Thank you Atty for the lecture. Atty, for non patentable inventions, pasok po ba dito ung mga sexual objects that induce pleasure? since these are contrary to public order and morality? if yes, would it mean the invention of condoms are not patented?
Well, they may have been patented in a state that allows such items to be patented. Also, it is arguable that condoms per se are not necessarily contrary to morality, as they may serve a scientific purpose, such as to prevent transmission of STDs, among other uses.

Yes, Philippine patent is only enforceable in the Philippines. You have to file a patent also in the US.

I want to clarify utility invention vs patent,
I am unsure as to if I should file for utility or patent for example a wallet, but the layout is very different and it can sort bills per value by itself. Should it be under utility or patent?

Depende po kung sino ang may ari ng lugar kung saan naka Park. Kung sa inyo yun, pwede nyo paalisin. Kung pag-aari ng Private subdivision, kausapin nyo yung Board ng Homeowners Association. Kung pagaari ng gobyerno, kausapin nyo ang barangay. Kung hindi po nagcocooperate ang nagppark, abiso ko po ay mag-hire na po kayo ng abogado para pag-aralan ang maaari nyo gawin. Salamat.
Good evening po, Atty. May question lang po ako regarding doon sa given scenario niyo po about sa true and actual inventor. What if po si Ana may naisip na idea then she file for application of patent (and sinabi sa kanya na medyo matagal pa bago ma grant yung application niya). Tapos, may neighbor siya na nakita ang idea niya na yun, and dahil may resources and money yung neighbor ginawa niya yung idea ni Ana and nireproduce and binenta niya. May IP right violation po ba and ano po yung legal remedy ni Ana po. Thank you, Atty.

Hi, you may find the remedies and penalties in Sections 67 to 84 of the Intellectual Property Code (RA8293 as amended), which, in case of patent infringement, include: damages, treble damages, injunction, and a criminal action for repetition of infringement carrying a penalty of imprisonment for the period of not less than six (6) months but not more than three (3) years and/or a fine of not less than One hundred thousand pesos (P100,000) but not more than Three hundred thousand pesos (P300,000), at the discretion of the court.

Simple lng nman po pero upon checking the internet wala pa po ako nakikitang gnon na product sa market. Bali under siya ng utility patent ksi upgrade lng po siya ng isang item na nasa market npo. As of now i am planning ang checking pa po on how to do it especially don sa product kung pano ko ggwin. If ever mtpos ko na. Sana pasok sa budget ko po mag pa legal consult sa inyo. Hello. Usually, yung place na humihingi ng ID, may list yan, tanungin nyo lang. Also, madali lang po I-Google yan. Ito po example:
