    I have a friend who owns a gun store and he has told me the ATF agents stopped being helpful long ago and are just plain rude and nasty to deal with. There is absolutely no need for that attitude.

      Sounds like he has some jerks in his area, the agents that have been in our store over the last few months have been their normal polite selves, and when we've asked questions about this, they don't seems to be concerned about minor typo issues, only actual violations.

    The question is now 'What constitutes an illegal part?' The ATF is now redefining parts that they previously declared legal as illegal. A gun store could have sold a perfectly legal part on one day and the next day they're in the business of selling 'illegal gun parts.'

    There is NOTHING to justify making ANY gun or part “illegal”. In addition, no one who has committed a felony, with or without a gun, should lose their 2A right if they have already repaid their debt to society through incarceration.

      I agree to an extent, but many think debt to society is they have served their prison time. I would clarify that to mean the time of the entire sentence even if paroled AS WELL AS proof of payment for all monetary judgements. Many felons serve a small portion of their time and NEVER pay the restitution they were ordered to pay. As far as violent felons who committed a crime with a gun……they should never get their gun rights back.

      Okay, that sounds great, but it's far from reality. We have had gun laws for many decades. As for felons, you're crazy. Even I (long time gun owner) would be opposed to that. They may have paid their "debt to society" (whatever the heck that means), but they've already proven to not be law-abiding citizens.

    The first FFL is bought a skeet shotgun from was the victim of break-in and theft of their firearms about a year after I bought mine. The "news" said the AFT's investigation showed it was an inside job and they found dozens or hundreds of firearms that were unaccounted for apart from the theft.
    I was visited by an AFT agent shortly afterwards to verify I had my shotgun and the serial number was the same as the paperwork. I told the agent to meet me at the skeet field on Sunday and to bring his skeet gun too. We'll make a morning of shooting clays and if he could beat me, he could try my shotgun out for a round.
    I never saw him again. 😂😂

      I'm pretty sure I follow your scenario, but just to make sure, one interpretation is the agent never showed up at the skeet field. Or someone might interpret it to mean that the agent did show up and when he was allowed to shoot a round with your gun, he took it and ran. Now that I've typed it all out I realize you would have described the second scenario a little more, if that would have happened. I'm going to post it anyway.

    What happens if you sell a pistol brace or order one for a customer and the Supreme Court says they're LEGAL but the ATF passes a rule making them ILLEGAL? Do you just lose future business AND money by just NOT selling pistol braces at all?

      no they're supposed to give amnesty/future date when the law takes effect. However there's literally nothing stopping the ATF from abusing their power. Which they occasionally do sometimes knowing that there is literally no check against them from doing so.

    What happens if the NICS does not come back for 3 working days and you send the firearm off with the customer because that's what the rules says, then the fourth or fifth day the report comes back rejected? Are they still going to shut you down?

      Normally, I'll say no. We've had that happen a couple of times in the past year where I work. The first one, after we got the notification of the denial, we contacted the customer and informed him of what happened, and offered to refund the firearm 100% if he would bring it back to the store, his opinion was screw the feds. When they contacted us about it, we informed them that we had contacted the person and what his response was. We heard later that the ATF had arrested him for it. We were in the clear on everything, because we had followed procedure and had actually gone beyond that by contacting the person and offering to refund their money if they brought the firearm back. The second one was the same except they brought the firearm back and took the refund, the ATF was fine with this and as far as I know, nothing resulted from it directly. If we are following procedure, there's not much they can do, it's those that don't follow procedure that are getting hammered.

    After 32 years in law enforcement, I am happy to say that I don't have to deal with all of this anymore! :)
    Zero tolerance means agents cannot exercise their own discretion when they come across a violation. Law enforcement people usually can make certain decisions in the field about violations. For instance, if you get pulled over and you were not wearing your seatbelt, the officer may, a) give you a verbal warning, b) write a written warning or c) issue a ticket. Zero tolerance means you are going to get the ticket; no warnings.
    Employers have to answer for their employee's actions. That means that if an employee messes up, the employer has to answer for it, the employer's license is in jeopardy. The employee cannot be singled out to take the blame. This is a legal principle called "respondeat superior". It really boils down to 'hire wisely'...

      So if in a employee purposely gets hired with the intention to get the original owners license taken away they could take advantage of this zero tolerance. Now it's extremely unlikely that someone would go through all this just to get back at somebody but it's possible people can be very spiteful.

