- Former president Jacob Zuma has won his bid against the Independent Electoral Commission of South Africa (IEC), making him eligible to contest the elections as a candidate for his uMkhonto weSizwe (MK) Party.
The electoral court gave the order in favour of Zuma on Tuesday after he approached the court to appeal a decision in which he was disqualified from standing for public office.
John Maytham interviews political analyst Khaya Sithole to get a better understanding of the ruling and what this means for the 2024 elections.

Constitutional Court shouldn't have involved itself in the case in the first place. What crime did Zuma commit, that the case was not tried in the lower courts but went directly to ConCourt bypassing all the other courts. You might dislike the outcome but it's so obvious for anyone else to see. Zuma was accused for corruption, which people keep talking. Before 1994 contracts were written for the next 100 years is what Zuma is hated on trying to cancel. Wait for it Zuma will expose who is really corrupt.
President Zuma was supposed to have appeared in front of the Zondo commission on charges of being complicit in State capture. He appeared earlier on during the hearings but then later refused to appear before Judge Zondo after lodging a complaint about J Zondo and asked him to recuse himself as he cited a conflict of interest based on a very personal matter that involved these two men. Judge Zondo then had no other option but to refer the matter to the Concourt where President Zuma was charged and sentenced to 15 months imprisonment without the option of a fine for contempt of court. After 3 months he was subsequently released on medical grounds by Arthur Fraser ( Correctional Services Minister)when he had no authority to do so. The Concourt then ordered him back to jail but then president Ramaphosa gave him a pardon. Now I am certain the latter regrets that generosity.

Sorry for answering in English, but I'm no good with Cyrillic. So, John was referring to Section 47 of the South African Constitution, which governs the rules around being a member of the SA Parliament.
As to the sentence Jacob Zuma originally received: it's a bit of a long story, but essentially Zuma was ordered by the courts to attend a government inquiry (looking into corruption allegations against government during primarily Zuma's time as president of SA). Zuma had attended the inquiry, but then left without notice or permission during a tea break. The head of inquiry subsequently charged Zuma with disobeying that court order which demanded that he attend. Zuma was therefore sentenced to 15 months in prison in 2021.
He was later granted medical parole, but the Supreme Court of Appeal (the court in South Africa that has the final say on a case) found that parole was granted illegally, so Zuma had to return to prison. The Supreme Court left it to the National Commissioner of Correctional Services to decide whether to add the months Zuma spent on "illegal parole" on to his 15 months, which the commissioner decided against, saying the parole still counted as a form of punishment. That meant he had three months left to still serve. On the day he went back to prison (11 August 2023) the Department of Correctional Services granted Zuma a special remission, which meant he essentially finished serving his sentence and was freed.

Probably helpful to read the Section in it's entirety to get a proper understanding of the legislation, avoid the unnecessary confusion, bizarre frenzy, and the need to mislead.
In fact, the "appeal" component of S.47 should compel shame and embarrassment on this nation and the justice system.
Mr. Zuma DID NOT even have an option to appeal the odd sentence. The Section has such details in mind you see.
He did not, because what is typically a court of last instance, the CC, was sadly manupulated on URGENCY, and used, wrongfully, as a court of first instance, stripping Mr. Zuma of his full constitutional rights, including the right to appeal. Everyone is entitled to that, incl, Mr..Zuma, no matter how exasperated you might be as he exercises his constitutionally enshrined and protected rights.
You would do the same too. Many would.
This is neither good nor a winning approach when wanting to uphold the now so famous, RULE OF LAW.
This I'm afraid was a travesty of justice indeed. Left many overwhelmed with sadness, distrust anger, disillusionment etc etc :-(

It's important to note that the statute NEVER, NEVER contemplated that what is not a crime would be crafted as a crime, for what appears to have been the illegal purpose of convicting and sentencing Mr. Zuma, when we all know he didn't commit a crime. This is so because, if he had, by now we would know all the salient details of the charge sheet. There never was a charge sheet as the esteemed counsel, Adv. Mpofu laid it bare in Court.
For the sake of the future its imperative that lady justice remain as blind as a bat ! It will be for our good, benefit and peace of mind.
If anything, this S. 47 does not fit Mr. Zuma's alleged contempt of court. Repeat: civil matter not criminal, thetefore civil remedies. This oitcome hete was an anomaly!

A disqualification under this paragraph ends five years after the sentence has been completed.”

The Bill of Rights is what counts. Section 19 is what matters. Section 47 is in conflict with the Bill of Rights (unconstitutional), therefore it must be referred to the ConCourt to be amended.

It has come to my attention that certain individuals purporting to be legal experts lack legitimate credentials. It is imperative that this matter be examined comprehensively, considering all relevant facets. President Zuma received exoneration from President Ramaphosa through the grant of remittal. The original sentence of 15 months was commuted to 2 months, thereby extinguishing the sentence. President Ramaphosa facilitated President Zuma's eligibility for inclusion on the Ballot. This decision is not subject to reversal.

Wrong interpretation of Sec47 which is for Parliament, Legislature, Municipal Council😢 IEC has no pwers here. There are 5 exclusions not only criminal record. That only applies after elections before swearing in of MPs, MPLs, Councilors. Eg ..government officials will be forced to resign their civil positions, legislature councilor positions before being MPs, etc, etc. IEC empowered on other aspects of qualifying election candidates.
