    The death penalty should be mandatory in crimes with a high death toll regardless of a mental plea. A jury does not want to have the weight of committing someone to death in this day and age. Someone who commits this type of crimes should not even have the choice of life in prison.

      I respectfully and highly disagree. Mental health should not be overlooked. That would inhumane to give someone the DP without acknowledging the state of their psyche first. I can't believe this is where our country is.

    Even if he was given the death penalty, he could be sitting on death row for 18-30 years, still wasting tax payer money, and still having all the opportunities to prolong his life . Death penalty doesn't = instant death

      No one claimed that. He is young and will live at least another 60-70 years under tax payer money which is a far worst case scenario than 18-30.

      Agreed and it was an instant death for his victims or if they weren’t dead yet, he made sure they were with more bullets shot. He deserves the death penalty, period. But, I do believe he won’t survive long in prison since there is always some prisoners that don’t like child murderers.

I know someone that’s been in there 33 years with a life sentence and still fighting for there freedom that didn’t kill rape nor shoot anybody accused of a robbery

      The jury has to follow the jury instructions. They take an oath:
      “Neither sympathy nor prejudice should influence your verdict.”
      Like the brash governor, you people are pretty ruthless in second guessing the jury. They were there, they heard the facts and the law, and they decided. They took an Oath. Maybe oaths don’t mean anything to y’all. Obviously, Desatan does not care. He knows better. If I was on The jury and heard the governor saying I was wrong, I would complain to the judge and the newspapers. It is disrespectful. The jury worked very hard and did what they swore under oath to do, which is follow the instructions of the court and come to a decision.
      None of you were there. You didn’t hear the evidence. In América, we don’t try defendants in the media. That’s what you’re wanting. You’re all judging him based on what the media said. And that is wrong, wrong, wrong. The media lies. They’re not under oath. They’re not subject to cross examination.
      Don’t try to second judge a jury. You’re not better than them. They did their duty. Accept it and move on.

    Well nice for the Governor to come out and say yeah it wasn’t right and I hope they look into whatever else they can do. Yeah if there was ever a case that deserved the death penalty it’s certainly this one. No one wants this guy around not even the incarcerated

    There is a huge difference for people on a jury listening to the facts and deciding guilt or innocence.
    The decision for the death penalty should not be decided by ordinary citizens, because they have to live with the fact their decision is going to bring about the death of another human being. For some, it's very difficult for them to be part of that process due to personal and/or moral reasons.
    The decision for the death penalty should be on the shoulders of the presiding Judge, just as he administers punishment according to judicial guidelines according to the State he rules in.
    Whoever thought the decision on death should be decided by a jury, should be barred from the planet, absolute stupidity!!!

      It’s true, they rely on regular citizens to make a jury decision. But it’s clear that this murderer did more than just kill a person, he killed 17 people viciously. I feel he was coddled all through the trial and the families came each and everyday only to be disappointed. The courts are not strong as they shroud be. With this it sends a message that any mass shooter won’t face the death penalty.

    Ron DeSantis took money from the NRA and the only way you get that money is by answering a questionaire where you say you completely oppose any gun safety. His press conference today is manipulative and opportunistic. I worked as a crime victim advocate in Florida, he is no crime victim advocate.

    He's speaking of juror misconduct. If the holdout juror lied about his or her position on the death penalty during voir dire then that would be contempt of court or something of that nature. I think it should be pursued to send a message to all future jurors that you will be held to your word under oath. In reality this penalty phase trial was just a walk through. This case is a poster child for the death penalty. Anything less is a criminal miscarriage of justice.

    Rapides parish Louisiana medieval dungeon built 100 years ago, 27 of us locked in a small steel box no bars are widows solid steel door with a slot in it to pass meals in, same as solitary confinement meant to house about 16 one toilet and one sink, half of them in their belonged in a mental institution some have been their so long they have turned into wild animals, if there was ever any hope of rehabilitation their is none now, they fed us rotten fish and rotten meat and molded bread that they got for free, half the people in their kept diarrhea and had stomach problems we got hot water down bidder kool aid with no sugar to drink, some have been in their for years just waiting on trail, the charges ranged from murder to shoplifting all in the same cell, I was wrongfully charged and had all my charges dropped, but I stayed in this hell hole for a week, I finally got bailed out, it took 3 years for me to finally go to trail and have all my charges dropped, but if I never would have gotten bailed out I would had to stay in that hell hole for three years, I wanted to sue the Sheriffs office but I couldn't find a lawyer to take my case even though I had a undisputable case, they all were scared to go against the Sheriffs office cause they all had cases they were trying to get deals on.

    Ron, Ron, Ron. Read the statute on mitigating factors. If you don't like it, then have the legislature change the statute to automatic imposition of the death penalty upon a guilty plea to a capital offense.

      The law says a jury of his peers, and we need to accept that. It was not easy being locked in a room and determining whether a person will live or die. That's our justice system, it is not perfect.

But on another note this person would be in jail with other murderers and rapist, you don't go to minimum security for something like this, at least I would hope not.....if that is the case then something has gone really wrong.

    DeSantis is basically arguing that if we don't agree with the jury's verdict, then there should be another process. The jury system IS the process - support it, even when you disagree with a particular verdict. If the law is wrong, then amend the law - that's what the legislature is for. But don't cherry pick a particular verdict and demand isolated cases get better/different/individual consideration.

      My exact thought. You take away this check and balance due to an unpopular verdict, and you've got legal precedent to overturn every jury that "gets it wrong" basically making juries useless.

