The ACC schools complaining about the GOR and wanting to leave FSU, Clemson, UNC, etc.. should have never signed a 20 yr deal. They knew the landscape was changing quickly. They only have themselves to blame. They should have only agreed to at most a 10 yr deal and they would have been free in 2026.
If fsu finds a loophole the ACC is dead. It’s really on life support now, it will cease at that point. There will be schools left holding the bag that will complain… when their mouths were silent when problems were being identified.
The 20-year TV Deal and GOR are the reason there is STILL an INTACT ACC today and not a DEAD ACC. If ACC could have been RAIDED last year the PAC would still be ALIVE and the Big 12 wouldn;t be the Mid 12 right now. 20-year GOR was the RIGHT STRATEGY and picking up schools in California and Texas in the aftermath was the RIGHT TACTIC. Between the FSU/NFL Alumni, the FL Senator Scott, the Gov Ronnie D (who already raised $1 million in legal fee coverage for the Noles), the Burt Reynolds estate, the Lee Corso future estate, half the State of FL legislature, they should be able to write that $110 million exit fee check today. And if no SEC/B1G Ten takers, go back to pre-1970s Independent....NDame South 😂

So when it comes to $$$ (ie subscribers) by adding SMU the ACC has also added every FAN of Texas, Oklahoma and A&M to the ACCN Subscriber Base. And any other Fans of the ACC, SEC or B1G that live in Texas too. That is a HUGE POWER MOVE. AND Guess what that also means. By adding schools in California the ACC has added SUBSCRIBERS from the Top 4 Fanbases in California. And they added every B1G, SEC or ACC fan that currently lives in California too. MEGA $$$$. Part of the reason the B1G grabbed USC and UCLA was to grab all of those B1G fans in Cali. And that is just about 1/4 of how what the ACC has done is a HUGE PAYDAY. There is MORE. Much More. But since I just PROVED you don't know ANYTHING TRUE I can wait while you sputter like a stupid clown and not believe FACTS.
It was a just matter of time before Florida State started this process because college football has become all about the money. The College Football Playoff snub gave them that last extra shove. The Atlantic Coast Conference had better start butting heads with ESPN if it doesn't want to become like another Pac-12.
ESPN has the ACC's back and has had it this entire time BUT THINGS DO NOT HAPPEN OVERNIGHT. ACC Revenue will be UP $16 Million EACH next year and UP another $20 Million EACH in 3 years and up another Large Sum in 7 years. But FSU is Financially Illiterate and DUMB. So they won't WAIT and WIN they will LEAVE and LOSE
College football is just a money league anymore. Players jump in the portal in December and don't go to their bowl game they played all year for. And schools jumping conferences continually. Really getting turned off by it all.
FSU's filing, "It is not bound to it's contract with the ACC" is correct. No ACC team is, but they all signed a binding Grant of Rights agreement where there are penaties for leaving. That’s all that matters. If a school in the ACC leaves without a majority consent to disband the conference before the end of the Grant of Rights, they pay an exit fee of 3 times the operating cost which equates to about $120 million, plus all their TV revenue at their new conference goes to the ACC for the remaining duration of the Grant of Rights. It is financially impossible to leave without a court striking down the exit fees. I don’t see FSU being successful in their argument of not paying those exit fees. If they are somehow successful, then Miami, UNC, and Clemson will leave as well.
FSU is doing this all wrong…they need to do this behind the scenes and announce it once they have an invite and figure out how they can get out of the ACC grant of rights

There is a political aspect to this situation with FSU. The state of Florida has been going after Disney for taxes and preferred treatment in Florida. Disney owns ESPN. Plus the money payout as you say. Thanks.
Bonus, if FSU can get enough other schools together to break the grant of rights, and collapse the ACC, Notre Dame could be forced into a conference. Right now, ND plays what, 6 games of ACC teams, break the ACC, and the other P3 conferences could freeze out ND by refusing to schedule them forcing them to join a conference, or take a serious hit to their scheduling G5 schools.
I just don't see what legally they can do to not pay the exit fee. This is an agreement made by lawyers, gone through by lawyers at all the schools and and more lawyers at one of the most powerful conglomerates in Disney/ESPN..... I just don't see how there would be any, ANY, loophole that could be found
there are half a dozen ways around it. from suing over the contract in several different ways, to playing the "states rights" game with the state government backing, to just breaking the contract and letting ACC sue them and sit back and play defense legally. After they leave if they renig they can either just wait as ACC falls apart and try to outlast them legally or pay a settlement with a desperate ACC. You talk about Disney lawyers like they invincible I'm pretty sure the State of Florida and their university systems have pretty good legal teams as well.

