I mean, when the dude asked if Burger King could actually sponsor them, BK literally said "we just gave you $5", essentially stating "we just did". Couldn't that be used against them if taken to a court of law? Also... this seems like a perfect subject for discussions about anti-spam laws, whether or not they exist, whether or not they *should* exist, and if they do, whether or not Burger King actually violated any of them.
@@GAMINGBAUS8703 Well that depends how the law defines contract. For example in the UK, contract doesn't need to be paper that sign by both side stating what do they promise to eachother. A verbal/ text for this case stating "I just did" is good enough. But of course Burger King could argue they didn't mean to sponsor them. But just to give the streamers $5 for whatever reason.
It could also be argued the the “just” meant “only” or “simply”. In that context it would be. Streamer: are you going to sponsor me? BK: No. We simply gave you $5
I don't care about streaming or advertising. What pisses me off about this situation is A) the breach of decorum, and B) the hijacking. That's precisely what BK did here. They hijacked the stream for 30 seconds. The streamer couldn't stop the TTS message once it started, so there was no control; that's hijacking. They may have paid the individual streamers a minimum donation of a few dollars each time, but it was unwarranted and was done WITH THE STREAMER'S FACE ON CAMERA WHILE THE MESSAGE WAS READ. That ALONE makes it seem like it was sponsored, makes the viewers associate the message more with them than a random midroll ad. I don't care what the law says in the moment; even if they found a loophole, they're in the wrong. They violated the spirit of the law and violated common etiquette, and they deserve punishment.
Its kinda the same to ads right? 1 ad might give youtuber cents but BK is giving 5 dollars so like yeah its annoying but its giving your streamer more money
To be honest, those of us like me who are turned off by this kind of BS are probably the ones who were already not going to BK. I won't be giving them business for a while, but the last time I chose to go to BK, they were selling glasses for the 2009 Star Trek movie and I've only been through any businesses drivethrough about 10 times this year. They aren't losing money pissing me off. Meanwhile, one person seeing a stream, thinking it's funny, and going out and buying a Whopper almost entirely pays for the revenue they gave a streamer. Granted, that doesn't count the cost of whatever human employee they had doing it, the marketing team that came up with the idea, and the profit margin they threw on top before sending BK the bill, but it only takes a few, and it's likely they targeted high profile streamers to get more distance from their efforts. Sadly, being a jerk pays in marketing.
That's very true. Isn't spamming in order to advertise an illegal thing to do for companies in the US ? Like if they started blasting your inbox with ad-mail but you didn't give them your email.
MessInMines I don’t think so. They often buy the info from info farms that buy the info from the websites you use. The websites DO tell you they will share info with third party companies, but it’s in the terms and conditions. So, for instance, your dog food company may sell your email address to an info farm, which sells it to Burger King, and then when you get a Burger King email, it’s legal. If you ask for them to not spam you, and they still do, I believe that’s not legal. But you have to deal with it in the first place. 🤷🏻♀️
@@AmaraJordanMusic Yeah but in this case Burger King didn't have the consent from anybody. The viewers, the streamers, or even Twitch didn't give their permission to BK. The viewers agree to see advertisment when they use Twitch. The streamers agree to show their viewers ads from twitch when they chose to display them. Twitch allows companies to advertise on their platform when they make a deal with said company. Here Burger King had the consent from none of those. The problem here is that the only one that can actually go after Burger King is Twitch. Twitch can go to court over this for anauthorized advertisement and win easily, but i'm not sure twitch is willing to. Depending on the people in charge it's even possible that Burger King will still be able to advertise on Twitch after this. Money from shitty companies is better than no money in the corporate world.
I put one of your videos up on my family TV and interrupted their show. Weirdly they just went with it. That’s how entertaining your videos are. That I can just interrupt my family turkish drama and they will just go along with it. 😂
Exactly, I feel like they're wasting their money, but maybe there's some other reason why they're advertising, I don't believe they can be dumb enough to just throw away their money there has to be something else going on, right?
Stepping in the conversation, they actually rely a lot on ads. Even if McDonald's is as big of a corporation as apple, they don't miss a single opportunity of saying "Hey! Here's McDonald's, come eat som crap!" Because it might seem useless but it actually works and some people (like me) actually forget that burgers exist.
