should have refused service due to the risks or had her sign a waiver. She did neither. Therefore, we are here and she is liable.

I agree that it was unprofessional to leave while servicing someone but I also agree that if they did something wrong her hair is going to fall out immediately. It wouldn’t take 4-6 weeks for someone to reach out with drastic hair loss likes that. She probably was putting too much heat in her hair or caring for it poorly. Bleached hair is High maintenance and you have to care for it a lot better than you normally would your hair.
No not with this process it can seem fine for some time and then boom it starts getting dry and brittle and next thing u know u wake up with it on it pillow.

" . but even then, its on second stylist to not ask these questions.
@@teaja211 before starting someone hairs the proper thing to do is consultation. Most time people who don't take care of hair for living won't even know what procedures and solutions do what. It is up the stylist to observe note and ask questions. Any professional stylist will most likely be able to look at hair and know exactly what questions to ask. If the salon were to do the consultation there is a record card u should keep. Date of any service they consist of bleach, dye, any chemical service should be well documented.
When JM doesn't understand the case he tends to catch an attitude with the people. The hairdresser needed to be more confident in her case because she acted as if she didn't care.
She definitely has a comprehension problem, she could not explain the process, she laughed some stuff off, she was completely out of her element with this one..If I knew it could potentially cause damage, I wouldn't touch it at all, rather give the client suggestions too from home, or recommend someone whose dealt with box dye..

OK, stylist (retired) here. My specialties were cut and color, including dimensional and corrective color. When YOU are the pro, YOU are in charge. You do NOT have to perform any service just because the client wants it. Sometimes you have to say NO. No client or any amount of fast money is worth your rep. I don't know why some clients aren't honest about what they've done to their hair, but the first thing I'm going to do is wash that mess and get my hands ALL up in it, and believe me, I will know what sort of shape that hair is in. (Can I just add a personal gripe here? I hate it when people say "the hair fell out." No, it broke off because the cuticle was so blown it just gave up the ghost). Anyway...I don't care, if a client wants something and I know that ultimately it's going to be a hot mess, I'm NOT doing it. They can fuss, make a scene, whatever. I'm not compromising my rep for you, Miss Entitled. Go on down the road...or better yet, here's an idea...let your girlfriend do it!! XD Then you can come and pay me for corrective color to save what little hair you have left. Bottom line, you are the pro so the buck stops with you. And I don't care about waivers or whatever. Word of mouth and what people see on the heads I've worked on are my bread and butter, so if I have a waiver but still have some big mouth talking about how I ruined her hair, blah blah blah I still lose. So If you cannot go from black to platinum in 1 session and the stylist admits she still attempted to do it she is definitely negligent. And should pay for ever strand of hair that fell of that woman's hair, that she clearly over processed.

Yes she should not have left her client but there are plenty of women that do not care about the consequences of getting their hair colored because they want the color so bad. I was thinking the same exact thing. I have watched other court shows and when there is a case involving a professional trade, they call in another profession of the trade to give their professional opinion.
The defendant just had to state why, what was done, would not have been the cause and/or why they aren’t liable. You don’t need an expert because he was giving her an opportunity to do it as the licensed professional. She couldn’t.

30 year stylist here. It’s up to the professional to advise the client as to what services are feasible. No way I would have tried to lift her in one session or proceed if I knew she previously used a box color at home. There is a huge risk when lightning. I would have done a strand test and informed her that conditioning treatments are a must. Some peoples hair cannot withstand this process. I would have recommended streaks at the least. 🤷🏽♀️
It’s the professionals responsibility to protect her license. The Stylist should have never agreed to this service with all the facts she knew about the clients hair. I’ve witnessed my stylist reject services that would not benefit the client.
Bibbidy-bobbidy-boo! They were BOTH inarticulate, and I would have thrown both of them out of my courtroom. It was absolutely excruciating trying to follow what they were saying. To state that they were tap-dancing on my last nerve, is an understatement.
I’m sorry this was a very petty litigation. The plaintiff knew exactly what she was getting into and when her hair started to fall out, instead of her going back to the person that did it, she went through another stylist that could have further damaged her hair even more. The defendant should have declined her services, however, the plaintiff was well aware and accepted the risk. Also, I wouldn’t be surprised if the plaintiff used box color hair, she probably didn’t use the right hair products at home for her color treated hair, which made it 10x worse. The defendant needs to tighten up on her professionalism to avoid issues like this in the future. And the plaintiff contradicted herself. She started out taking about how her and her mom would grow their hair and cut it off to donate. But cutting your hair in this instance caused emotional distress????????
They would grow it out in short time then donated it when she was younger , but then they stopped doing it and she grew her hair out for years and became very attached to it

