I am struggling to find the case of someone who was charged for breach of the peace for simply swearing in public but the judge ruled that swearing alone is not a breach of the peace I would like this for reference as I’ve been threatened by police previously if you could help me?
Just confirm, is breach of the peace only when somebody is being violent or likely to be violent? So loud music, for instance, isn't breach of the peace? Or like if someone had a really loud dog barking all night? Sorry, I'm just trying to get my head around it's exact definition
This was really helpful thank you! I'm a law student and this helped to contextualise the offence for me :)
Thanks so much for the feedback

noise usually is not a police issue and police can not take action. council regularly take action with your examples.
good help to get my head round it as a newbie :>)
Brilliant thsbk you for this!!
Do the police need to caution you when being arrested for a breach of the peace?
We recently left Europe so kiss these rights goodbye sometime soon
We had these things well before the EU was even a thing.
