He doesn't want death to be the answer, because even with villans have family members or loved ones who will miss them. Like after everything Joker did in a Killing Joke, Batman still offered help to the Joker. He wants to show that rehabilitation is possible. That's one of Bruce's greatest flaws. He's too hopeful. Even if it's false hope, in such a dreary place such as Gotham, his hope is one of the things that helps keep him going. Like with Harvey Dent, his former friend. He doesn't want to kill him or for the city to do so. He wants to fix his friend, so they can have good times again. Everyone has flaws and this is Batman's. His false, deluded hope. Don't get me wrong, I believe that Joker should be dead by either Batman's or the prison's hands. Joker is better off dead. But Bruce wants to have hope.

The definition of insanity as I heard it.... Basically to be unable to adabt and doing the same over and over again and expect the inanimate objects will adabt or suddenly change their reaction and obey.
