  • In this video "FILMING LAWS IN PORTUGAL - WHAT DID THE LAWYER SAY" i retry my visit to the lawyer.. this time i succeed en get a lot of information. But Portugal has a problem with its legal system. Basically they are way behind on there laws for modern day content making.

    Well Jasper, I made this assumption in a comment on one of the previous videos, about not publishing, editing and posting on your channel images taken with your surveillance cameras that cover public roads. From what you explained, yes, this may be one of the aspects that needs to be reconsidered. I'm glad I went to get the information, even if it's still pending. Carina is certainly a great diplomat and her meeting with local authorities is of great value. One idea is to keep dogs within the boundaries of your property, properly fenced. Regarding construction materials, etc., in several countries it is not allowed, including where I am, what is allowed here is to rent a proportional container that is on the public sidewalk but without affecting the passerby.

      Anyway, each place has its own rules, avoiding spending on fines is great, they can generate resources for your projects. I must tell you that not all people have a sense of humor, and they interpret your smile as if you were mocking. Maybe it's a characteristic of slight "sarcasm" / "irony" that is bothering some people, I don't know... that's my interpretation after reading some comments and their responses to people. We are all on the planet in acidic, difficult and highly polarized times, and perhaps it is better to let ourselves be enveloped by the form of peace and love as we have to preserve our goals, our mental health and live peacefully. Being peaceful does not mean, for me, being "passive", that is, we need to find the best balance so that we are not harmed, as we often are, by not embracing "good neighbor" policies. Do your excellent work as always and adapt to the location, things take time to be resolved/resolved and you need to come and go, be aware of the formalities that are original to where you are. Everything will be fine. Avoiding responding to comments from "acidic" and bitter people who want to drag you into an argument is also a path to wisdom. I wish you health, peace and prosperity.     The laws in Portugal are very similar to the rules in Germany, so I would say it is pretty much European law. Your examples from UK do not fit, as the UK is no longer part of the EU.

    Be careful. Driving while being distracted by phone camera or whatever, maybe against the law as it would be classed as dangerous driving.

      I think that in all European countries you can’t use your phone whilst driving that is dangerous driving but filming from a camera in the car you have to abide by the laws in Portugal. Here in Italy you must have permission from the people you film. You must abide with the laws of the country where you live otherwise you change country. As an immigrant we should RESPECT the laws of the country as NOBODY made you live here. There is NO reason to create animosity where you are living just so that you can live in peace too. I know it’s a pain in the ASS and I understand you as I’m a Brit living in Italy for the past 55 years and it’s not easy when you don’t know the rules. Just laugh it all off.

    My brother, there is lots of foreigners doing videos and they might be able to help you. Holding a camera in one hand and drive with other might not go very well with the local cops

    Hey Jasper, have you thought about a small camera on the window sill of your apartment, unobtrusive and private, to monitor who is coming to your property. You don’t need to broadcast the footage, but outside it would be very difficult indeed to see something sitting inside the window.

    I’ve been I Portugal for 20 years , my view we came here of our own accord so we need to respect the laws and as of he country that allows us to be here. I see you position b in my experience. The more you push the more they will dig their heals in and keep visiting you. Let it go buddy pay the fine and get on with your life. Best of luck for the future

      @@GhostTownDaily there’s always a fine here my friend lol. we at first got a fine for a ridiculous amount for work we did on our land to divert water to our fields. We offered them the minimum of 500 euro,s which was way below there original amount they excepted it. The 500 we paid was way way below what we would have paid a solicitor to prove our inoccence lol # Portugal life.

    Finally, I can stop repeating the same comments over and over about cctv and about filming in public in Portugal... Jasper, I'm so happy that you were able to meet with your laywer this time and get this sorted out (as much as it can possible be). I was growing worried that you'd heed some of the ridiculous advices written here over the past days.

      And going to more detailed stuff now:
      1) "Europe" isn't a homogenous body of law. In Germany is way worse (stricter filming/publishing laws) than Portugal, while in England (not EU) is fair game. And you have to understand one thing, in Portugal filming in public and publishing it isn't only about the expectation of privacy (or even it is hardly about that), it is also about ones image rights. CCTV, on the other hand, it's about private data and expectation of privacy, yes.
      2) Glad Zoe is categorized as mixed and so she skips the potentially dangerous dogs category, it saves you the trouble of having to do (and pass) the mandatory training. And yeah, it depends on the Junta, rural areas will have you register, urban areas not so much. I live in a rural area and my dogs are registered in the Junta (and it's mandatory), whilst my brother's dogs it's the same situation as Carina, he lives in an urban area and went to the Junta and they said there's no need there. Guess it has more to do with tallying the dogs in an area and the risk of them running astray. But when it comes to potential dangerous breeds or dangerous dogs you do have to register regardless if it's urban or rural (and the difference between the two it's as you said, potencial dangerous breeds is a list of breeds that are considered potentially dangerous, while dangerous dogs are dogs that have effectively bitten someone or same animal, caused damage, killed animals, etc., regardless if they are on the list or not).
      3) Yeah, I told you that might happen, regarding the public roads. If you weren't so "public exposed", if it had been me, I would still try to open a procedure with the Camara to do the road works. Sometimes they let it slide, forgoing the "coima" and the "repair cost" when we still go thru the proper process, because believe it or not but the "bureaucrats" also hate all the bureaucracy.
      4) Being assertive is neither being confrontational nor sheepishly, it's being the proper measure. Cops, at least in Portugal, don't want to have you jumping hoops, at least not anymore (it was a very different thing when I was a kid, specially with GNR, we had all sort of jokes showcasing GNR insidiousness). You don't need to be antagonizing to stand your ground in Portugal.

