The big problem is, many many rhythm games would cease to exist if we were to ban the use of unlicensed songs in said games. If not, we would need to start to pay just to play the songs, which would destroy the community and the rhythm game genre, i believe. osu! is not the only rhythm game that suffers from this problem.