Yes but as he said, he doesn't control WHEN the ads play, just how many. It was the youtube algorithm that thought "hey, put it here, perfect timing" and laughs at it's own joke
I think twitch has ground to sue, because there are twitch terms of service specifically made for advertisers on the platform, and it would stand to reason that bypassing the entire verification, taxation, and moderation of twitch to advertise would be disruption of the platform, causing in, possibly large, monetary loss.
Even then that’s gonna end up as 2.5$ since twitch takes half donations from each streamer, and even then I’m not sure if taxes are still put onto the remaining 2.5$ which could make it more like 2$ for what could be a thousand dollar+ sponsorship.
That was intentional..... matpat was referring to babish because he can earn a lot on mid rolls during the right time of the year since he is a cooking channel. Matpat went on to say this isn't the case for gamers hence the controller was shown Next time think a bit before you say something ;)
That’s so shady. Streamers can get in trouble for having an “undisclosed ad” in their streams when really Burger King just popped in and was like ima give u five bucks to tell everyone to buy stuff at Burger King without ur consent and let u get all the heat for what illegal stuff may be happening, k!
And the funny thing is its because the Aussie government was primed to sue BK, as there was already a fast food chain called 'Burger King' when American BK tried to set up shop, hence the name change.
I haven't seen that one but I have seen an ad where they admit to stealing a McDonald's recipe. ua-cam.com/video/ZF86Rb-uFNE/v-deo.html&feature=emb_title
I like that the "JUST" in the title implies that this isn't about whether he broke the lore, but rather whether it's taken him until JUST THEN to break the law. Like not "Has he broken the law?" but instead "Has he really only NOW broken the law?"
@@dividedbyzero1742 it's not illegal and it's a system streamers have taken advantage of since it began. why are u on the side of streamers here they aren't entitled to a sponsorship.
Imagine if you were having a conversation and someone shouted an advert catchphrase in your face mid sentence. That’s what this sounds like. Like trying to have a conversation whilst walking through the town market
Id consider this analogy poor because there is no difference with a tts that shames the streamer on public like “everybody hands up im a robber”. you’re literally going against tts, not just what BK is doing.
I can see the analogy a bit, I like the idea of shaming companies that do this or doing what Ross did during his stream when it happened. I also like the cool refreshing taste of diet coke.
uhhh these arent conversations, people dont throw money at each other mid conversation. You're trying to make the initial interaction sound less sleazy than it actually is - face it, from the start it's more like a person on stage, and the crowd throws money at them, except one guy throws money and says SHOP AT BK!!
"But is it illegal?" If it's not now, it will be soon. Every advertisement also has to pay out to Twitch, UA-cam, Fox or wherever is playing their ad. Do you really think for two seconds corporations are going to let this slide?
I literally laughed when I heard the clip with "I just spent $5 to say you can spend $5 to get a whopper" I like hos reaction of "what is going on?" Big companies are invading live chats and streams to advertise.

@‘‘ well, technically, they could have done 2 things with a budget of 10000$: 1. Spend 10000$ on twitch for ads, targetted pretty much indiscriminatively towards people that ignore most of the ads and get very little profit from that investment, while the streamers who end up displaying those ads maybe earn 20% of the budget while Twitch keeps 80%, meaning in total, they basically pay Twitch an 8000$ tax for paying streamers 2000$. 2. Spend 8000$ directly as TTS messages, during relatively high traffic, exactly when they want to, towards an audiance they want to, then spend 2000$ to get their advertisement about having been visiting streamers around to get the maximum amount of profits from their investments, quadroupling the amount of money that goes to streamers directly. So, while I disagree with their method, it's actually more streamer friendly than Twitch itself has been.
Here’s two things that may have been overlooked: One: if BK put these adverts on non-American streamers, the laws may be different. For instance, I could imagine that UK advertising law - which is much more strict than the US equivalent - could make this kind of advertising illegal. Two: these TTS adverts are fundamentally different to mid-roll ads *because* they give more money to the streamer. The majority of mid-roll ad revenue goes to Twitch, rather than to the streamer, whereas the majority of donation revenue goes to the streamer, rather than Twitch (for BIT donations) or StreamLabs (for other donations). This could potentially put Twitch or StreamLabs into a position where they could sue BK for lost revenue. I will admit that I don’t know a lot about the law, but these things seem like pretty big problems for BK. The difference between a big company BK being sued by small, independent creators, and a big company like BK being sued by another big company (Twitch or StreamLabs) is vast, and more likely to frighten BK into not doing this again.
