  • In 2006, New York City designer Ari Saal Forman dropped a limited run of Menthol 10s, a one-of-a-kind sneaker that drew inspiration from and took a shot at Nike and Newport. Written right there on the tongue, Ari explained that the shoe was “dedicated to the two brands that have taken the most and given the least.” Once the companies got word that the shoe was out, they did everything they could to get it off the market.
    Ari wound up getting a cease-and-desist letter from Nike and facing an aggressive lawsuit from Newport. To this day, he’s not even legally allowed to own a pair. VICE met up with Ari in Manhattan to hear the inside story of why he made the Menthol 10s, and why he took on a legal battle in the name of conscious consumerism.

      That box is crazy expensive, the entire shoe is. So if he want's to compete it's in the highest of the high end market. Not shoes for the common man. Also he must have known that they would sue him. The way trademark laws are set up they have to sue him to keep their trademark. If you don't you have no course of action when someone truly and maliciously infringes on your trade mark.

      People bootleg all the time still to this day like Imran potatoes and others and they rarely get heat . Even dapper dan only got Cease letters when he became too big like a retailer . For the most part they leave you alone , but I think it was the connotation of tobacco and the similarity of Nike combined in a sneaker and Nike didn’t like that . Had it been a brand like snickers or a food brand then they wouldn’t give a damn but cigarettes is a no go for them

      @@C-Lyfe85 Yeah, that's usually what they do. Whenever they can recruit someone who's a creator of what a Corporation want and like, they know that person as creator is going to want ownership Rights an/or a large percentage.
      Generally they will throw a low ball offer, to buy out a newer Company and therefore it's hot product/s.
      If the offer is refused, which you MAY as well SELL it because if you DON'T take an except their offer. They'll simply make a small tweak to the Product, an steal it entirely.
      Which with the money and marketing large Corporations have, no one would even question the Company having STOLE the ideas. Or as NOT not being the original creators, an as an Established name brand would basically steal any attention or sales the actually creator would even get.

    I remember the famed Menthol 10's. It was back when the shoe game was not bought out by the web bots and and Supreme was still new and original. Back when we didn't have smartphones and I'd carry around a map of New York with all the sneaker stores crossed out and then I would make my plan so I can hit all the spots within a few day period. Those were the golden days!!

    I had the privilege to meet Ari nearly 10 years ago, this guy that I knew John was close friends with him and I had lunch with them at Miss Lily's down in Manhattan. John owned a pair of the Menthol 10s so I got to get a close look at them and the attention to detail is next level. Ari is a brilliant guy, this could go down as one of the most iconic sneakers of all time for it represents so much more than just a shoe. Crazy how much money some of the cease and desist skateboard decks go for, these being so rare with so few of them they could be very undervalued as a true piece of culture history

    This man is wonderful! No matter how many times I watch this. It never gets old, not just a story, Imo it's due in large part to homies personality! It's no surprise he came from the skate community. (OG skate community) one of the best decisions I ever made was getting involved in skating..... best times of my life!!
    Back in the day it seems like there were a few guys like Ari sprinkled throughout skating worldwide. And they helped shape people and the culture.
    I have never experienced anything remotely close, or met anybody like the people that I met back in those days.
    S*** I'm just rambling, but it's hard not to. Some might read this comment until we get what I'm talking about! Props Ari!!!!!

    This should be considered fair use under the parody statute. It's copying of copyrighted material done for a limited and “transformative” purpose, which is criticism and comedy.

      I’m not quite sure on how this law is worded but there are many similar laws on the books for similar situations amongst other categories. In the others there’s a consistency when it addresses the range of actions one is allowed to pursue and remain protected. With that being said, the language of these laws pertaining to profiting off such acts of expression seem to be pretty consistent in that the laws are NOT on the books to protect ppls right to profit on these ideas but rather to simply protect the freedom to create or distribute types of information they are passionate about sharing or feel is important.
      On one hand, collectively these hundreds of smaller, unheard of and “specific in nature” laws are everything that creates our fabric of freedom being woven YET UNFORTUNATELY since they don’t always get as technical as they should on the financial aspect (given its not the reason for being created) many ppl like this great gentleman have to simultaneously get a crash course in how insanely expensive this shit is considering the way most of these disputes originate from, which is a “David vs. Goliath” type circumstance where the larger party knows this already and has all the disposable income they need and more to seek and destroy anything that gets in their way. NOW, you’d have to be living under a rock to not sense the change in tide slowly developing and in the future the little guy is going to have the capabilities to compete on every level. Wouldn’t it be great if the reality wasn’t that they’ll just adjust the laws down the road once any type of inequality gap amongst the rich and poor starts to shrink. Regardless of any of it, you gotta respect this man’s passion for choosing to live his life and utilizing his talents & wisdom to make social change in the way he knows how. That’s the POSITIVITY and type of story we need to start holding these larger news corps responsible for choosing to push aside in an effort to show only things relevant to whatever opinions they feel strongly about.

      It's a kind of spiky deal when trademarks are involved, you usually have much less of a chance to claim fair use when they pull in trademark law. Branding and logos are under trademark and considering the means he went through to produce the shoes, legally, it would stick enough. On top of that, they probably have some applicable defamation too. Shame though, this is a real neat idea, and corps need more fucking.

    I am blown away by Ari's mind. This man goes deep. The details in that shoe are amazing. What a statement. My father, heavy smoker, died of lung cancer. I totally get it.     This is everything that's wrong with this country in a nutshell. Creativity & artistry are being squashed by big corporations, some of which are killing the very people who buy their products. The "little guy (or gal)" doesn't stand a chance against these Goliaths. What happened to free speech & expression? How is this product slanderous or a form of plagiarism/infringement of Newport's ideas? It's a creative form of criticism & he has every right to make & sell them. At least he *should* in a truly free country where corporations weren't people.
    Fuck Big Tobacco. I can't think of a single other drug that can make its users have to talk through a hole in their neck. Not heroin, meth or crack even. My mom also smoked around oxygen tanks, except it was in the delivery room while she was going into labor with me. 3 packs a day for 21 years. Quitting is so incredibly difficult & most people fail several times. These corporate fascists are hurting society in more ways than one.
