Always Review Your Chapter 13 Budget Prior to Your Meeting of Creditors Hearing

  • You can avoid problems at your #Chapter13bankruptcy meeting of creditors by carefully reviewing the budget that your attorney filed on your behalf.
    As I discuss in this video, your household budget can be found at Schedule I and J of your bankruptcy petition. This budget sets out how much income is coming in to your household and how much in expenses is going out.
    You want to avoid the situation of not being able to explain a line item in your filed budget.
    Given that you may have created your budget 2 or 3 months prior to your hearing, and your spouse or others in your home may have had input, you should not rely on memory or guesses.
    In this video I relate the story of a woman who could not explain several budget items that related to her non-filing husband’s relatives and business affairs. In that case, the trustee will file an objection and the debtor may end up paying more every month.
    You are allowed to bring a copy of your budget and the rest of your Chapter 13 paperwork to your Section 341 meeting of creditors and you should do so. #atlantabankruptcy #atlantachapter13 #meetingofcreditorshearing #preparefor341hearing
