CRB Eligibility Verification, Repayments, Violations, and Penalties in 2021 [What Can the CRA Do?]

  • In this video I explain the CRA's powers in terms of investigating your eligibility for the CRB, including their ability to require you to provide any document or information, and to reconsider your application up to 6 years (72 months) after you receive your benefit payment.
    Even though the CRA has this long time window to reconsider your eligibility on the CRB cheques that you have received, in all likelihood it will only really need to use 1 or 2 years, because it is waiting for your tax information like T4s to be filed, which will come into their system in the following year when you file your tax return (for 2020 you file in 2021, for 2021 you will file in 2022).
    I also discuss your right to have the CRA's (Canada Revenue Agency's) reconsideration of your eligibility reviewed (which you must request within 30 days of them providing you notice of their decision) and your onus in this review process to prove that you do meet the necessary requirements for a valid CRB applicant.
    Aside from repayments of the CRB (Canada Recovery Benefit) on ineligibility, I talk about how the CRA can determine violations of the CRB Law (Canada Recovery Benefits Act), and make you pay penalties on the basis of those violations. I also briefly cover the most serious consequence of breaking the CRB law, which are the criminal offences relating to this benefit and can result in a maximum sentence of imprisonment.
