*UPDATE 2:* On May 23rd, MrBadim sent a copyright takedown request against the Atomic Fabrik video. It was declined. He once again failed to fill out the form correctly.
*UPDATE: UA-cam's DMCA team finally forwarded the counterclaim.* They actually declined my third counterclaim initially, based upon the form being incomplete(??) even though it wasn't. But it appears that TeamUA-cam asked them to review it, after which they realized they made a mistake (for the third time), and correctly forwarded the counterclaim. This system is INSANE, but I'm glad they finally got it right. Now, the claimant (MrBadim's son, I guess) has 10-14 business days to produce evidence they are taking legal action against me, otherwise the video will be reinstated.

The issue isn't about whether YT "cares" - many people working there do. It's about whether they "can" care. False claims like this are super easy to produce and that means YT gets probably hundreds of thousands, maybe millions of these every day. If each of them was human checked, they'd be constantly in loss just to pay those people.

That's the main problem with UA-cam's DMCA system in a single sentence.
It's not an especially satisfying reason.. but the reason it works that way is that youtube normally has protection from copyright laws on content that its users put on youtube, up until they get a request to take it down. Once they get a request to take it down, if they don't take it down and it actually does break copyright laws then youtube can also be legally liable for it instead of just the person who created it.. which means that as soon as they get a request to take something down, they almost always err on the side of removing it because they don't want to run the risk of hosting content that they could be held liable for.
@@asdfqwerty14587 True, and the worst part is that implies that the incentive for UA-cam to deny fireb0rn's counter claim request would be out of fear of Supercell coming in to sue them for allowing images of a plagiarized elixer collector model to appear on their platform, not for the fraudulent claim of copyright ownership that Vadim coerced his son into making. That they know it was blatantly false, but still think it could hurt them if they don't uphold it, so they go with it anyways.

@@asdfqwerty14587 To add: I don't know that it's been tested in court but the platform is generally thought to still have section 230 protection for improper take-downs. So even though there is theoretically a counter-claim system in the DMCA, there's not much incentive to do more than the bare minimum on it. The improper takedown submitter might be liable but the platform probably isn't.
@@professorhaystacks6606You have it slightly backwards. It is exactly because they treat every potential copywriter claim as legitimate that they keep their safe harbor protection. If they decided to arbitrarily deny some and not remove the content, they would be putting themselves personally liable for the following lawsuit. If fireborn for example tried to enjoin UA-cam against this guy, they would easy be able to have the judge remove them from the suit through section 230 exactly because they acted on the copywrite claim.
I agree that I don’t believe the act of denying a counter-claim has been tested. But that may go into YTs TOS where they are not obligated to host your videos and can take them down for any reason they wish. They deny the counter claim by effectively saying they will not host your video regardless, and then you really have no recourse since at that point the video being removed is YT just not wanting to deal with it rather than a copywrite dispute.
Edit: it would be interesting if a creator with sufficient means tried to enjoin YT in a suit against someone under 512(f), suggesting that UA-cam does have a duty to evaluate counter claims (judge the reasonableness of the original copywrite claimant) rather than only the initial claimant for copywrite.
It's broken from either side, for the record. My old channel was entirely terminated for submitting a takedown on a video that was fully owned and produced by me. I've been trying to get my old channel back for weeks at this point, and they refuse to put it back up. It got to the point where I literally mailed in a DMCA to them. No response, whatsoever.

While the whole news article exposing debacle would be hard due to to how large of a legal team they can afford, this is PERFECT grounds for a lawsuit. As one of the people who have finished the OG video, I hope you fight tooth and nail to bring it back, or upload to an external source. It is very frustrating to think that anyone can deflect criticism at them through a copyright claim, and hours of irrefutable work can just be undone like that.

The whole broken system is a result of YT doing everything in their power to ensure they *_can't_* have legal action taken against them.
However, they still care about how they are discussed through social media platforms like Twitter. So if this story is picked up by someone like Penguinz0, it could become a sort of _Actman Act II: Badim-Scam Boogaloo._
Man, this video hit home. Last year I had a different UA-cam channel of mine terminated because I had 3 simultaneous copyright claims filed by a game publishing company who I had criticized. I basically received the same automated responses rejecting all of my counter claims. I never got the channel back, after 4 months of trying. A lot of lost time and money, and UA-cam will never resolve the problem.

How big was your channel even? I can't imagine it was that large, so how the hell did they even find your video? Actually, I probably know why. They probably have someone searching for any criticism of genshin, sees if the channel is small, and just copyright claims you to death. Picking fights they know they can win. They know that someone too big can get the word spread and have the takedown removed, but pick on the little guys, and nobody notices. Screw this stupid system, it's been this way for half a decade with almost nothing done to fix it. It only benefits those looking to abuse the system, and the only reason youtube doesn't improve it is because they don't want to get involved in legal trouble, even if it's at the expense of everyone else. I think he was referring to the original video when he said that, but that one is far more damning than the response video, so it's probably fine by fire? It's the uploader's account that's at stake in that case, if anyone. But unless they have a huge subscriber count, they might not touch it.

You know TheFatRat actually had a big thing for this you might want to try and reach out to him as he is very against the wrongful copywrite that goes on in youtube and I remember him setting up some sort of fundraiser or something for it. Ik he does music and is more about that but it might be worth a shot.

I would say lawyer up, and then put that in your next counter report saying that you and your lawyer are prepared to take not just the claimant but also youtube to court if youtube doesn't reverse it. that tends to get them to reverse such claims real quick.

Genuine question, what stops you from re-posting the video with those 8 seconds edited out, or even just the picture blurred out? I watched your whole video about him and you clearly put in a lot of effort and presented it super professionally, really sucks to see that he’s tryna take it down
His (Fire’s) account might get terminated by another false takedown request on the reupload if he does that
This is his second strike. 3 and his accounts terminated. Gamerant/screenrant striked one of the videos he made right before this whole saga but I didnt see that one so am unaware what they are covering up

It’s frustrating that video discussing important topics and describing valid criticism keep getting taken down. UA-cam shouldn’t be using AI to decide weather or not a augment is valid as it isn’t their job to decide if an arguments is valid or not and clearly the AI they use is unable to make fare verdicts.