It won't be a simple as you suggest, but play out your theory for us. FSU leaves and refuses to pay the exit fee. ACC still owns the excusive rights to televise FSU football games so the ACC can say ok, we can either NOT televise your games and recruits won't want to go to your school or we will televise your games and keep all the revenue until we get to the $110M you owe us, slapping an injunction on any other media company that tries to broadcast Seminole games. Why would the SEC then take FSU? It's media partner already purchased the media rights through 2036. Is ESPN going to feel bad for the Seminoles and just fork over another $10M out of charity? And I highly doubt the Big Ten/Fox will want the headaches of jumping into the middle of litigation, likely telling FSU: "call us in a couple of years when the litigation is over."
I believe I saw when PAC 10 was being picked apart that there is a clause that if 6 or 7 ACC schools leave at the same time, there are no exit penalties for anyone. So technically if if Big 10, SEC and Big 12 poaches were to poach 2 members each, there would be no penalties.

@@petion2013 The ACC is managing a decline to the BIG12's Tier 2 level. The +3 work just fine for that and retains the ACC's general academic and overall sports branding. The BIG12's +4 were dilutive and the 4Cs just tread water.
A declaratory judgment strategy has been available on Day 1 of this story, and I have referenced for almost as long. The question is why now than earlier. Most likely because such an action jeopardizes all GORs, will not make any broadcaster happy, and there have been ongoing efforts to renegotiate the ACC's deal with ESPN. My gut says proper venue/jurisdiction would be NC. If FL law is materially applicable making FSU less responsible for contractual obligations, that could make it less attractive to the P2. Anyway, I maintain that a court would most likely shorten the GOR and lower the exit fee in a full challenge. Ironically, that could also shorten the time that ESPN would have to renegotiate, but the ACC value diluted with the +3.

I remember the Ole Western Athletic Conference when it expanded to 16 teams. There was a lot of infighting, and the conference broke up. There are some similar parallels here.

FSU only played 3 ranked teams all year and LSU was the only highly ranked, at the beginning of the season. Their out of conference was very weak. Don't pick creampuff teams to play and you get in. With Miami and Clemson not being good, the ACC was a very weak conference.
What was their record against bowl eligible teams, and did they schedule 2 sec teams in season. What more could they do? They WON all their games, which is more than 2 teams in the espn/sec invitational tournament
Playing in the ACC, with a bunch of mediocre, kills your chances in the rankings. The Big 10 has 3 strong teams, the SEC has numerous high level teams and big time games week after week. These Conference are adding USC & UCLA and Washington and Oregon. The ACC added more mediocrity with Cal, Stanford & SMU.

Didn't realize FSU was so poor that they couldn't pay the $500 million in exit fees. I mean, Michigan State paid $500 million in a settlement, $100 million for a coach that's not coaching, and $45 million for a coach to coach. FSU not leaving the ACC with a 5 year payback doesn't make sense.

No we would not. Starting in 2024 the Big 10 would have the #1, #2 and #3 media markets. #1 NYC has Rutgers; #2 LA has USC and UCLA and #3 Chicago has the Big 10 HQ. There are media markets, and then there are college football media markets. FSU is a huge college football media market. It would be fiscally irresponsible for the Big Ten not to accept FSU, should they want to join the Big Ten Conference.

I think it had more to do with losing Travis and that weak showing they had against Lousiville than it was the ACC, but saying they play in the ACC is the scapegoat answer. Had they beat Lousiville 37-3 they would have been in, it's pretty simple.

No, the reason why the Big 10 denied FSU is because it is not an Association of American Universities member. Neither is Utah. Add to the fact that the Big 10 will get Los Angeles (#2 media market), Portland and Seattle, there isn't as much money in Salt Lake City. I was thinking about it, the SEC & XII each had a one loss team in the playoffs. I can see why FSU is butt hurt, but If they had played in the B1G, SEC, XII or PAC championship game they would PROBABLY have lost as they only had their 3rd string QB.

I don't understand why people think they have to follow the law or rules of the conference to leave the conference while at the same time the conference has this ironclaw writes rule that they have to fight and break the rules and that contract to get out of the conference. It doesn't make sense to me if you're going to break the contract which will be breaking rules to the conference you might as well break them all. If you want out ASAP which would be at the end of spring semester if I'm on the Florida State University I would say ACC screw all your rules not giving you a year we're out by summer no matter what. Makes sense to me. And then you just let the courts handle it from there but in the meantime you're independent or you're either joining the Southeastern Conference and making Disney happy which would just make ACC unhappy you're pissing off both Disney in the ACC conference and you're joining Fox and Big Ten. But I think once Florida State leaves you'll see North Carolina Virginia Georgia Tech Miami Clemson also jumping ship. Maybe even NC State.
As a Canes fan, this is first and only time I'll ever root for FSU to win at anything. If they find an escape hatch....the precedent would be set and flood gates would open for other schools as well. Good luck...we're all counting on you.

