It seems to me, from how you describe this - a little hard to follow because of all your subpoints - that NGN suspect Harry learned about the phonehacking through illigitimate sources, and they are fishing for the identity of that or source, or those sources. If the court in a case of alleged phonehacking would give the party alleged to be behind that phonehacking access to the other party's laptop or digital records, that in itself I would find shocking. For something like that to be warranted the expected findings should have to a lot more significant than proof of date of knowledge. They could also call the author in question as a witness, and ask him under oath about what Harry told him in e-mails that was related to the alleged hacking. Lady Fortune is meant to be fair. That she is not if one party is allowed a fishing expedition into the other party's digital records in a civil case. Unless Harry is suspected of a very serious crime which provide such access for law enforcement, this shouldn't even be an issue. Protection of privacy, trumphs a civil case - especially when it could be used to undermine that party's right to justice. If forinstance NGN found something in the e-mails in question that was not related to their case, but embarrassing enough for Harry for him to drop the suit if that guaranteed it wouldn't be published.
I am surprised the judge even allowed a hearing on this, to be honest. Had I been on the bench I would have dismissed it outright. A party doesn't get to look the other party in the cards, in a civil matter. That is just how it has to be for the proceedings to be fair and unbiased. If NGN believes Harry has done something wrong, they have to provide proof of that - not ask for permission to a fishing expedition into Harry's digital records hoping to find such proof.

Harry was offered a settlement, like William, and could have taken it and poured it into Invictus again like William which would have prevented this latest challenge/intrusion. Even IF Harry gets a win and a settlement, he will have spent a great deal of money getting there which, in my opinion, is wasted as I don't believe Harry's legal team needs the money as much as Invictus does.
By the way, IF Harry DID know before the statute of limitations, then I don't think it would be fair for him to get a win/payment when others equally harmed can't.
