Can u explain the second para of sec 5 i.e on unconditional feature of bills of exchange... What if the promise to pay is after the death of a person as it says condition which is certain to happen. What about if the receiver dies before payer.

See dnt get confused when we said bearer cheque in that no name is mentioned which can be negotiated or endorsed easily by just transferring only see for eg Mr A has drawn s cheque which is bearer if Mr A transfer that cheque to Mr B so now Mr B is the holder of that cheque and now he can claim the money from bank and now if that cheque has gone lost.....and if this cheque is found by Mr Z Then as the Cheque was bearer so Mr Z can claim the money from bank...as there was no specifically Name mentioned on the cheque WHILE NOW IN CASE OF ORDER INSTRUMENT ORDER INSTRUMENT is that instrument in which name is written if we take the example Again of Cheque Mr A drawn a cheque now in the column of Pay to he writes Mr C name then this cheque amount will only get by Mr C and nobody would claim the amount except by Mr C or it can be pay to someone else depends upon Mr C's order.

Here the condition has to be certain. Like sir said 'when someone is dead' . Or take an example where you have to make emi payment for ur car and you have given your financier a cheque which has a condition that if you fail to pay emi then he would encash that cheque. Condition is "CERTAIN".
