You're allowed to stop people from suicide, right? If I tried to kill myself and they got to me before I could, I would be taken (probably against my will) to a pshyciatric service where I wouldn't be allowed to leave until my doctors signed off on me. I don't understand why they can't just do the same to the patient here.

He is calm, gentle, and empathetic and let's them make the choice, whether they know it or not, to save themselves.

Dr Charles speaks to Meadow on the premise of respecting her wish not be treated. She's taken thallium;a highly toxic substances as a protest against climate change and was dying.
Offering her pain relief and sedatives to ease the transition is called 'end of life' care. Meadow consented to that, but not life saving treatment to stop the poison, to do that without consent,would need a court order.
But to sue she need to step up and admit she wanted the sleeping pills
But Charles is arguing that once she is in a coma from the pills then she is not able to give or refuse consent. So if her condition worsens when she's under then the doctors can do what they like to save her
So she wants to kill herself like her friends in protest of climate change? Hey who says crazy can't solve its own problems...
Remember, this is the Chicagoverse, where physicians get away with ignoring or dubiously circumventing patients' rights _all the freaking time,_ not the real world where careers are ruined and lawyers make stacks of cash over such shenanigans.

It's not implied consent if they KNOW the patient won't consent.
Unfortunately, that's not necessarily true. In emergency situations, unless there is a legal document stating otherwise (ex: DNR), medical professionals are permitted and sometimes obligated to treat. Again, I say emergency situations. This situation does not apply, I am aware, I am speaking more generally about emergencies.

Implied consent means that the patient is incapacitated before being able to state their wishes so the medical staff acts in good faith to do what they think is best.
You can't just drug a patient everytime you didn't like their choice. That's assault. 😂😂😂😂
It is worth noting that once someone commits self harm, generally speaking, they're not considered able to consent for themselves. They want to die so of course they don't want to consent to having their stomache pumped...or take that pill that will save their life, etc. It's not unusual for them to refuse. But suicide is illegal, so... they are put on 72 hour hold and Doctors make the decisions.
I took a CPR - chocking class and it’s that because they’re unconscious you can make the medical decision as they can’t. The court will defend you in that as long as you know what you’re doing and had good intentions in mind.

What you're saying is correct as far as encountering an unconscious person, having no other information. The patient wasn't able tell you what they want before falling unconscious, so it's reasonable to assume they want you to attempt to save their life. This is called "implied consent."
In this case, the patient clearly stated their wishes, so implied consent does not apply.

@@alllifeisasong Good to see you in these comments!! So often I see comments from medical professionals agreeing with the dodgy things they do. Like no, you're right, it literally is assault. And she would be able to sue them. Especially because implied consent mostly works off the principle of not knowing what they want to do and doing what is best because I'm most cases you would assume that they would want to do what is best. But in this case they know that they were doing something she actively stated multiple times that she didn't want to do. So they very actively did not have implied consent.

Book Butterfly it already happens, especially in hospic patients, both my grandfather and uncle were suffering from horrible medical conditions so the family made the decision to help them pass pain free, although it was towards the end of their lives rather than when they still had the mental capacity to make the call themselves
The difference is stopping medicine that's keeping people alive vs giving medicine to kill people. Most of doctors have to swear the hypocrstic oath not to kill patients, this is also why there's usually no doctor present at government sanctioned killings.

Well this is morally horrible. ffs. The woman legally denied the meds in the first place and the second she regains consciousness she can sue them. Removing her ability to consent does not suddenly give them the power to over rule her previous refusal.
This is a tricky situation because of the 'implied consent' loophole a lot of lawyers use to get their clients out of trouble. Lawyers for the doctor could argue that the woman gave implied consent. If they can prove that was indeed the case, then the case can get thrown out.
I see this as one of those lawsuits that can swing both ways: all depending on who has the better lawyer.

As someone who has survived institutional abuse and neglect the fact that Dr. Charles decided to trick his patient into being incapacitated makes me sick. I understand why he's doing it but being tricked into taking a sedative in the hospital is the reason why I can't be sedated at the dentist's office. Yup, PTSD.

Its a bit annoying how they never really tell stories to the end. I watched this episode for this storyline and then didnt even finish the story? They left it at exactly this point. They gave her 2 doses of medicine, but she will need a lot more of them and will probably continue to refuse. Thats it. They always stop the stories before they come to a satisfying end.

A lot of times when people commit suicide, they have a family that does in fact love and support them. But they had no idea their loved one was having emotional and mental issues because they didn't tell them. That's especially true with bully victims; mothers and fathers are forced to bury their children. Because they hanged themselves because they were being harassed at school and the teachers weren't helping them.
Of course what do I expect from someone who supports the genocide of an entire nation and it's people. Something Creative it’s a feeding tube.. breathing tubes go into the mouth
A psychiatrist is a licensed physician whose specialty is psychiatry. That physician went to medical school, completed a residency, then completed a fellowship (kind of like a second residency pertaining to the specialty) in psychiatry.
They're many times confused with psychologists, who are practitioners of therapy, sometimes with a doctorate. They are not medical practitioners.
So, yes, a psychiatrist can legally take out a breathing tube (although in this case it's a feeding tube if memory serves me). However, generally speaking, psychiatrists have done only limited procedures since residency many years prior to practicing psychiatry. So, generally speaking, it would not be a function that a psychiatrist would do. They would ask the medical professionals who are more practiced at that procedure to do it.

@@alllifeisasong Thank you very much, that was very informative. I knew phychitrists are doctors and could prescribe medication and gives diagnosis vs phycologists who can not. I just didnt realize they where licensed to practice anything that wasnt specifically mental health related.
(I'm also still back on season 1 with watching the full episodes so I dont know a lot about Dr Charles outside of clips on youtube. so I haven't seen him do much outside of mental health related things.
in regards to the feeding tube vs breathing tube, I just noticed him removing a tube and was confused so I said the first thing that popped into my mind.. probably completely forgot feeding tubes were a thing in the moment.)
@@harrypottersnumbrfan it's a great show, one of my favorites! But it's not very realistic at times, lol. They minimize the RN's role and support staff is virtually non-existent (I realize this is likely because they don't have an endless budget for ancillary cast and also, reality of doctors delegating everything to support staff is less dramatic), so the doctors in the show do things that Doctors would never do, like transport patients and sit in the CT room reading the scan in real time as it's done. In reality, there's a giant team of multidisciplinary staff that keep the hospital running, of course. :)

Yes. I don't really know why they're overcomplicating this (beyond the obvious that its a tv show and they need drama). She took poison, directly admitted to it, and admitted to wanting to die. They can absolutely treat her without her consent the same way they would for any other person who took a harmful substance to end their life.
