    I am losing count how many times a gun has been pulled on me. They are adding up. The statistics of probability are working against me that one will be fired.
    An anonymous caller reported my car for being parked in the parking lot of the City Square (public parking). At about 5:30pm, when I was eating a bowl of cereal, a Sheriff Deputy pulled next to my car and started demanding my name. They had to identify me.
    This is a town where they closed their police station down and rely on the Sheriff Dept to do their law enforcement.
    I am so tired of these anonymous callers giving the cops permission to harass me. This process of vetting isn't right.
    The caller complainer needs to take some responsibility for themselves and be fully identified when they make a stupid complaint!

      He didn't shoot though... This guy was not answering questions and was acting suspiciously. The cop doesn't know if the guy has a bomb or a gun, the cop is just doing what he was trained to do. Just because this guy knows he doesn't have anything doesn't mean shit to the cops. For all the cop knows there's a bomb in there and it'll go off any second. I'm surprised how well the cop kept his cool through this process. This guy was just asking to be a target.

      It has been established in federal courts that a LEO pulling out his side arm is not attempted murder. It's only murder if the LEO kills the subject without just cause after all evidence has been analysed.

    I looked up the law You only have to identify if you are lawfully stopped in a public place under Utah code 77-7-15. Which states the officer has to have reasonable suspicion that the person is committing a crime

    In order to be detained you must be suspected of a crime, which in this case was cited as "failure to identify". Yet you only need to provide ID if you are being detained for a crime, which he wasn't when he was asked for ID. But in order to be detained in the first place there needs to be suspicion of a crime. He never had that initial suspicion of crime and had no right to detain. Just looking suspicious is not grounds for detainment, and therefore he has no legal obligation to present ID. Obviously the cop is in the wrong, and more than likely it didn't matter.

      It's impossible to know beyond a reasonable doubt that was going on the LEO head at the moment of encounter. We can't say that the LEO didn't have reasonable suspicion because we were not there, we don't have all the facts surrounding the situation....

    "Stop and identify" statutes are statutory laws in the United States that authorize police[1] to legally obtain the identification of someone whom they reasonably suspect has committed a crime. In Utah v. Strieff (2016), the U.S. Supreme Court ruled that the officer's stop of Strieff and demand for identification was unlawful under Utah state law.

    77-7-15. Authority of peace officer to stop and question suspect -- Grounds.
    A peace officer may stop any person in a public place when the officer has a reasonable suspicion to believe the person has committed or is in the act of committing or is attempting to commit a public offense and may demand the person's name, address, and an explanation of the person's actions.
    The text before being amended read: The words (he) and (his)was struck and replaced.
    7244 Section 85. Section 77-7-15 is amended to read:
    7245 77-7-15. Authority of peace officer to stop and question suspect -- Grounds.
    7246 A peace officer may stop any person in a public place when [he] the officer has a
    7247 reasonable suspicion to believe [he] the person has committed or is in the act of committing or
    7248 is attempting to commit a public offense and may demand [his] the person's name, address, and
    7249 an explanation of [his] the person's actions.
    It still said the same thing, (reasonable suspicion of a crime) prior to anything else. You can't legally be charged with not identifying, when no other crime has been committed. You can't put the cart before the horse.

    Don't sue the department. They are funded by stolen tax dollars. Instead, please go to the nearest federal court and file an Oath of Office violation. If you win an Oath of Office violation it does two things, 1. the officer has to pay, (not the police department), a fine for every violation he or she committed and 2. he or she can never be a public officer again on U.S. soil, (banned as a cop for life). Next, go to the nearest state court and file an Oath of Office violation. If you win an Oath of Office violation again it also does two things, 1. the officer has to pay, (not the police department), a fine for every violation he or she committed and 2. he or she can never be a public officer again on state soil, (banned as a cop for life). Finally, file a claim against the insurance bond, (that the police officer or law enforcement officer has to carry by law), for damages. This will cause the insurance company to charge more to have a bond against each officer, thus providing an incentive for the police department to actually fire bad officers instead of putting them on paid vacation or doing nothing at all.

    In order for "Failure to ID" to be a crime, you must first be obligated to ID due to reasonable articulable suspicion of a past, present or future crime. Failure to ID cannot be the compelling reason for the detainment in the first place.

Upon further review..... right at the start of this video the man says "am I being detained"... the officer says "no, I'm just talking to you, trying to find out who you are." Even under the authoritarian Utah law, the officer shot himself in the foot by saying no.. The officer has no right to see the ID, the officer must walk away, this man civil rights were violated and he should sue

    #1: Utah is a stop and ID state.
    #2: Cop drawing a gun on the suspect for ID, after asking multiple times. When he does go to retrieve his ID, the cop just assumes the worst; a gun.
    He should not be a cop if he just naturally assumes the worst for every encounter, that is not the proper mindset a cop should have. A cop should always be ready for the worst, not just assume it first.

