sony are completely shooting themselves in the foot with that policy or short samples. I've gone and bought lots of albums from listening to the avalanches, daft punk etc.. for artists that i would probably never have found/bought such as Camp Lo and George Duke. Music is now on 3rd or 4th generation sampling - take for example 'sparkling' that features on the original avalanches album, the music from that was sampled from some old Vibe player
The industry is way behind the times and they're trying to get the international courts to hold up until they get new laws in place. Sorry, but you don't stop the net.