This was so hard to watch as a stylist myself, the stylist was absolutely correct in this case and should not have had to pay . Especially since it was not even her who did her hair last , the breakage didn’t start until after the plaintiff had chosen to rebook with a different stylist , and then and only then is the time she complained of how her hair turned out . And as for how Judge Mathis treated the cosmetologist in the case was completely degrading, her made her seem like an complete air head when in fact he was the one being ignorant in having no knowledge of what she was actually saying. Everything she did say is absolutely true and if any stylist looked at this case , or even anyone who has common knowledge of how bleaching your hair works should understand that this is a possibility, bleach is damaging especially when you have box color . And if your client still wants to proceed after being told the possible outcome , then as an adult I trust that you are able to make you own decision on whether your color goal is worth the potential damage it may cause . It makes me sad to see this stylist portrayed like this , especially when she graciously gave her 175$ gift card . She did not deserve to pay this plaintiff a dime . Do better .

Most salons make you sign a waver that says they are not responsible for any breakage or hair loss to avoid a lawsuit. The plaintiff should have done her research before getting this done especially when she has hair this long and beautiful!
They were both pretty dumb, especially the defendant... How do you know nothing about being a stylist or your business? But i do feel like the plantiff knew a lot more than she said. It sounded like the defendant told her: " this could be bad for your hair. are you sure you understand the risk or what could happen?" Plantiff said "Let's do it." Judge Mathis is quicker to temper and will interrupt as much as he wants, which i understand he is the Judge, but doesn't let them finish explaining anything.

She overprocessed her hair with the dye. She wasn't saying anything at all about the dye did it. JM had yi drag the answer out of her. I'm surprised he didn't tell her after a couple of times her case was dismissed for lack of evidence or for inability to get her point across.
She didn't say anything about it because the plaintiff had zero complains about her hair falling out after SHE styled it. When she went a second time to a totally different stylist to get her hair bleached again, that's when it fell out. In fact, it started falling out in the second stylists bowl. She just didn't know how to argue her case.
The fact that she left during an appointment was unacceptable. If I’m paying you to bleach my hair which you know comes with risk of hair loss, the hair professional in you should finish the appointment through and educated me through the process. She was right to sue.
The consequences of wanting to go super/platinum blonde. There is always a risk when you beach your hair, especially if you have raven dark hair, because it takes time and multiple attempts for the chemicals to kill the melanin molecules, thus thinning and drying your hair out causing breakage.
I feel kind of bad for the hair stylist it seems like she knew what she was doing but wasn’t prepared for dilemmas like these. You must have a contract in place or some disclaimer clients can agree to if anything goes wrong after consultation…..additionally, she reminds me of me without coffee- all over the place lol. Expert testimony was needed for this case. A lay person can't understand the terminology or what the expectations of dying the hair. The fact that this was a very involved technique and she handed her off to another stylist is mind-boggling. Also she said she knew the client's hair would probably fall out. You can not put bleach over box dye. If u do it doesn't lift as it would and it's damaging to the extreme. After explaining she should've had her sign off that she doesn't care and will attempt to do small sessions with deep conditioning treatments. She was talking as if she was a friend who did her a favor. So the reason she lost is simply cause she's unprofessional
Judge Mathis doesn’t understand the subject all but when the girl explains things he super dismissive about it right away. And if a customer wants something crazy and you explain the cons beyond it, you still have to make money and proceed.
No, I disagree with that last part. It is not uncommon for stylists to refuse to do a service that isn’t recommended, even if the client insists because think about it….THEIR name and THEIR reputation is attached to what that client walks out the salon with. The client won’t be walking around with a sign that says: “My hair is jacked-up because I did A-B-C beforehand, ”. People are just going to wonder *who* did their hair, and then vow to stay away from that stylist.

The defendant was completely negligent in this case. Very unprofessional and acted as though she didn't even care about the plantiff dilemma of hair loss. I've never seen a case of such disregard with respect to a hair disagreement. She shouldn't be doing anyone's hair.

I disagree with this judgement. The plaintiff had a responsibility to herself as well to be knowledgeable about the process & make a wise choice. If a stylist tells me there's a possibility that my hair will fall out from a service, bump that...I ain't going. I also feel like the defendant could've defended herself a little better.

The judge got this wrong... if you don't know what's going on you should bring in a specialist ( like he's done in the past) I'm not a hairstylist and I know how damaging bleaching can be on the hair...saying " you knew it could cause damage and you still did it?" As a Licensed Cosmetologist, she should have had her to sign an " Assumption of Risk" Contract. The Plaintiff had pre- existing damaged hair & didn't go back for follow up treatments. The defendant could have Won the case if, she could have Professionally expressed what happened 🤔

The salon owner is actually correct, but she didn't explain it right, to the client or the judge. A colorist can only speculate on how long or how many sessions it will take to lighten the hair, it's science and everyone's hair type is different and responds different, and there's no guarantee of anything, the only guarantee your hair will be damaged when bleaching the hair, but there are products like "Olaplex" that can help to protect & restore and while re-bonding the hair. Next time someone wants to go that extreme, have them sign a document that protects the colorist from being sued, then maybe the client will rethink going that blonde. Regardless if it's even the best case scenario, the hair will never feel the same.

