Unironically I don’t think Mr Beast will sue, since it opens up all of Mr Beast financial and business communications with current and prior employees of his company. And every single time a shady business tries to sue for defamation, they almost immediately settle after some very convenient leaks that were opened up from them trying to sue. The Fox and Dominion case was hilarious to read through, largest settlement and they got counter sued right after 😂

The thing with defamation in the US is that if the information you state is true, and proven to be true, it can’t be charged as defamation. So in order to actually sue for defamation, Mr Beast risks coming clean about all of those things. And considering that some of that activity is illegal on Mr Beast’s part, it wouldn’t be protected by an NDA.
I just found out from the US Government website that I quote "Lotteries are illegal, except when conducted by states and certain exempt charitable organizations". Beast Philanthropy was lunched in Sep 2020 and the 40M signing shirts live stream was in Sep 2020.

@Exbozz In the UK it works the same, truth is an absolute defence against defamation. Otherwise, you could be sued for saying something true about someone that happens to make them look bad.

They both were a part of the "effective altruism" movement, which is basically making as much money as possible to give to charity/give back as much as possible. A reasonable form of this would be a lawyer donating half their salary to charities while living a comfortable, but less luxurious life because of their high paying job. But both Sam and Mr. Beast took things way too far and convinced themselves that the ends (supposedly altruism) justifies the means (scamming and exploiting people). They lost the plot.

Literally Scare-Tactics 101. My previous employer was involved in all sorts of illegal things regarding harassment and on-site innappropriate work behavior, and she consistently would tell me, "Remember, you signed an NDA." And I'd call her out every time saying, "If the actions are illegal, the NDA doesn't apply." And she'd always shut up after that.

If you accuse someone or a company after working there for only a month and you signed an nda, and you can't PROVE a criime has been commited, the, you're sht out of luck: basically : you F.d up. Also, MrBeast's youtube and affiliates is Wayyyyyyy worth more then 1 billion dollarS. think 10x that much and you'll get in the vicinity of the ad revenue and money it brings in.

You don't know how discovery works do you? A request for discovery is not a fishing expedition. They are only required to provide documents or evidence directly related to the case. The discovery would be limited to items that directly pertain to any suit. The only way the court would know the documents exist is if a party presents the documents or provides evidence that the documents exist and haven't been turned over.
It's not a criminal trial. The FBI doesn't bust down the doors and rifle through their filing cabinets and devices.
Stick to talking about things you understand.

He didn't say every document that Mr Beast has, he says the amount of documents he would get, which can be true within the rules of discovery, given that he will most likely get data on things like the competitions (like who was in the competitions that was accused of faking and who won how much from it) and records of who won how much from the shirt signing streams. Not to mention the amount of testimonies that could be brought out.
The whole thing would be showing off too much of the workings of the company that they would rather be kept private and the whole thing would probably cause more harm than good unless they can prove that everything that Dogpack was saying (including pretty cut and dry things like what he showed of rigging) was malicious lies. If they go ahead with the lawsuit, it would take the mask off of the happy friendly Mr Beast persona that is a big part of where he is today.

With how savvy MrBeast is with UA-cam and internet culture, it is genuinely shocking to me that he is responding to this controversy in the worst way possible.
The only explanations I can think of are:
1. He's not as savvy as we thought.
OR
2. He's guilty of even more than we thought.
Or 3. He's actually innocent, but due to his fanbase, Beast can't be straightforward.
Why I think this? Simple. Why hasn't Dogpack404 filed a suit himself, or hired a PI to do proper investigation?

1:58 NDA can stop from some of that but what it can't stop you from is entering in protection of the *Whistle Blower Protection Act* - if a company is misleading, doing something illegal or unlawful he can protect himself with it if he can prove his claims.

Mrbeast and his team suing Dogpack for defamation or something is literally the most brain-dead, potentially suicidal move they could possibly make. The moment any actual litigation is filed, Dogpack would be legally entitled to engage in "discovery" where his lawyer can demand any relevant documents from MrBeast's team be provided, which would result in one of two things, all of MrBeasts dirty laundry being documented in court (best case a PR nightmare), OR MrBeast and his team FACING MASSIVE SANCTIONS FOR HAVING ALREADY DELETED (DESTROYED) EVIDENCE THAT THEY KNEW WOULD BE RELEVANT TO THE PENDING LITIGATION (That's a felony in most states!). So all Dogpack would need to do for example is request a full copy of the livestream with the fake signatures (that MrBeast team already took down) and if they didn't preserve a copy of it before deleting it, then they would have to admit to the court that they deleted it knowing it was evidence that could be used against them, and at that point they're fucked!

He's certainly taking a huge risk. He may end up destitute because of lawsuits. I hope he's got some money saved up if he wants to try to outlast lawyers. Hopefully he's taken some lessons from vexatious litigants if he plans go to pro-se because very few individuals can afford a single lawsuit already. He may think the law is on his side since he is very young and not realizing how the weight of a corporation can crush you through litigation. He may also think a lawyer will take his case pro-bono which is extremely unlikely.

1:33 - Asmon has it wrong here. Dogpack has stated all the information in his video is public knowledge - available to people outside of the company. He also reviewed the video with his lawyers prior to uploading.

It doesn't have to do with "regular citizen". It has to do with impact to reputation and your standard of living. Most of the time a "regular citizen" simply doesn't have the clout to convince anyone, and therefore the damage is not substantial.

For someone who is potentially facing criminal charges of running an unlicensed lottery or violating various sweepstakes and other competition laws I think its very foolish for him or his team to try and remove or intimidate anyone related to calling it out. In court a judge will not look kindly to destruction of evidence of attempts of perverting the course of justice. This is not normal youtube drama its hits the law and the law hits back harder.

I'm surprised no one mentions what is probably the real reason for the Cease and Desist. Of course he knows this info never gets back into the bottle, but with this action of his lawyers he wants to intimidate other possible whistleblowers. So far it's only one guy that worked for 4 weeks for him. But usually when the dam is broken, other former or current employees may come forward. The message to them is, we will sue everyone that wants to leek something. This could work. The guy doesn't have anything more and it will be forgotten by the internet in 2-6 months. but when more people, maybe even with evidence of worse things come forward, they could get in real trouble.

Not a lawyer, but we work in LawTech and are often dealing with these kind of situations when lobbying against corruption or abuses in Romania. It's legal to voice your opinion as long as you don't mislabel it as fact. Somebody that is shown to have fraudulous behaviour is, by standard definitions, would be called a "Fraud". Ask 100 people on the street, they will likely say you can call him a fraud.
If he's acting subjective, that's allowed. So that doesn't cover it. In my opinion the situation is likely more complex but it's clear that the problems voiced are legitimate.
