That's not really true. Judges are meant to be guided by statute and expert testimony not their own preconceptions. The question though, is currently the litmus test for political affiliation. We know the left think everyone is a woman, if they say so. other than women, who should be described differently, so as not to upset everyone else who want to be one. or not, as the case might be.

Selection by immutable physical characteristics as Joe Biden declared before selection automatically disqualified 94% of the population by demographics. Simply looking at the representation compared to the nation as a whole in almost every circumstance where it is complained about there is already over representation often of minorities as you would only need 1 black female out of twenty employees to be representative of the existing population that could actually be working. There is even issue with this expectation though as any business or place of employment can only hire from the existing surround population and given that much of the minority groups have self segregated into communities the existing local of potential employee racial identities is not distributed evenly at that 12% for most of the country and is highly concentrated to a few regions around the country. About a quarter of voting members (23%) of the U.S. House of Representatives and Senate are racial or ethnic minorities, most of those are black. This shows over representation based on the existing potential population that could possibly be selected to work in government.
Not that any of that matters or is any reason to assign anyone to work as only those who want to apply will and that isn't ever going to equate to exact representations for anything in a free country where people select and pursue that what they would like to rather then what they are assigned to do. Also this selection method is petty and does nothing to serve the public in the best way at the very important roles of government that should always pick the best possible for the positions even if the best for that given year is all black men or all black women. The work of running a nation is too important and effects directly 350 million people and indirectly but more so then any other country in the USA case the whole world.