Very valid point regarding signing a contract to protect the colorist. In addition, it may be a great method to utilize for clients/ customers to rethink or respect the process and possible outcomes.

A patch test is then recorded n should be saved on file and updated once every two years or more. The state has procedures in place but u get lazy n then this happens.

Sorry, he got this one wrong. The lack of confidence that the defendant displayed, lost her the case. She was trying to explain why this happened. Ultimately the plaintiff had damaged, compromised hair to begin with and the procedure melted her cuticle. The hair stylist will only know what the client has done to the hair previously if the client informs them. A client can arrive with healthy shiny looking hair, that is coated with silicones or flat ironed and that will mask the damage. The plaintiff ultimately assumes the risk and it’s her and more accountability should have been placed on her for non healthy hair habits. Box dye deposits so deep and is near impossible to lift. It was clear she was there with box dye on.

I believe the defendant’s lack of professionalism was the beginning of the end. She does not take her job seriously. She had difficulty explaining the process and risks to the judge. Therefore, I must assume she did not adequately explain it to the client/plaintiff. She failed to have the plaintiff sign a waiver stating her understanding of risks and assuming responsibility. She left in the process of a risky service instead of rescheduling. This caused the plaintiff to lose faith in her and book with the second stylist to finish lifting her color to platinum blonde. The second stylist was not there for the initial consultation. Therefore, she might not have all the pertinent information about the clients hair. Honestly, I think the original stylist should have refused service due to the risks or had her sign a waiver. She did neither. Therefore, we are here and she is liable.

I agree that it was unprofessional to leave while servicing someone but I also agree that if they did something wrong her hair is going to fall out immediately. It wouldn’t take 4-6 weeks for someone to reach out with drastic hair loss likes that. She probably was putting too much heat in her hair or caring for it poorly. Bleached hair is High maintenance and you have to care for it a lot better than you normally would your hair.

" . but even then, its on second stylist to not ask these questions.
@@teaja211 before starting someone hairs the proper thing to do is consultation. Most time people who don't take care of hair for living won't even know what procedures and solutions do what. It is up the stylist to observe note and ask questions. Any professional stylist will most likely be able to look at hair and know exactly what questions to ask.
If the salon were to do the consultation there is a record card u should keep. Date of any service they consist of bleach, dye, any chemical service should be well documented.

OK, stylist (retired) here. My specialties were cut and color, including dimensional and corrective color.
When YOU are the pro, YOU are in charge. You do NOT have to perform any service just because the client wants it. Sometimes you have to say NO. No client or any amount of fast money is worth your rep. I don't know why some clients aren't honest about what they've done to their hair, but the first thing I'm going to do is wash that mess and get my hands ALL up in it, and believe me, I will know what sort of shape that hair is in. (Can I just add a personal gripe here? I hate it when people say "the hair fell out." No, it broke off because the cuticle was so blown it just gave up the ghost).
Anyway...I don't care, if a client wants something and I know that ultimately it's going to be a hot mess, I'm NOT doing it. They can fuss, make a scene, whatever. I'm not compromising my rep for you, Miss Entitled. Go on down the road...or better yet, here's an idea...let your girlfriend do it!! XD Then you can come and pay me for corrective color to save what little hair you have left.

30 year stylist here. It’s up to the professional to advise the client as to what services are feasible. No way I would have tried to lift her in one session or proceed if I knew she previously used a box color at home. There is a huge risk when lightning. I would have done a strand test and informed her that conditioning treatments are a must. Some peoples hair cannot withstand this process. I would have recommended streaks at the least. 🤷🏽♀️
It’s the professionals responsibility to protect her license. The Stylist should have never agreed to this service with all the facts she knew about the clients hair. I’ve witnessed my stylist reject services that would not benefit the client.

