Justice Thomas failed to take one thing in consideration and that is that an innocent person could be held in prison in violation of their 4th amendment rights guaranteed by the constitution. That guarantee demands a remedy under law. It would have to be a clear issue that would result in the overturning of an appeal to be considered. It would have to be so clear as to not retry the case but overturn it on its face. Very limited but the 4th amendment guarantee demands it.
