Recently Delhi High court passed a slipt verdict on a PIL that asked for removing the exception of marital rape from Section 376 of the IPC. After the judgement came out there is a lot of talks going on this issue.
The Inuth’s Shahbaz Ansar talked to people in the National Capital to know their views and we got shocking answers.

Marriage is a monogamous relationship it means sex is limited between husband and wife.
It also means husband and wife both are 100% Dependent on each other for sexual needs.
When there is 100% dependency it becomes duty for both husband and wife to satisfy each-others sexual needs.
Sex is a matrimonial duty in a monogamous marriage.
If a woman want 100% Autonomy of her body then men can also exercise their bodily autonomy.
Men can buy sex from sex worker instead of getting trapped in a sexless marriage.
Men can also hire surrogate Mother Instead of having children with wife.

1.in foreign countries power dynamics is different , here power dynamics are highly towards men , laws are made as per condition of society because gender neutral mean not just on paper but to be gender neutral in effect , as per the condition since men have more power in indian society in every aspect therefore if we make it gender neutral on paper men will exploit it even more , the best way to show this is how rapes , sexual assault are highly unreported in India ( since 99% rape cases go unreported)
2.your point about false rape cases is completely wrong , since as per NCRB 2020 data even if add false cases + non cognizable cases+ cases ended as mistake of law or fact then also the maximum false cases go up to 8%

7. also by not making the law men are already misusing the immunity to rape their wives , any law shall be tested about how much gender neutral it is in effect not just on paper therefore even if we make the law the chances of women misusing it are still less than the chances of men misusing if the law is not made , therefore the law would be more gender neutral if it is made by default
also only 36 countries in the world don't have a law for marital rape

@@acegaming7336 a physician could examine the woman who filed a marital rape case against the man. Because there's always clear signs of violence in such relationships or atleast would have some violence involved. The husband could produce proof that the wife had given consent for intercourse or something similar as proof of innocence. Maybe if once the complaint is filed the next time a victim is domestically raped she's legally allowed to record the incident, or if the husband is falsely accused he is legally allowed to record whatever goes on between him and his wife so they have proof either ways.
Also there would even be the problem of marital rape if the laws of monogamy in india weren't so strict and sex before marriage is legal anyway. Men and even women don't understand the meaning of consent and have an idea that they own their partner. I've seen cases of controlling wives too. You or your partner don't completely own each other.

These are standard set by default .they need non working woman .then you need to pay alimony for kids .it's not the fault if the children though in some cases there are other ways where you can escape from alimony like saif ali khan

The situation of 498A( more than 50percent cases are false , court has mentioned it as legal terrorism ) is the reason marital rape case should not be brought in india .
The remedy of those women whose men force sex is divorce or file complaint against them for cruelty , the law for cruelty already exists in india - 498A.

I have a crazy idea. What if ? Just hear me out 😂 There should be sexual consent forms available for download from a government website and they should be signed by both parties before intercourse infront of a camera and a witness (to prevent forceful signatures) regardless of relationship status and that signed consent form must be uploaded to the government database. Consent forms would be valid for a 15 day period and must specify the sexual activities to be excluded. For example if the girl wants to have intercourse but refuses to have anal, it must be specified. If due to any circumstances the parties involved fail to sign the consent form before intercourse, it must be signed and uploaded to the Government database within the next 48 hours. I know this will be hampering the privacy and intimacy of the relationship but safety of both parties will be ensured.
