      Part of the inspection form that you sign says if something comes up after the inspection you can't go after the inspector. I got lied to twice by the good Christian people I bought the house from and couldn't do anything. The problem wasn't visible when I bought the house as it was to do with the sump system and the land was dry. Ended up costing around $10,000 and unbelievable stress.

      It costs a lot of money to sue and if you lose your essentially bankrupt. Only way around that if the lawyer is willing to take his payment if you win. I was told by my lawyer that these kind of screw jobs happen all the time. There really is no way to get restitution the realtors and inspectors cover their asses with air tight contracts. The owner is probably nearly broke owing to having to sell it. Also the cost of litigation is so high that you are better off fixing it yourself.

      The bank sold it after it was foreclosed on BECAUSE of the water damage. The bank sold it to someone who covered up the damage and sold it "as is" for a profit. The bank didn't conceal anything. IN FACT the buyers could have researched exactly what the news crew did and found out it had been foreclosed on because of water damage and they would know to stay away.

    come on y'all know when you buy a new or newly renovated house that it smells so much like paint and drywall. I could easily see why they didn't initially smell the mold! This is common that people are out here selling houses that should be torn down. there needs to be an insurance for this situation because too many people are being shitted out of life. And yes a lot still get past inspectors because they can't rip holes in your house unfortunately. Best way to protect yourself is knowing some history.

      Inspectors absolutely can find problems like this if they have the right equipment. A simple mold test can be done in seconds or a water and damp detector can be purchased for $20 at Home Depot because everyone knows where the water is, there is probably mold. Just like you can detect wood beams and studs behind drywall, you can also detect mold and dampness. Any home inspector who tells you it can't be done is a lazy liar, or an ignorant fool who either fell asleep in class, or doesn't even have a legit certificate.

    Yes, the home-owners have a responsibility to hire an inspector. But the damage was in areas that inspectors don't have access to. However, there's absolutely no way the sellers were not aware of the damage when they flipped the property. The onus is not on the inspector or the buyers. It is on the people that concealed the damage that they knew was there.

    Qualified Inspectors don't have to rip out walls to find mold. Technology is available. Moisture and humidity monitors and infrared cameras have been around for years now. With that much mold and mildew, I can promise you that the humidity and moisture content of those walls would have had alarm bells ringing. And there are numerous methods for determining possible termite infestation before having to expose the actual inside of a wall. People have to educate themselves before making such a huge investment. Knowledge is power. You don't have to be an expert these days. The internet is full of information that can help the average home buyer. Research the builder, the real estate broker, and the inspectors before you settle. Reaserch the design of the house, the climate, the location. It's your money. You have a right to ask questions.

      Looking for mold isn't part of a normal home inspection. You have to pay a mold expert to come do their own inspection. And in my case, the house I was in had mold in every square inch of it and by looking at it and being in there, you'd never know it.

    • @johnnelson8956
      @johnnelson8956 5 років тому +27

      Eric Batrez i am a retired civil engineer. I said nothing about smells. Mold forms where water is present and under certain conditions. In the south especially, trapped water combined with heat forms humidity that migrates into a home. Modern sensors can detect high humidity levels and give an inspector an idea of where to look. You don’t have to rip out the walls. As far as termites, termite colonies give off heat. Heat sources can be detected with quality thermal scanners.

    During house hunting I was quick to say "Nope!" to any home that had an unpleasant odor of any kind regardless if the AC was on or not. It's a definite sign that a house has some underlying issues that renovators try to cover up with make overs. Even with that caution my dad discovered that the sellers let the grass grow tall before buying it because a pipe in the ground under the lawn had burst and was slowing leaking water. Got it fixed when we discovered it and the water company adjusted the bill, however I pray that there won't be anymore issues with pipes or plumbing. The third bedroom (my workspace/ guestroom) gives me allergies after being in there for an hour or 2 without the air filter machine on. 🤔 No clue why but I bet you I'll find out soon and handle it. The house was inspected before buying but these days nothing is gauranteed unless you build your house brand new from the start with the best contractors. I hope this family wins their case because they paid too much for a house that is not only worth how small it is but also a total hazard. SMH No one deserves such terrible luck.

Replace baseboards, add railings, get a plumber to fix leaks. As-is is an agreement not to ask for those things, and its usually for properties in foreclosure or with serious known defects. So it is a big red flag, you need to know what you are doing, amateurs shouldn't buy an as-is house, it's for DIYers who know what to do with a fixer upper or investors who have the money to pay for remodeling.

    As someone who bought a house that was flipped like this one take my advice 1) get an inspection 2) don't listen to the realtor when they say it's a "new house" with all the work they have done and 3) Pay for the extra insurance that is offered at the sell of the house to protect yourself from unforeseen circumstances. For us it would have saved us from having to completely rewire a home that had "new" wiring and fuse box and have repairs made to a brand new and incorrectly installed septic system. I hate to see things like this happen and flippers should be held financially responsible for slapping a window dressing on a home that had serious problems like this one.

