The underground bunker part is funny.
I just noticed there is a plastic corrugated buried drain pipe jutting out into a stream on my property. It comes from the neighboring property (like maybe a downspout drainage extension pipe or sump pump). The stream crosses the property line a few feet away and the neighbors have access to the same stream on their own land. We owned the house for a little over two years and the adjacent house is 12 years old. We have a 15 year adverse possession law in Virginia. This part of my property is a native vegetation undisturbed area. The new neighbors who have been there for 18 months have been acting very interested in this area of my property either because they hate the native landscaping or because they want it because it is closer to their house than mine and it is on the other side of some woods. They've entered the area at least 3 or 4 times acting like they are nonchalantly walking. We had a boundary survey marking and erected fence posts every 70 meters to show the line. The drain pipe was never visible before so I dont know if they weed whacked to allow me to see it or if the vegetation is just short from winter. My question is is this adverse possession for this area? Can I require them to remove the pipe? I am planting trees in the area and erecting a fence in the future but am concerned about losing this land to these people.

Depends on the state. If you are not in adverse possession for the required time then you can be trespassed. If the owner gives you permission at any time before this you do not have a case.
@@madmadmal If you are requested to leave and immediately do, is that still trespassing? In his case, if he's been there for two years with no request to leave, and the owner shows and asks him to leave, and he immediately does on request, is that still trespassing?
They should also have laws for people who do fix things up. It’s sad to see people waste things then another fixes and then that person gets shitted
What happens if the owner of the land that's being encroached didn't know that was happening because he didn't know that piece of land was his and none of the previous owners ever brought it up either and the encroached didn't know either but maintained and used that strip of land.
@@madmadmal owner has to evict during the time until he obtains title. its not criminal trespass, but civil trespass

QUESTION: the owner died and the daughter died shortly after, I went to the sheriffs department and let them know the owner died and the daughter died and that I was going to take over the abandoned house. All together it was five people I was addressing one was a woman. The sheriff ask me my name and where I live and the address of the property I was taking over. He typed something up on the computer I don’t know what it was.

Hardly anyone owns property anymore. It's all warranty deed from 1933. You can only own property with allodial title.
What if said person steals mail, manipulate electronic data, threaten the true owner, take all of her possessions to trap her, then claim that person’s property. Then what is true owners rights in that regard?!

What about putting a lien on a house you did work on and the owner did not pay? Then you will be co-owner.

Is there any legal forms to fill out? I want to pursue an abandoned property…. Back taxes of 5 years. The city will be taking it to auction off next year. I want to pay the back taxes and establish residency but I also want some sort of legal documentation

How does this work if the current owner didn’t have a will when they passed away and it’s been passed down and down and down to the family for 80 years making it more than one owner ?
you will get full ownership because u occupied regardless whos name is on it, im adverse possessing right now just building my case first

@@Castro_C I did some research you have to file a "quiet title action lawsuit" with everyone who may own the house, u have to do a "title search" and get records of everyone who "owns" the house. then build your case, I read that its a hard type of lawsuit you'll really need a lawyer for. ( in Arizona if you offer the owner a quitclaim deed & they decline to sell u the house through that quitclaim deed, and u win your quiet title action lawsuit then you are entitled to lawyer fees from defendant.) otherwise u wont be. even if u only put like 3$ on the quitclaim deed.
@@Castro_C To start the process you need to compile all of your evidence that you adverse possessed the property. Then you will need to do a title search through a title company and find out who the current owner/owners are and you will have to file a "quiet title action lawsuit" against all of them, or just the 1 person, whoever has ownership or part ownership of the property, and hope the judge thinks your evidence is strong enough. however i read "quiet title action lawsuits" are very hard to do without a lawyer cuz there are regulations u have to follow or else the judge will throw ur case out. im at the stage where i need to research how quiet title action lawsuits work cuz there are regulations and guidelines u have to follow i think. so i heard its best to just hire a lawyer last one i saw was 1500$ plus other fees for the lawyer.
