    Explanation of Stare Decisis
    The doctrine of Stare Decisis is a legal principle by which judges in the UK are obliged to respect the precedent established by the previous decisions of other judges. For example if Conservative judge A decides in 2010 that the punishment for killing another person is twenty-five years in prison, then Liberal judge B in 2017 cannot decide that the punishment is twenty years. In 2017 Judge B must follow the precedent established by Judge A seven years ago. And so Judge B must say the punishment is 25 years not 20 years.

    So judges in the UK are required to interpret the law in the present according to what other judges decided in the past

    Stare decisis is a Latin term. It means to stand by things decided. Stare decisis is a doctrine used in all court cases and all legal issues. A doctrine is simply a principle or an instruction but it is not necessarily a rule that cannot ever be broken. The doctrine of stare decisis means that courts look to past similar issues to guide their decisions. The past decisions are known as precedent. Precedent is a legal principle or rule that is created by a court decision. This decision becomes an example or authority for judges deciding similar issues later. Stare Decisis is the doctrine that obligates courts to look to precedent when making their decisions. These two principles allow American law to build case by case and make our legal system a common law system.
    For example let’s say (person) blue borrows (person) red’s lawnmower while red is away on vacation…. (video continues). Now listen and answer the question below:
    Lawn mower Yellow car
    How are the red man + blue man regarding the red lawn mower and green man + yellow man regarding the yellow car used to explain stare decisis?
    - to repair a lawn mower = to fix a lawnmower
    Answer
    The judge’s decision that the green man must repair the yellow car and not replace it (i.e. buy a new yellow car for the yellow man) is based on the precedent of the red lawnmower which the blue man had to repair for the red man but not replace it (i.e. buy a new red lawnmower for the red man).

    Nice video. Only one thing to say. You cannot say STARE DECISIS in american/english pronounce. It's latin! You must pronounce it as you read it in Italian...

    "Rule of precedent" in other words "law".
    Which means the judicial system is creating law. Bypassing our legislative system.