    For starters, Florida has the dumb law requiring trials to decide life w/o parole or death instead of a judge to decide their fate, like the majority of states; a waste of taxpayer $$. The defense for this decision laid out an almost flawless case showing how the current state of Florida system was at least partly responsible here if not more so. Watch the testimonies, from a private, pre school director 's compelling testimony how she reported to the proper agency that Cruz, a year old toddler showed distinct physical and developmental symptoms stemming from in the womb brain damage caused from a drug addicted mother. She did this with the hopes he'd be evaluated by doctors as proper followup, after informing the adoptive parents. They did nothing, no follow up or no regulatory process requiring evaluation. As he aged and was showing more developmental violent symptoms at home, county agencies would be seen at the house, multiple times again, to evaluation by doctors or precautions taken. That was testimony by the neighbor across the street. Then, due to a lack of communication somewhere, everywhere, when he attended the Parkland high school he shot up, they allowed him to enroll in their ROTC, multiple year program where he was educated about weapons,
    shown how to use them, so well, he won a sharpshooting marksmanship award. That was the ROTC program director from the high school testimony. This was the defense 's icing on the cake. How could this happen? This is typical of many states' red tape problems. This case will be studied hopefully to close the gaps these agencies have, to avoid this from happening again in Florida or many other states.
    Horrifically, this system handed a brain damaged kid guns and taught him how to sharp shoot. How could he be sentenced to death despite the severity of these horrible, tragic deaths. Apparently Desantis is naive (doubtful), or isn't going to acknowledge the state's accountability. The Sandy Hook shooter was diagnosed being on the spectrum of autism. His mother allowed him an arsenal of guns, so it was more on her and not the state in that case. He was given a diagnosis, Cruz was not.

    People on here want the death penalty, its according on what jail you're are in, some jails are ten time worse than death. I've seen jails in small towns in Texas where you would rather stay in jail instead of being released and then I've seen jails in Louisiana where you pray for death and would do anything to get out.

    I do not support the death penalty. However, I believe there are Fates worse than death. I am not religious, but if there's a hell, the thought of spending your only physical body life in prison until you die, only the two eternally suffer is a fate worse than death

However, as a person of color, and knowing that the death penalty is disproportionately handed out some people of color for the same crimes committed by white people, I'm just not willing to have a system in place that plays with people's lives. If just one innocent person gets killed from the death penalty, it's too far. At least with the life sentence, there's always room for redemption. Death is final, there is no coming back. That is not to undermine your perspective or the pain that the victims have to go through. But I'm willing to tell the judge and my lawyer if something happens to my family that I do not support death penalty and I would like to see them convicted to life.

    Maybe you should try at least ATTEMPTING to prevent these things from happening instead of pushing for guns guns guns for everyone no matter what their mental stability might be. It's a little too late to care now.
    I'm not opposed to the death penalty, but honestly that's the easy way out. He'll suffer in jail for years and then he'll die anyway. Life is a harsher punishment.

      Jerry, Nicholas Cruz killed students on Valentine's Day because of his own miserable existence on this earth. There should not be a trial when there's absolute proof a person took a life of another or others. A judge should have the sole authority to sentence a person to death for their hideous crime against humanity. Execution should follow within 48 hours. The kids he murdered had their entire future ahead of them. He took that away from them without any remorse. There's no reason for him to continue to exist.

      I don't think it makes sense to kill the defendant, we need a justice system that tries to rehabilitate people, not punish them.
      When we punished children who crossed the Mexican border by locking them in cages, that deterrent didn't have any effect on immigration, simply because punishments and deterrents don't work. The Death Penalty is a completely ineffective deterrent that honestly needs to go. Would you rather pay a little extra in taxes to kill defenseless people who surrendered in jail, or would you feel better being part of a system that tries to rehabilitate them?

    The problem here, is the justice system isn't just, it's corrupt, in yrs, I've seen criminals having better/ more Priveledges, than the victims themselves, but these jurors don't sometimes know even what really happen in some city, state, these cases r movedround somewhere else, an alot of these jurors have no CONCIENCE, compassion of these massacres?? They simply don't care? It didn't happen to me, well too bad, not my kid, my mother/father, brother, /sister?? So Why Should I Care? Or put too much emphasis in this case/...!! !! BUT Let It Happen to Them, DEEP ?? Where It HURTS, an let's see another reaction....??

    Convicts should have to help replace the roofs that the insurance companies are requiring be replaced. Replace death penalty with a life sentence of hard labor if guilty beyond reasonable doubt. That’s a real deterrent.

Matter of fact, that was one of the first kickstarts to the prison industrial complex, even before the war on crime. Even still, slave labor is still enormously unethical. What we should do is gear prison systems or Rehabilitation instead of just punishment. Finland did it. As a matter of fact, Finland has a prison museum to show how brutal and barbaric their prison system used to be. It looks exactly like our modern-day prisons.

      You are undermining the jury because 3 of them gave a result that you didn't like. This reminds me SO much of the Kyle Rittenhouse trial when it comes to the jury. This is how America works. If we make exceptions then the wrongfully convicted can get executed before even having the opportunity to show their innocence. Nik had taken responsibility and there is undeniable proof that he did it. Those 3 jurors aren't the only people who gave Nik mercy in this country. I get the frustrations but whining about the outcome and getting angry at 3 jurors who followed their duty that didn't go your way is ridiculous.
