Unlike the UK Germany is fortunate in having a US style political system after WWII in which the Lander (States) have considerable power since they determine the composition of the Upper House of the Bundestag and a written Constitution with an independent Constitutional Court that can and does rule whether the actions of the Government are Constitutional, as with the recent budget case where they reigned in Government expenditure to the level allowed by the Constitution.

The court has been sceptical about this approach and that's why the ban was suspended.
