    This victim is AFRAID OF THIS GUY!!! He violated his PO in front of the world at the courthouse with no one protecting her. Of course she left. He was not at all made to stay off of her. This system is so flawed

      im surprised her lawyer even let her go out there without at least telling one of the deputies to escort her knowing that piece of garbage saw her leaving the building - i almost feel like she bears some responsibility in this - there had to have been another way to get out of there besides that one door but i could be wrong

      I agree, the victim must be terrified of this guy's continued delusion and his persistent and determination to be with her, regardless of the consequences. No wonder she's angry with the court, she probably feels so let down as they can't seem to keep him away from her.

    Wow this defendant’s insistence on speaking to judge Middleton outside the presence of his attorney, after the judge told him explicitly not to talk and especially not about his case, is extremely telling! He was directly told no and why not, by a judge. He said he understood and he wouldn’t. Then he says it’s not about the case. And he immediately launched into talking about the case. He has absolutely no impulse control, even directly in the face of an authority who could put him in jail for a very long time. It’s scary to think how he behaves in other settings if direct and immediate deception and defiance are the best he can do in court

      I don't think he was deceptive at all. He seemed to be completely honest about his infractions, first with the police officer and then with the judge.

      @@thomasdalton1508 There are different types and styles of deception. This is a powerful thing to learn. There are those who decieve with lies, and those who decieve with truth. The latter is far more dangerous than the former. Those who will decieve with truth will tell you to your face what they are doing, make you think they intend to change, and not only continue their deceptive patterns of behavior but double down and ramp up those activities to dangerous levels with no concern for others or self.

      Are we just going to gloss over what he said to the judge? He said some weird crap about how he hopes that 50 years from now, he and Carly will be together and look back on this as just a bad memory, or something to that tune. Oh my god. He is so delusional. He thinks they are destined to be together and nothing can stop fate. He is so crazy. And that’s the stuff he’s willing to say in front of a judge while being recorded on video and audio. Imagine the stuff he has said to that girl when nobody else is around. “Carly, I’m going to fashion your bones into a set of dentures for my pet iguana”.

    As he is being escorted out at the end, he says "She got my attention", referring to the interaction he had with earlier that day. Implication being that he did in fact speak to her. He can claim being unwittingly tempted to speak to her, but he followed her outside as per the video evidence. He's convicted himself.

      Actually there are laws against baiting someone you have a PPO/TPO/RO/SO out against. So yah, she CAN go to jail too. These are recent laws due to the upsurge in the amount of women using this to "guarantee" custody.

    What a mess this was! Judge Middleton definitely made the right decision! Also, you could tell he was not happy with the contact that occurred in or around his courthouse with everyone, including the prosecutor and I don’t blame him!!

He has a fantasy with her that he will never let her go and he has been destroying her self esteem for years. He is what she is going through. I'm not saying she shouldn't have lost the kids because it wasn't a safe environment but to divorce that of all context is ridiculous.

    I feel bad for Judge Middleton. He tries so hard to help people and defendants like this guy show just how bad it can get. You can tell at the end of the trial that Judge Middleton is at the end of his rope. How the man doesn't become an alcoholic is a testimony to his character as a man.

      He was really trying hard to find a reason NOT to cancel the bond and for all his efforts, he was clearly frustrated at the defendant's refusal to follow a simple command like "don't talk without your lawyer." If someone can't maintain composure and have some self control in the court room, they DEFINITELY have none outside the court room.

      Judge Middleton tries to help the criminals get any treatment that can benefit them, while at the same time protecting the victims to the best ability the law will allow.

    He’s on bond in two different courts. This is what is wrong with our justice system. This man should be in jail. Period. None of this repeated bond crap. This is the type of defender that will turn around commit murder, and then commit suicide. He is that sociopathic.