      1stupidfish They would come back that they had reasonable suspicion of parking there overnight, which would be their "public offense"... But the cop told The Dude there was nothing wrong, that "I'm just talking with ya." Didn't detain except for the failure to ID, which, even then, just a name is sufficient in Utah.

      If he's sitting in the drivers seat with the keys in the ignition, hes operating a motor vehicle.. even if he isn't driving anywhere, and even if the car isn't running.
      operating a vehicle requires a license and you have to provide ID when requested.
      Anyhow this guy handed his wallet over then tried to walk away, saying he was going to go inside his house..

    Please be fair! A COP'S job is so DANGEROUS! But wait! Law enforcement is NOT on "America's top #5 most dangerous jobs list" But, Sanation Worker (garbageman) is . An innocent American is 87% more likely to be killed by a cop, than by a TERRORIST. Cops have murdered more than 900 unarmed people as of Oct 2016. The average punishment is two weeks paid vacation.     Deputy Nelson had no idea what was about to happen to him. In the follow-up video where Travis's car was falsely alerted on and searched shows how disconnected this perceived power is to his real power. The only thing in reality that separates those powers is abuse of power. After this interaction and after the next interaction he doesn't understand case law where Reasonable Articulable Suspicion that Travis had committed a crime, was committing a crime, or was about to commit a crime is the absolute minimum threshold for detainment. Any detainment without those elements is illegal. In his undeveloped mind he really believes he has the right to demand answers to his questions. You see here attempted 4th Amendment violations, attempted 5th Amendment violations and actual illegal detainment and abuse of power and sadly he has no idea he's committing those errors. Still doesn't.

    In Utah citizens arrest is legal. If the law is for one to ID themselves then why doesn’t the cop have to ID himself when asked? Parking in a public place isn’t illegal. No PC for a stop or detention existed to even approach to be asked for ID. Then he was illegally searched when the cop snatched the wallet. He found the ID then searched more...

      Because if you are a criminal, your driver's license says "CRIMINAL" on it in big red letters. Seriously though, they are fishing for a warrant because under Utah vs. Strieff, it can be used to turn an unlawful detention into a lawful one after the fact. Even if the warrant is for an unpaid parking ticket in another state. Thanks, Supreme Court!

    It’s a stop and Id state only if you’re suspected of committing a crime or have already committed a crime, or suspect a crime is about to be committed. They couldn’t articulate a crime being committed other than not providing papers which isn’t a law he can break unless he had already broken the law. We have freedom of movement and when the officer says the man videoing is detained for not identifying himself, the officer is infringing on that mans rights due to the fact he has not committed a crime. You even hear the officer assume that the man videoing has a warrant which isn’t the case, aka profiling. You also notice the first time he asks the officer if he was being detained he says “no were just having a conversation” but then decides to make up laws and changes his mind.
    I’ve had the fortune of being stopped only for traffic violations and always had a cordial experience with most the officers I’ve dealt with, but the day that I start to get asked for “my papers” as if I were in nazi Germany then we’ve got a problem. Be informed and be knowledgeable. We as a people have given police too much power and they abuse it, but they can’t if you understand the law.

    From the start, you can just tell this is not going to be a lawful stop at all. He asked the officer, what is the crime? The Officer needs to articulate a crime in order to ID him. But when he asks again, he says "In Utah, its failure to disclose identity".
    Cops, let me run this down for you.
    He has to have committed a crime for you to ID him in the first place, so this "Failure to disclose identity" is absolute non-sense. You cannot ID someone for not committing a crime, that is in breach of the 4th Amendment.
    Failure to ID is a secondary charge - This means, the Citizen has to be in "Custody" or "Arrested" and fails to ID himself for this to become a secondary crime.
    I live in the UK and even I know the American laws better than these 2 officers. How can these morons get it wrong?

      He does not need to articulate a crime, he needs to assert that he suspects you of a crime. Telling you what crime he suspects you of can hurt his investigation. Later, if you follow up with a complaint the cop would need to articulate the crime that he suspected you of. So basically, if you ask "do you suspect me of a crime?" and the cop says yes, show ID and file a complaint. If he says no, then he is not entitled to see ID and if he still insists under threat of arrest, show ID and sue his sorry ass for violating your rights.

      The whole point is police policy is explicit all officers when requested must identify verbally or in writing. Same goes for other public servants. But as a private individual the 4th amendment protects my anonymity. If you refuse to ID during the booking process then a secondary charge can be implied. In order to book you there must be primary charges everything else is secondary. Usually misdemeanors. As the saying goes you may beat the crime but the ride is free to the gray bar hotel.