I’m sorry this was a very petty litigation. The plaintiff knew exactly what she was getting into and when her hair started to fall out, instead of her going back to the person that did it, she went through another stylist that could have further damaged her hair even more. The defendant should have declined her services, however, the plaintiff was well aware and accepted the risk. Also, I wouldn’t be surprised if the plaintiff used box color hair, she probably didn’t use the right hair products at home for her color treated hair, which made it 10x worse. The defendant needs to tighten up on her professionalism to avoid issues like this in the future.
And the plaintiff contradicted herself. She started out taking about how her and her mom would grow their hair and cut it off to donate. But cutting your hair in this instance caused emotional distress????????
They would grow it out in short time then donated it when she was younger , but then they stopped doing it and she grew her hair out for years and became very attached to it

This was so hard to watch as a stylist myself, the stylist was absolutely correct in this case and should not have had to pay . Especially since it was not even her who did her hair last , the breakage didn’t start until after the plaintiff had chosen to rebook with a different stylist , and then and only then is the time she complained of how her hair turned out . And as for how Judge Mathis treated the cosmetologist in the case was completely degrading, her made her seem like an complete air head when in fact he was the one being ignorant in having no knowledge of what she was actually saying. Everything she did say is absolutely true and if any stylist looked at this case , or even anyone who has common knowledge of how bleaching your hair works should understand that this is a possibility, bleach is damaging especially when you have box color . And if your client still wants to proceed after being told the possible outcome , then as an adult I trust that you are able to make you own decision on whether your color goal is worth the potential damage it may cause . It makes me sad to see this stylist portrayed like this , especially when she graciously gave her 175$ gift card . She did not deserve to pay this plaintiff a dime . Do better .

Most salons make you sign a waver that says they are not responsible for any breakage or hair loss to avoid a lawsuit. The plaintiff should have done her research before getting this done especially when she has hair this long and beautiful!

They were both pretty dumb, especially the defendant... How do you know nothing about being a stylist or your business? But i do feel like the plantiff knew a lot more than she said. It sounded like the defendant told her: " this could be bad for your hair. are you sure you understand the risk or what could happen?" Plantiff said "Let's do it."
Judge Mathis is quicker to temper and will interrupt as much as he wants, which i understand he is the Judge, but doesn't let them finish explaining anything.

She overprocessed her hair with the dye. She wasn't saying anything at all about the dye did it. JM had yi drag the answer out of her. I'm surprised he didn't tell her after a couple of times her case was dismissed for lack of evidence or for inability to get her point across.
She didn't say anything about it because the plaintiff had zero complains about her hair falling out after SHE styled it. When she went a second time to a totally different stylist to get her hair bleached again, that's when it fell out. In fact, it started falling out in the second stylists bowl. She just didn't know how to argue her case.

The fact that she left during an appointment was unacceptable. If I’m paying you to bleach my hair which you know comes with risk of hair loss, the hair professional in you should finish the appointment through and educated me through the process. She was right to sue.
The consequences of wanting to go super/platinum blonde. There is always a risk when you beach your hair, especially if you have raven dark hair, because it takes time and multiple attempts for the chemicals to kill the melanin molecules, thus thinning and drying your hair out causing breakage.
I feel kind of bad for the hair stylist it seems like she knew what she was doing but wasn’t prepared for dilemmas like these. You must have a contract in place or some disclaimer clients can agree to if anything goes wrong after consultation…..additionally, she reminds me of me without coffee- all over the place lol. She’s gotta have a bit more confidence in her line of work, especially when you’re presenting a case to a judge.

Expert testimony was needed for this case. A lay person can't understand the terminology or what the expectations of dying the hair. The fact that this was a very involved technique and she handed her off to another stylist is mind-boggling. Also she said she knew the client's hair would probably fall out. She did it anyway for the money. Wow!

You can not put bleach over box dye. If u do it doesn't lift as it would and it's damaging to the extreme. After explaining she should've had her sign off that she doesn't care and will attempt to do small sessions with deep conditioning treatments. She was talking as if she was a friend who did her a favor. So the reason she lost is simply cause she's unprofessional

No, I disagree with that last part. It is not uncommon for stylists to refuse to do a service that isn’t recommended, even if the client insists because think about it….THEIR name and THEIR reputation is attached to what that client walks out the salon with. The client won’t be walking around with a sign that says: “My hair is jacked-up because I did A-B-C beforehand, ”. People are just going to wonder *who* did their hair, and then vow to stay away from that stylist.

The defendant was completely negligent in this case. Very unprofessional and acted as though she didn't even care about the plantiff dilemma of hair loss. I've never seen a case of such disregard with respect to a hair disagreement. She shouldn't be doing anyone's hair.

I disagree with this judgement. The plaintiff had a responsibility to herself as well to be knowledgeable about the process & make a wise choice. If a stylist tells me there's a possibility that my hair will fall out from a service, bump that...I ain't going. I also feel like the defendant could've defended herself a little better.

The judge got this wrong... if you don't know what's going on you should bring in a specialist ( like he's done in the past) I'm not a hairstylist and I know how damaging bleaching can be on the hair...saying " you knew it could cause damage and you still did it?" Is like say to a plastic surgeon " you knew there was a possibility of complications or death and you still performed the surgery?" Yes... The stylist wasn't good at speaking and the fact that she passed the client on to another stylist was held against her. I can't say that is right or wrong but I can't say I've seen it happen plenty
