I am having one doubt regarding this lecture: you said that an order passed by the court related to the controversy arose between the parties is considered as a decree since such order is resolving the controversy... you also gave example that rejecting a suit when it is time barred is also considered as a decree since from now there is no controversy remains in between the parties; and further the dismissal of suit when plaintiff didn't show up in the court is not considered as decree as the controvery still remains... my question is then why we consider rejection of plaint as a decree due to non-payment of court fee since the controversy still there and the plaintiff has a right to again file a suit regarding the same cause of action.
Sir doubt in this question A filed a suit against B . B raised plea of limitation and suit being barred by principle of Res Judicata , Court Framed an issue and decided against Defendant .Is said decision a Decree or Order ??
Sir you have a been saying CrPC instead of CPC. Section 144 of CPC is Restitution but 144 of CrPC is power to issue order in urgent cases of nuisance. In the previous lecture as well you 125 of CrPC which is order for maintenance and 125 CPC is Power of High courts to make rules.

Bcz the ground which one could take for defence or attack if ignored and judgment passed then that ground can't be acceptable again. That's why we called it constructive
sir for eg if in a preliminary decree a is given the possession of a house and b does not appeal against it, in this case when the final decree is passed giving a the possession and the ownership can this be appealed against by b? alothough b didnt appeal when a was given the possession in the preliminary decree
Preliminary decree after passing the final decree can't be appealed. But if the final decree which is also based upon the preliminary decree is challenged then obviously the appellant court also looked out the preliminary as well as final decree
U need to file an appeal within the prescribed time period else u need to move an application for condonation of delay and thereafter it's the discretionary power of the court to allow Ur appeal or not. If dismissed then u can go for revision against that order if that is also dismissed then u can't do anything Bcz law can't help those who r sleeping over their ryts

If the plaintiff felt aggrieved by this order his remedy lay either by an application under O 47, R (1) or by filing an appeal against it. Appeal always lie before session court
An adjudication which does not formally fall under the definition of decree stated under section 2(2) of the Code of Civil Procedure but due to a legal fiction, they are deemed to be decrees are considered as deemed decrees. Rejection of plaint and determination of the issue of restitution of decree are deemed decree.
