LMAO! Its not against the law, because the show is a scripted docudrama with actors. None of the distilling is actual distilling. Its all colored water. No production of any kind kind have real liquor, booze of any kind on a set. It's not reality TV. As per the Virginia Department of Alcoholic Beverage Control, "If illegal activity was actually taking place, the Virginia ABC Bureau of Law Enforcement would have taken action." The Bureau requested the producers add a disclaimer to clarify that the show was only a scripted dramatization. Producers are not obligated, so they declined, as disclosing its 100% fake would probably kill the show. Still some people are gullible enough to believe actual moonshiners can go on TV, showing their faces, distilling on film, and not get busted. YIKES! 😂😂

However they don't believe they should admit it in a disclaimer on the show as requested. They do not want to disrupt the illusion, and the disillusions of those dull enough to believe they can actually film illegal activity and get away with it. No one would have to investigate anything, if it was real the show is all the evidence they need to convict.. Video evidence is regarded and holds as preponderance evidence leading to convictions in countless crimes and civil cases. They bill the show as a "Docudrama that dramatizes illegal production of moonshine." Do you honestly think the IRS would ignore a bunch of people brewing shine and not paying taxes? Of that the ATF given all the video evidence in a fu@king recorded TV show would not swoop in and arrest them all if they were brewing real alcohol? Every single agent in that jurisdictions would be out of work if they couldn't catch a bunch brewing on camera. Look up some words if your meathead mind is capable of it. Preponderance, Docudrama. Dramatize, Video evidence. While you are at it look up Travis McMichael, Gregory McMichael, William Bryan convicted on video evidence. Derek Chauvin, J. Alexander Kueng, Thomas Lane, Tou Thao, convicted on video evidence.

No state allows liquor on a film set, no production company allows liquor on a film set, no production company allows anyone on set who has been noticeably drinking, or is drunk. Workers compensation does not allow it, insurance companies will not cover them if there is an accident.

It's crazy to me that some people think that because the "Moonshiners" don't really break the law in this show, the liquor must be fake. Obviously the liquor isn't fake, the "fake" part is the idea that what they're doing is illegal. All the Moonshiners on the show have legal licenses to distill. So they're totally within their rights to make alcohol. Though I'm not certain if the sales of the alcohol are real, they're certainly making actual liquor.

I love that we're all aware its fake, yet still love the show. I think it does a great job of showing how moonshining is without actually doing anything illegal. They must have water running through the stills most times Id guess.

its not fake, 1.making moonshine isn't illegal, its only a problem because its untaxed liquor. 2. they have to be caught in the act, as tv shows are not evidence because, like you pointed out, it could be water running through the stills( a point the network's lawyers are sure to make). 3. as long as they aren't selling it to minors(which they aren't because they have too much to lose by doing so) its not really worth it for the police to arrest them, especially considering how famous they are, and how much backlash there would be. what could be fake is some of the "problems" that arise when making the moonshine.

The stills are real, everyone is licensed they just drum it up for the camera. They are licensed distillers it's perfectly legal.
These are easily the best people to watch.

@@snailcage wellllllll, no. Not quite. It would specifically be akin to selling some weed and bagging up a 1/8th on TV - they are just not worth pursuing. They're not on the radar. Now, if there is any investigation into their activities and it shows that they are meeting more than one client then this entire show would be used against them. They don't have to worry about it as long as they aren't getting rich off of it. Otherwise, this would certainly be documentation of conspiracy to produce and distribute illegal alcohol.
@@snailcage You also have to think about what the IRS would have to say if an investigation is started and it is found that they are making a good amount of money and not reporting it as income..... That is a whole different scenario that they don't want to be involved in, so I would HOPE that they have their tracks covered since they are doing the show....
@@josephtaylor-kennedy1420 Still wouldn’t be an issue for them as long as they don’t get caught in the act of selling it, as any lawyer worth anything would be able to show that there’s no way of proving that anything shown here is real. Even with weed you could film yourself handing a thousand pounds to somebody in exchange for cash and it still wouldn’t mean anything as long as you didn’t get caught because you could say it was hemp (they’ve done exactly that on this show, search “CBD moonshine” and the episode should come up), and even in the event that that were illegal, they would still have no way of actually showing that it was real weed being used. If they did get caught then the prosecutor could use this show against them in theory after the fact but they probably wouldn’t even bother doing that if they had confiscated the alcohol and they had caught them selling it.