    Always interesting to hear what Maggie has to say. However I think you missed the mark in this video. You talked about a very negligent or gross mistake. As a consumer my concern is that ‘no tolerance’ is about revocation for the most minor of paperwork errors that may have previously only received a verbal reprimand. I’d like to hear your thoughts on that especially when you consider the video that floated around with the agent using a personal phone to take images of the ffl logs.

    Joe Schmuck works at the wally world sporting goods dept, breaks a rule, and gets caught. Does just that store lose it’s ffl or does the corporation lose it’s ffl? They could potentially shut down most big box stores with this by one person breaking the rules in any of their chain stores.

    A new employee would be considered to be still in training, and would not handle any gun-selling transaction without being checked/seconded by a more experienced employee, or by the store owner.

      The gun shops ive been to already do this. Ive bought a dozen firearms over the years. I fill out the paperwork and another employee checks it, then the owner checks it. Then they call in for the background check or record your ccw license.

    Back in the 70’s in Pennsylvania there was a waiting period to buy a handgun but not a rifle or shotgun, I don’t have a problem with that but it should be a Function of the States not the Federal Government

    If a shop takes an out of state CWP in place of a background check they will shut you down. It HAS to be an IN state CWP. It does not matter if an employee does it or the owner does it, the shop is done and the license is pulled.

    The trick is to have only certain people who are allowed to process the sale of a firearm; there should also be a supervisor who reviews the paperwork against before the gun leaves the store! The ATF paperwork is not rocket science but people need to take it seriously. The current administration has not introduced any new laws or policies concerning gun sales, this “zero tolerance” policy is saber rattling! Same practices as it’s always been!

    There is a zero tolerance for clerical errors. An example, the NICS date was 09/01/2022 and you entered 09/02/2022. You will loose your license for that mistake now. Anything clerical in the NICS section will cause you to loose your license. So it is not just blatant violations of the law.

    I once walked out of a Bass Pro without paying for a shotgun because a salesperson's error with a bar code reader. We realized that our bill was much less than anticipated by about 1/2 mile down the road and went back in with the shotgun and the receipt. This Bass Pro has an employee carry any gun purchase to the exit and hand it to the buyer at the door. Which happened that day.
    First Bass Pro freaked because I was walking in with a boxed shotgun, then freaked because I got the shotgun out without paying. Then gave me a very nice gift card for my troubles. And the salesperson was still employed next time I visited.

    At the Kentucky guns store, last time I purchased a gun there the original clerk does the background check and initial it and 2nd gun clerk must verify and initial it and then the original salesperson physically walks the gun to the check out register and let's the cashier know that the background check was good before allowing you to pay for the firearm. It's a bit inconvenient especially if they're busy, but busy and in business is way better than sitting in prison or losing a ffl when selling guns is what you do.

    The question I have is what mechanism is in place for the FFL to correct mistakes once they are discovered prior to the audit by the ATF? What are the steps if a firearm is mistakenly released? Say a gun is mistakenly released at noon by a new employee, and the mistake is noticed when the boss comes back from lunch at 1pm. Is there anything in place for them to reverse that release and recover the gun?

      It would be interesting to hear, because most of the verified accounts I've heard have been about shops that were either doing shady stuff to begin with, or were FFL's in name only, basically a "Buddy Shop". I haven't heard any verified accounts of a shop being closed due to minor typos.

    A mistake I made on my first purchase (probably a common one) was to misread county as country and put U.S.A.. Luckily the clerk caught it, but I have heard of stores losing their ffl for this simple mistake.

      I made the mistake by not marking the country. I just left it blank. The guy/ employee saw it and asked/told me to recheck my answers. I did and I walked out with a new firearm.

    I would imagine that if the background check is denied, and the store sells them a gun, then that is most probably NOT a "mistake", but instead an intentional violation of the law. I can see that it is possible that it could be a mistake but probably an intentional violation.
    Where there is an intentional violation, there should be a heavy penalty. That is deliberate deception.
    I can see a lessor penalty for mere mistakes that are made, proportionate to the severity of the mistake.
    In either case the situation must be resolved. If someone was sold a gun when the buyer did not pass the background check, then the gun must be confiscated. That is very clear.

    I would say it depends on the situation of what happened BUT the ATF is not really trusted or liked today- in most ANY kind of situation.

      I don't believe so, I have to a friend who owns a convenience store with a sporting goods dept and the clerks get trained in the procedures for transactions. Until they are ready they must call the owner for a transaction and he will come down.
      Just the store must be FFL, not the clerk.
      He may have to authorize the clerks to sell with the ATF, but I don't think the hired help has to have their own FFL license.

    I have heard that it is going a lot further than it did before. Honest mistakes as described on this video are not necessarily being excused. Things like writing the Country in the County field are being severely punished.