      Regarding the number 3, to showcase how bureaucracy averted the bureaucrats are (and they themselves prefer the path of least resistance), here's a story/joke we tell in Portugal:
      One day a man decides to open the wall in the living room to place a window. A few years in, he comes to know that he shouldn't have placed a window without proper authorization and could get in trouble, so he tries to do things proper and opens a process to legalize the window.
      The process is promply rejected with the argument that the building was bult that way and can't have a window there... after much thought, resigning from the idea of having the window there, he decides to start a process to remove the window so to return the legality of it all, which is rejected with the argument that the building was bult that way and can't have the window removed.
      So the man kept this last process as proof that the window was legal and couldn't be taken out and he couldn't be fined for it.

    Dear Jasper,
    I’m so glad you know yours rights and now can "fight" back in case of any more troubles through your lawyer. I know is an expense you didn’t need if only the police has been nice and explained properly what was going on and gave you time to sort things as you’re doing now. So for the police that I’m sure is reading our comments: bugger off! Go do your job somewhere else as Jasper has a lawyer now and can sue you for harassment!
    So let’s go back to normal life now and carry on your beautiful journey in ghost town! ❤

    We live here in europe, the laws are everywhere the same.
    There are so many cases done about this already... But there are always some governments that think they don't have to follow these rules.
    I can tell them... that's not how it works😂

    Well then it’s up to you to make a presentation showing your UA-cam channel , from the start of your house to now, others who have came from Britain to Portugal who are doing the same thing, show that it’s providing a way to help Portugal, and a teaching lesson. We do that in America that’s how laws and amendments get made although we have congressman who can help us, give it a try

    I was a cop for more than 40 years in the Netherlands. My advice: don't try to outsmart the cops. It will become a game of honour for them. There our thousands of rules (in every country) you have never heard of, but they will use this rules if they can not find anything else. Just be polite, thank them for doing there job and shake hands. Take your loss. After that, they will forget about you. If you keep batteling they will do also. It will only heart you and not them. (Excuses for bad English)

    Jasper, in het geval dat je werkelijk in de problemen komt is er een mogelijkheid om bij de Europese comissie om hulp te vragen. Dit is bedoeld voor europese burgers die in een ander europees land wonen dan hun oorspronkelijke en in de problemen komen met een onderdeel of dienst van de overheid in hun huidige verblijfplaats. Je moet er wel rekening mee houden dat je dan op behoorlijk wat tenen gaat staan omdat er dan hiërarchisch van boven naar beneden wordt gecommuniceerd, als je begrijpt wat ik bedoel. Niet voor wissewasjes dus 😊

    If Portugal are part of the EU, they do have to harmonise some of the laws however the problem is it takes a long time. I also think that some of the judiciary are conflating 'filming' as in a production with all stage crews etc with social media type filming. Their interpretation of the EU Regulation - GDPR is a little skewed - Even the UK who left the EU has adopted the GDPR rules and introduced them as legislation under the Data Protection Act.
    Challenging the status quo and increasing awareness is the way forward but it may be painful for a lot.
    Just seen you mention Charles Veitch - Check out Auditing Britain also - these guys are doing a great job of teaching public officials and others about the laws on filming in public.

    I left Portugal because it is behind the times in many ways and I think the older generation that runs the country don't like to change with the times. The authorities are like grandfathers. Maybe that is why many of the young people are leaving the country.

    Gosh! No wonder people are exiting Portugal. The authorities seem unfriendly and the laws behind the times. That’s just what I’ve been told by friends who lived there and friends who were from there. I hope I don’t offend the Portuguese, sorry

    It is good u went to talk to ur lawyer and get her professional advice. If Portugal is not applying EU directives thereare specific mechanisms to challenge the authorities and redress the situation. Am very happy that you took action to make sure that ur animal's situation is iron clad and no one can take action against them. Anyone trying to harm or take action against an animal i have would drive me ballistic and nasty. Basic thing is don't pick a confrontation but be informed of what u can and cannot do within the frame of the law. Judges don't have as much latitude to make or interpret the law as in co.mon law systems. Even to interpret or address for gaps of the law, judges have to follow very well spelt out rules. Privacy laws in Portugal are defined. From what u said it seems to me that you need a specific objection from someone to ur filming being published. If no one objects u have a tacit approval. U still need to put signals in ur property that u have camera surveillance. If someone reported u to the GNR u have to be careful not to supply material to the GNR to document that complaint and build a case against you. So far even if a cisit by the police is u unpleasant, they did inform u first of ur alledged infractions and asked u to rectify them. Of course in the process they spewed some nonsense about "dangerous dog". But at least u used that to close loopholes. Am surprised they transferred so many municipality tasks to the Freguesias. Then again they need to justify their existence, so why not add more competencies...

