    If a military member is properly of the government, how can they sign a contract with a civilian without approval from their commander and full disclosure from a JAG officer in writing? Full disclosure in writing at the time of signing any contract is required, or the contract is void. The military nor the state in which you get married do not give disclosure or written notice of what happens if you break the contract(divorce).

      Great points/question. Service members are not property of the military, rather we serve based upon a commission for officers or a service contract for enlisted service members. Service members are free to contract outside of the military. There are many consequences to divorce in the military, which civilians do not have to deal with in divorce.

      @@Legal_Cannon I did 27 years in the military and if you are active duty, you are US government property. Military members are under UCMJ 24/7 on duty or off duty. Military members that sign a marriage contract sign with a civilian and the state without full disclosure from the military or the state that they got married in. This is a violation of contract law. Also, if a military member signs that marriage contract and get divorced, they must go through family court. That is a violation of the 4th, 5th, and 6th amendments of the constitution. All military members take an oath to support and defend the Constitution from all enemies foreign or domestic. So, signing that marriage contract violates the oath of enlistment and contract law. This is a terrible way of supporting our military personnel. I always told my people, never sign that wicked marriage contract! Also, military members are not free to sign contracts that effect their military service outside of the military. If a military member wants to get a civilian part time job, they must get approval from their commanders. Then, if the military member has a top secret clearance, they must be very careful about what they do off duty. Do you think they could sign a contract with a foreign company? No way, they would have their clearance pulled.

    How does this change if both spouses are active duty?

      Felicia, great question. The greatest difference is that both parties have bargaining chips related to military benefits and potential retirement eligibility, if both spouses are service members. Both would be entitled to a portion of the other party's retirement. However, negotiations often resolve this division of assets issue in a military divorce.

      I have a question.I served in military and retired now.I want to divorce my wife becoz of infidelity and sufdered mental health problem..She is not a US citizen and we got married in turkey.Is she still entitle for alimony?thank u

      @@rosesis8686 great question. Entitlement to alimony is based on state law, ie where the divorce is filed. You should consult with a military divorce attorney where you plan to file divorce. In Oklahoma, alimony is calculated based the dependent spouse’s need and the supporting spouse’s ability to pay.