    A shop near me said to me once someone got denied and then said they wanted a air rifle and they refused to sell it to them and the moron started screaming at them it is not a firearm i can have it. Long story short he got a free ride in a police car with a trespassing charge since he refused to leave the store. And had a active warrant as well

    When you get denied you get a transaction #.
    From there you can go to the local police station and get finger printed and send the card back to an appeals board who will research your info and send you the results .
    If it is determined you were ineligible, chances are you may be payed a visit by the ATF.
    If a mistake was made you are directed to apply to the VAF (voluntary appeals file) and they will issue you a pin number to include in your next 4473 purchase.
    There's a box for you to write in your pin number on the form.
    This pin number is reported to NICS at the time of the background check and the transaction will proceed, or you will be put on hold if they're busy.
    I have had my rights fully restored via a Governor's pardon and understand full well how this system works.
    It took about 2yrs to get er done and now I never have any trouble with the background check at all.
    My state also allows private sales, and being a CWP holder all I'm required to do is fill out the 4473 form and I walk out the door with my purchase, no check needed in my state if you hold a CWP.
    May I also add: Of all the correspondences I had with the ATF, DOJ, NICS ,the California DOJ, the county seat records dept or any other I may have forgotten did I ever run into anyone who was rude, condescending or just plain rude because they were dealing with a convicted ( non violent ) felon in any way shape or form. EVERYONE involved in my case was polite, helpful and respectful of a person who made a mistake as a 19yo kid who screwed up 30 yrs before!
    This was 9 yrs ago.

    I would like to see an interview with some people that have been shut down since zero tolerance. It is my understanding that the number of shut downs has increased greatly. I want to know if someone gets shut down because he put down June 12 instead of June 13 or 2021 instead of 2022 or forgot one r in the name Harrison. I ask this as I am retired and I was thinking about getting an FFL and specialize in inexpensive but quality guns for first time buyers, people on small budgets and smaller calibers and recoil for seniors or medical reasons. But am a bit fearful with all the bad atf stories going on. How difficult is it to fill out purchase and sale forms and keeping track of inventory etc.

    The story of the dealer "buying a collection and selling" without doing background checks and paperwork is partly correct. What she either failed to mention or is not aware of was the dealer was selling his own personal collection as a private individual to other individuals. Well, what hung him up was as an FFL holder the ATF looks at all firearms in your possession are subject to your selling under the FFL, no difference between business inventory and personal collection. The rules also apply if you are a C&R license holder and decide to sell a part of your collection, your sales.must be ran through an FFL holder, you can't just sell your gun to your buddy on a Friday night after work without running it through the system. You also need to run inherited or guns given as a gift, it doesn't matter if it was a gun passed down from two or three generations back, you have to pass the background check and do the paperwork before you can legally possess it.

    all the guns criminals have originated with the purchase from a guns store and most weren't stolen. Shady gun dealers are really mad about laws that keep guns out of the hands of criminals.

    I'm wondering what FFL lets newbies handle firearm transactions in the first place. When I started working at a LGS, it was about a month of watching over shoulders before I was allowed to even review a 4473 on my own, let alone process a background check and I was watched at the register as well to make sure I was following store procedures about checking everything before the final sale for quite awhile as well. Pretty much the same for the guys that have started after me too.

    Breun calls into question the entire requirement for licensing.. furthermore revocation of a lic...is presumably a regulatory taking of property interests thus the holder is entitled to substantive due process protections.
    I would litigate this matter post haste.. talk to NSSF or your compliance atty... and if you don't have a compliance atty...your nuts...

      In my state you get an email with approved or denied. if denied, I guess you would have to contact the state police to find out.

      In most cases you have options to appeal the denial. Something like 95 "per cent" of denials are false denials due to error on the database, similar name or birthdate as a prohibited person or user error on the FBI's background investigator.
      Every State has a different process to appeal a denial.
      As a sidenote, you will know if you are prohibited from possessing or buying a firearm. You have to be adjudicated mentally deficient by a court or have been convicted of a violent misdemeanor or felony. Part of the sentencing of those crimes, you will be informed of becoming a prohibited person.

    I went to buy a handgun a few years ago and they done the background check on me and I wasn't accepted or denied so they wouldn't sell it to me. I wonder why that is to this day

      You were probably put on hold, that means one of two things.
      1. They are busy and have a backlog, and they'll get to you ASAP.
      2. Your info sent up a red flag and they had to research your identity further as someone else with the same name or whatever's the problem, needs to be verified.
      If you get no response within 72hrs or 3 work days the FFL can proceed with the transaction.