    I hope Zareh has a good insurance policy cause from my years in real estate and construction, he doesn’t stand a chance if this case goes before a judge. He would have been much better and would have been cheaper had he just bought back the pile of mold and gone in with a reputable mold remediation company and let them remove all the mold properly and then rehab it again after the exterminator gives a clean report and cut his losses. I don’t think there’s a judge in the country that will find in his behalf after seeing the pictures.
    Someone knew about the mold and termite damage. There is far too much damage in this house for any contractor to do any work in there and not notice the signs so someone knew but everyone decided to keep it quiet so he didn’t have to spend another $75k repairing and taking a loss on the project. If he is buying 75 properties a month then he’s familiar with all this but chose to be cheap

    The very first inspection detail that appears in the video is the height of the surrounding soils and lawn to the height of the interior floors. Code calls for a minimum of 8" above surrounding soils. The video looks like the floors of the house are below the level of the surrounding lawn. To begin with, raise the house or lower the lawn. There is no substitute for for correcting lawns that feed water into a home. Period.

    • @Sailor376also
      @Sailor376also 6 років тому +32

      No. I have been a licensed builder for nearly 50 years. There are obvious clues, evidence, in the first views of the house. There are two gutters and down spouts,, but there is no gutter in the center one third if that front elevation. The water falls off of the roof 12 inches from the house. And, where there are gutters the downspouts exit 6 inches from the wall. The window heights,, those are double hung windows,l they look fairly normal to me,, except I know that windows,, unless they are safety glass and tempered,, must be more than 18 inches above the floor. Those windows are no more than 8 inches above the lawn and plantings outside. So the floor must be sunk into the lawn by about a foot. Code is clear,,,, minimum 8 inches above the lawn, and a positive slope away from the house,, should be a foot in the first ten feet. ,,, and eight inches, floor above lawn is really not enough ,, especially in termite or carpenter ant country. One picture. The first picture. Is worth every bit of information needed. The Home inspector,, both the hired inspector and the city code enforcement officer ought to have their tickets pulled. You do not need to look any farther. The water dumps off the roof and flows downhill into the house. Mold and termites are exactly what will happen. Fire the city guy and sue the home inspector for egregious negligence. He is either completely incompetent,, or he was paid by the seller.
      This is not rocket science,, water flows downhill.

The whole small community knew it had water and mold problems to begin with, as well as an extremely agressive neighbor, and now no one wants to buy it. Buyer beware! The house never traded hands for more than $15 in the past before I purchased it for 120k. I still owe 90k and perhaps I will have to sell it for that and lose all the money I also put into repairing it including a new tiled shower since the old one leaked between the layers of old flooring and had tree roots growing aound it since the shower drain wasn't even hooked up peoperly to the pipe.

    I guess you would need to be able to check the house history from insurance companies. Maybe we need a a similar service like we have for vehicles. You could see if there were ever claims for flood damage. There is a brand new company for someone.

    Bet if this family had wealth and lawyer power this would be resolved really quick. My grandfather had a very similar issue, but the fiscal ability to aggressively pursue a resolution. Needless to say, the whole matter was concluded and resolved to the full satisfaction of my grandfather within 3 months upon which the prior owner then tried to physically attack my grandfather while the whole damn family was there celebrating and setting up his garden. He loved gardening... And honesty.

    Apparently Jar offered the full buy back and 10k plus but these owners turned down and are still suing. There are lots of upset buyers from this company. Google Jar House, mold, lawsuit and will see tons of stuff about them. Very shifty and shady operators.

    Jar should not only get their money back on the home and reimbursement for medical expenses hopefully they will also get extra money as far as punitive damages. This is disgraceful,Jar Should be investigated and put out of business.

    I just finished renovating my house I bought last year. Mold in the walls and old termite damage they didn't repair. It was bad but not this bad.

    All the damage was there before it was put on the market. All of the mole was covered up. There's a serious leak through the house. The termites was there never treated

    The seller has 💯 percent of responsibility to the buyer especially as a real estate broker they know better then to cover up structural defects and mold. The home inspection could not discover the structural damage because it was covered up by the seller and only way the buyer could have detected the mold is to have a full blown mold inspection which most home buyers didn’t do unless prior water damage has been disclosed.

    This is exactly why I would only buy a new house. It's better to rent than to have the financial burden of constantly repairing a older home.

    Never purchase a house from someone that flips property. Also, companies are in the business to make money. Huge red flag when a company is trying to sell a residential property

      Mold is not an allergen. It’s a poison!

      Some people are very allergic to mold and can tell right away it's there. I'm one of those. A trick to check for mold in walls is to remove the wall electrical out let covers and wall switch plate covers with a screw driver and then give it a sniff test. That way you can tell what odors are coming from inside the wall.

    We rented a place with mold from ductwork condensation for 6 years. The owners told us they wanted to sell, painted over all the mold and sold to an elderly couple for top dollar.