By adding schools in California the ACC has added SUBSCRIBERS from the Top 4 Fanbases in California.

College football is just a money league anymore. Players jump in the portal in December and don't go to their bowl game they played all year for. And schools jumping conferences continually. Really getting turned off by it all.
FSU's filing, "It is not bound to it's contract with the ACC" is correct. No ACC team is, but they all signed a binding Grant of Rights agreement where there are penaties for leaving. That’s all that matters.
If a school in the ACC leaves without a majority consent to disband the conference before the end of the Grant of Rights, they pay an exit fee of 3 times the operating cost which equates to about $120 million, plus all their TV revenue at their new conference goes to the ACC for the remaining duration of the Grant of Rights. It is financially impossible to leave without a court striking down the exit fees.
I don’t see FSU being successful in their argument of not paying those exit fees. If they are somehow successful, then Miami, UNC, and Clemson will leave as well.

ACC still owns the excusive rights to televise FSU football games so the ACC can say ok, we can either NOT televise your games and recruits won't want to go to your school or we will televise your games and keep all the revenue until we get to the $110M you owe us, slapping an injunction on any other media company that tries to broadcast Seminole games.
Why would the SEC then take FSU? It's media partner already purchased the media rights through 2036. Is ESPN going to feel bad for the Seminoles and just fork over another $10M out of charity? And I highly doubt the Big Ten/Fox will want the headaches of jumping into the middle of litigation, likely telling FSU: "call us in a couple of years when the litigation is over."

My gut says proper venue/jurisdiction would be NC. If FL law is materially applicable making FSU less responsible for contractual obligations, that could make it less attractive to the P2.

I've always thought if the Big10 expanded further, it would go for North Carolina and Virginia. FSU seems like a poor fit. Big10 likes to think its an academic conference.

SEC dont really want these teams but they might end up taking them to try to prevent them to Big 10. Big 10 definitely interested in Miami FL too. North Carolina and Virginia would be decent moves but wouldn't increase revenue. Adding FSU / Clemson would skyrocket revenue. Nobody cares about Ohio State versus Virginia. Florida State vs Ohio State or Michigan or USC etc is a multi million dollar game for the conference with the TV money.

I was thinking about it, the SEC & XII each had a one loss team in the playoffs. I can see why FSU is butt hurt, but If they had played in the B1G, SEC, XII or PAC championship game they would PROBABLY have lost as they only had their 3rd string QB.

I don't understand why people think they have to follow the law or rules of the conference to leave the conference while at the same time the conference has this ironclaw writes rule that they have to fight and break the rules and that contract to get out of the conference. It doesn't make sense to me if you're going to break the contract which will be breaking rules to the conference you might as well break them all. If you want out ASAP which would be at the end of spring semester if I'm on the Florida State University I would say ACC screw all your rules not giving you a year we're out by summer no matter what. Makes sense to me. And then you just let the courts handle it from there but in the meantime you're independent or you're either joining the Southeastern Conference and making Disney happy which would just make ACC unhappy you're pissing off both Disney in the ACC conference and you're joining Fox and Big Ten. But I think once Florida State leaves you'll see North Carolina Virginia Georgia Tech Miami Clemson also jumping ship. Maybe even NC State.
As a Canes fan, this is first and only time I'll ever root for FSU to win at anything. If they find an escape hatch....the precedent would be set and flood gates would open for other schools as well.

Florida State will make a big mistake if they leave the ACC? FSU would have a much better chance to get into next season CFP with the expanded 12 teams then trying to compete in the Big 10, or SEC? The Big 12 isn't any better then the ACC, and it would cause FSU fans to have to travel very far for road games? Next year's Big 12 isn't going to compete well with Big and the SEC?

The acc is on its last contract. Look at the pac. The sooner people realize the acc is g5, at best, the better off they will be. You don't want to lose your cash cow. Guess what? Fuck you we're gone.
They will make twice as much in the Big 10 and will elevate Big 10 to true national status footprint wise meaning more money and better branding going forward. Going to new Big 10 or staying in ACC is night and day the Big 10 much much better.

ACC has irons in the fire and just needs time to develop them MUCH LIKE the B1G and SEC needed TIME to develop the SAME IRONS that they put in the fire EARLIER than the ACC did. ACC was just LATE to the Party on the Streams of Revenue the B1G and SEC are using NOW to create this GAP. But ACC will catch up.
Everything is IN PLACE and WORKING towards closing that GAP in the ACC... but the Big 12 is STILL more than 15 years behind everyone else.