    Well, what was my first impression, is right. Someone near you, or among your viewers, claimed for the cars, the dogs, the cameras, you, but I really believe, as you are Dutch, with lots of friends and easy laugh, they will arrange a way to check all about you.

    All the complaints are a "fait divers"! Someone accused you of something else, and they are arranging their way in. Who else is living at the village, there apart from your friend Maria?
    Maybe even is no neigbour, but it can be someone that watches your videos and sees things no one else sees....😅😅😅😅 I hope you understand what I tried to tell you. Maybe your lawyer is right, keep calm. You know, we have a saying, "quem não deve, não teme"... I live in Cascais, here we have to have the dogs registered in Junta de Freguesia, and at the moment you do the registration, you have to have the dogs vacinated to "raiva " is compulsory.The registration is five € yearly. Duarte's momy, has to pass the ownership from her to you. Simple to do, on Sciac, I believe there is a "minuta"/layout, where she passes the dog to your name. The change of owner name, has no costs!
    There are lots of people filming even with drones, it's forbidden. I know someone paid a fee for filming Cascais and passed over Hotels and private houses, he had a hard trial and paid large thousands as fee. Plus, he had to close all sites where the filming were.

      If this were done where I live, there would no longer be a need for the government to charge other taxes 🤣, all taxes would originate from filming avenues, whether with cameras or aerial landscapes with drones, etc. Even large farms are monitored by drones, this has reduced the cost of people carrying out security work in these places. The only thing that is highly restricted is in relation to data, the data protection law prevents the disclosure of data, etc. and the faces of "suspects" of "crimes" on television, Instagram, etc. (social media). However, television and other media can publish aerial images, yes, results of weather situations, floods, homeless people, etc. etc. So, wherever it is, there are rules, but some can publish photos, footage of popular parties, fairs, etc., bathhouses and others cannot publish anything.     Some tips ; Never eber get in the way of the GPR the hit first and than maybe when you can talk .

    This law with the dogs doesn't apply everywhere. In Olhao i saw 2 dogs being kept on a rooftop for 24 hours a day. Never leaving for a walk, to go shit anything. Also, the people let their dogs shit all over the streets, even in front of the homes main door. These laws seem to be made up as they go along? Your dogs are loved, walked, fed, watered. They seem to be pleasant and friendly. Holy shit i would be pissed off if they picked on my dogs. The video from Albuferia shouldn't count as that city is pure bedlem. 😂😂😂

    What about the Ring doorbells? Not a thing in Portugal? (en vertel mij wat over één Europa: vanaf welk gewicht heeft een aanhanger een eigen kenteken nodig in Nederland? Iets van 700 kilo ofzo toch? Nu Portugal... hier moet je al vanaf 300 kilo een eigen kenteken. Dat verklaart dus waarom je hier alleen van die k*tterige kleine aanhangertjes hebt eigenlijk)

    Just as an example, one of these days, in a broadcasting for the fires, it was mentioned several times, that there are thousands of foreign people living illegaly in tents, caravans, barns, and so on, and that will have to be checked, as this people can be causing fires, due to use of forbidden machinery in some days they can't use, for risk of fires. That, as I understood, was due to claims, some people did, years ago and only now will start to be checked for. The regions mentioned, were all where there are offgrid properties.
    This to tell you that, it might not be a recent thing, it can have years, and as people can understand other thing from what you show, you never know. It's not the people, they like to have company and things cleaned and arranged. Look elsewhere. Your lawyer can try to know. I was informed my neighbour made a claim against me for feeding cats and pidgeons. And I arrived there. Do the same , ask who was and why. Good luck.

    You are just being picked on because you are a foreigner. The people are very spiteful and jealous here. They envy their neighbours their family and anyone who might do better one day.
    So many neglected and mistreated dogs and dogs ruining around in the village everywhere. I had to force the GNR to rescue a dog i found living in disgusting conditions no water or food, left to die in a hole. They didnt charge the owner because they are friends. I took the dog snd tried my best to help him but had to have him euthanized as he was too far gone. So f sad. They neglect their livestock. They are years behind in values and morals and reality. It is the country we chose to come live in. Doesnt mean we need to lower our standards to theirs.
    Someone is obviously very jealous of you and wants to cause problems.
    Filming in public.....before i came here i watched vidoes of people walking the streets and beaches...filmed in public and seen people's faces even breasts on the beach. Yes their so called laws are made up willy nilly and depends who you are. Similar to mexico. 😅
    Just keep doing what you are doing and maybe consider inviting the police in for coffee next time. Try to make friends with them. I know in mexico bribes were good. Juat saying..

      @@GhostTownDaily I am Portuguese and know exactly what you are talking about. It is not about making fun but its about trying to make a positive change. We should welcome people like Jasper reviving abandoned towns like this, spending money and hard labour and when he starts getting somewhere people who are jealous try to put obstacles in his way. Let him be as long as he is not bothering anyone. Ask Maria and the other neighbours in the area if they are upset with him.