If BK saw this comment, they would probably get annihilated by more strict laws in different countries. Then they would sue some twitch streamers to try and get their lost money back, and then proceed to lose more money...
System in place: money -} Something said on stream. Twitch streamers think it shouldn’t be this way are silly 😝. If let’s say a company instead of saying: go buy something. Said I love [Product] that costs x amount of money that wouldn’t be advertising. Just discretion of opinion so it would open up more issues. Technically thanking the streamer is also advertisement because it’s a “trusted” sources opinion as referral to other viewers to subscribe or spend money. Just because a big corporation did the same thing millions of people do doesn’t really make it wrong.
you are so smart, I mean I can not think those ideas that fast, for 3 channels, and probably a new one coming soon, not to mention the many other channels!
That’s why Burger King’s wife left him. He’s a lier and Dairy Queen couldn’t take it. See I have a fast food universe. McDonald is the creepy farmer. Wendy is one of the village kids. Jack in the box is the jester. U can keep going. But to be serious she just didn’t know when to trust him.
Another way I look at it, is like this: Imagine if another Content creator used a 5 dollar donation to advertise their YT Channel/Twitch on some much bigger streamer's livestream. Surely EVERYONE would think that's fucked, right?
@•o• And imagine if a company of any money did something smart with it. Oh dear. How stupid of burger king for using a tactic to avoid spending 80 grand on some advertising. Do you even hear yourself? you are getting mad. That burger king. Went on stream. PAID money to these streamers through a service they provide. And used that money wisely to avoid spending a crap ton of money. Please grow up
I don't think burger king should do that but the analogy is a bit off since they are not offering the same product. 2 streamers compete for viewers while BK is competing for customers so it doesn't directly impact their business as say burger king promoting their new dollar burger next to a 1.50 taco stand.

Also... this seems like a perfect subject for discussions about anti-spam laws, whether or not they exist, whether or not they *should* exist, and if they do, whether or not Burger King actually violated any of them.
Without a contract, legally they wouldn't be considered a sponsor. It's not forced sponsorship, it's basically unsolicited mid roll ads
BK: No. We simply gave you $5
@@GAMINGBAUS8703 unsolicited midsole add, which also affect the people subbed to the streamer and can normally bypass them.
“We gave you five bucks so we get to tell hundreds to millions of people to give us money”

That's what he said
That's very true.

@@royabraham9167 No. Twitch is a *FREE* streaming platform. Them not making people pay to stream is the entire f*cking point.
@‘‘ well, technically, they could have done 2 things with a budget of 10000$:
Here’s two things that may have been overlooked:
One: if BK put these adverts on non-American streamers, the laws may be different.
Twitch can't sue them for that because it's simply a viewer making a donation.
Yup
N
you are so smart, I mean I can not think those ideas that fast, for 3 channels, and probably a new one coming soon, not to mention the many other channels!
The FFCU (Fast Food Cinematic Universe)
I actually talked about this with my family
Nuraz yes
Lizzie The Shortie they will think ur crazy why. Lol. (Me too)
"Oh Henry!"
"Sweet Marie!"
"Oh - Henry!"
"Sweet...Marie...!"
"SCORE!"
Another way I look at it, is like this:
Imagine if another Content creator used a 5 dollar donation to advertise their YT Channel/Twitch on some much bigger streamer's livestream.
Surely EVERYONE would think that's fucked, right?
I've seen youtubers pay for spots on other youtube channels.
@@hyuugajay But streamers did not consent to having that advertisement on their stream.
@@hyuugajay As matpat and the terms of services of Twitch say BK used the service improperly for advertisement when it is not meant for that.
You should do an episode about how Hungry Jacks in Australia released a “Big Jack” and have been sued by McDonalds
That's a dumb lawsuit. I dont think they can win that Just because it rhymes lol.
Yes! I was thinking the same thing.
I was thinking the exact same thing when I saw Matpat’s video
