- Nationals Senate Leader Bridget McKenzie discusses Independent Senator Lidia Thorpe “disavowing her oath” she made before the Senate.
The senator has been criticised after it was revealed she swore allegiance to Queen Elizabeth II’s “hairs” not “heirs” in her parliamentary oath.
Ms Thorpe has been accused of violating her pledge to the monarchy after she shouted “You are not our king” at King Charles III during his royal tour of Australia.
“This was less about a Senator behaving badly … but really disavowing her oath of allegiance that we all have to make before we can take up our seat in the Senate," Ms McKenzie said.
“There is a serious constitutional question.”

Yep, I wrote to Sky News over a year ago saying she should be charged under the Commonwealth Crimes Act for “Obtaining a Financial Benefit By Deception.” Financial benefit being her enormous salary, the deception being her lie to her constituents at the polling booths that she would represent their interests, and her falsely giving an oath that she never had any intention of keeping.

I’ve been saying for ages that she is in breach of her oath. The oath and affirmation found in the schedule to the Commonwealth of Australia Constitution Act 1901 (Cth) are a part of the Constitution. As such, they are just as binding at law as the rest of the Constitution.
It would help if the Governor General enforced the keeping of oaths and affirmations. I guess validly issued letters patent is an issue there.... but nobody wants to talk about that

When taking an oath the person has no option to change the wording of "The Oath". To swear an oath that is worded differently to required oath of office is to have failed or refused to take the required oath and therefore because she has NOT taken the required oath of office she should not or cannot take or hold the office. The value of the oath is not set by whether the country is at war or not it is as it is simply a legal requirement for the office. Our defence forces, police, and all governments are sworn under oath which is legally binding, (AS WRITTEN), regardless of the volume of the spoken word or any muttered alternate wording.
The senator was given a card on which the required oath was printed and the words on the card were what was required for the oath, (no facsimile or alternative wording allowed or accepted). The oath as written is the required oath of office and if the oath taken was different it simply means that the person did not undertake the swearing of the required oath and therefore has NO RIGHT to occupy the office. A simple matter of law!
This fact has no possible cultural or racial variations as it is a simple legal principle. Perjury is taking an oath to tell the truth in a court of law and failing to keep the oath. Jail is the possible punishment in a court of law if the oath is breached, (the same as for most other CRIMINAL OFFENCES), and the principle of oath taking is foundational to ALL CIVILISED countries and nations. Her failure to take the required oath of office shows a total lack of civilised values in her beliefs and makes her appear as a person of no morals or respect similar to a terrorist or worse, (most terrorist organisations do require the swearing of some form of oath).. There is no case to argue in her defense as there can be no negotiation with terrorism in any form! Actually a terrorist's word is of higher value than her word has been proven to be.
She will not resign because she has no respect for the people of Australia or our nation, (regardless of our races or cultural values), and she is self serving with low values of morality and human decency. She is not and should not be a representative of the country or its people in any form. Put the matter to the government and let the AUSTRALIAN people judge each and every politician on their vote about this foundational question for the respect of law and the constitution.
Now you can see the sort of result Australia would have obtained if the voice referendum had been upheld. No respect for the constitution, law or even common human decency! Personally I would like to see her jailed for either failing to take the required oath or for illegally masquerading as a sworn member of the Australian government and thereby defrauding the commonwealth of the monies she received during her deception. She does not have the required moral values, she dishonours the constitution and is not a sworn member of the government. The people of Australia and the world are watching and will judge if our constitution is actually worth anything!

On becoming a senator you are required to swear an oath of allegiance to the crown. That is tantamount to entering into a contract between the senator, the Australian people and the crown. She took that oath albeit with unbounded cynicism. There may be no mechanism in the constitution to sack her but what she did was to repudiate that contract and her position is untenable.
Thorpe's pretence that it is all about Heir versus hair is disingenuous, because she gave an oath of allegiance to the Queen's "heirs AND successors".
