The defendant was giving him him way more time then what was in the contract. Then when plaintiff backed out and wanted his deposit back, that is nonrefundable, they gave him a credit to use with any other vehicle. The plaintiff just wanted his money bc he needed it.
For me, the thing about deposits is if something serious like life threatening happens soon after handing over, let's just say 1800 bucks. I'd rather save up the total amount make the purchase it's mine or my descendants if something were to happen
The defendant has no obligations to help the guy that just sued him, the guy will just make his life worse by still trying to get that deposit back, why try and make him work with the guy?
I've had a few people leave deposits on stuff and flake, then try to get their money back. In one case a guy asked for two weeks, at the end of that he still didn't have the money so he gave another deposit to give him another two weeks, then vanished. Several months later he called to try to get it back. Sometimes it's a hassle, but the extra money makes it worthwhile.
The defendant needs to make sure this loser of a plaintiff has his ducks in a row before he saves a second vehicle for him. This is a case of Seller Beware. Chump A Lump = Plaintiff
Karma doesn’t come into play here. They offered numerous extensions and offered to apply it to a different car. The plaintiff has to accept he can’t afford to buy a vehicle
No psychic and ignoring the prior comment...the plaintiff is out of gas. As is, be sure abt the purchase before handing over money and make sure you can afford. We have seen enough cases to know this outcome. Hope the plaintiff learned a lesson. Even if they promise to refund him, put it in writing!!