    I had a similar problem with my ex husband. He kept breaking the PFA time and time again and nothing would happen to him. The one time he broke the door down and got into the house . I called the police. We lived about 20 feet over the township border for our police district so we had to rely on the state police for help. It took them 3 hours. A black eye, broken nose and 2 cracked ribs was that result and he never went to jail and not even a fine. Absolutely bs. This system failed me which is why I haven't dated since 2012 and probably won't and it's failing this woman. He breaks the protection order 4 times and even right there at the court house. That's why she left and I don't blame her. Thankfully this judge locked the defender up. It's about time. Way to go judge. I was acting like a cheerleader after he locked him up. I'm happy being single and not dating, I'm a positive person and will help anyone and content. Hopefully this woman can finally relax and heal.

      Hum, are we watching the same video she commented on? Don’t dare call someone a liar that is ignorant, tone deaf and you’re victim blaming. Even if you had your doubts, to call her a liar is disgusting. I hope you’re not a grown adult thinking and commenting like this. I am all for our justice system but why don’t you go watch the countless DV reports that resulted in tragedy or even worse the countless times CPS had multiple reports, children with er records where they had bruises, broken bones and many teachers/family calling to report and they either don’t take things seriously or close the case-it’s only until something serious happens. So ask yourself, if that can go on and with children, then yes, other things may or may not be taken seriously.
      Don’t call people liars, especially if it’s based on just a bias, opinion, because that is truly just disgusting.

      I need to clarify when I stated I’m all for our justice system, I Am for it when things are done that we obviously not corrupt, same with law enforcement, I don’t unfairly profile all based upon some. There’s good & bad in life, period, and yes some of those bad people wear uniforms, lab coats, billionaires, princes, teachers, lawyers, etc. I respect the law & order when it respects their sworn oaths, just needed to clarify that.

      He's way too chill and way too lenient. If I lived in his county I'd be very unhappy. The things he allows people to get away with and his lenient sentencing is one of the big reasons why criminals don't fear the consequences of their crimes. Then he wonders why he sees the same people over and over again. I'm sure he's a nice guy, a great neighbor and community member, but as a judge I think he's terrible.

      I’m not entirely sure that is delusional. Never underestimate the power and abuser has over their victim. By the time the abusers get violent, the abusers have already convinced the victim that they are worthless, that no one else would ever love them because they are not worthy, and they should be grateful that they have their abusive partner

    When parents have behaviors so bad they get referred to CPS, they are typically given 3 months to follow the improvement plan CPS gives them. The child may or may not be given over to the temporary custody of the state, ie to a foster parent.
    After they fail to complete the Improvement Plan in the time allotted the judge will almost always give them another 3 months to make progress. If there are egregious circumstances then CPS can go back to court and the judge can make the decision to discontinue the plan immediately and remove the children permanently, making them eligible for legal adoption, by the foster family, other family members or another adoptive family.
    If I were to fill in the blanks as it were it sounds like the husband continues to be abusive and his wife keeps inviting him back into the home. CPS then tells the judge both parents are failing to follow the Improvement Plan and the judge permanently terminates the parental rights. It would be as if the parents here never had children. Foster kids have their records sealed and the state guards their privacy with great priority.
    So now we've got a mother who is mad at the system for "taking her kids" and won't cooperate with the state. We have a father to whom it's more important to continue to see and beat his wife rather than do what's best for the kids so he can continue to be a father. Finally we have a prosecutor and judge who want to protect the child but the parents won't stop disobeying court orders.
    This is a pretty bad case. The prosecutor is still working to protect the wife despite the lack of cooperation. The judge likewise knows where this is going and is making the tough decisions to leave the husband in jail. What a mess.

    When the judge canceled his bond, the sound of his disbelief was astounding. What did he think was going to happen? Did he think this was all a game? Yes, he dug this hole and just couldn't believe the judge would put him in jail. When you pull crap like continually violating a PPO, think about what the worst consequence would be. He clearly didn't think of that.

      I think the mom may be partly to blame for losing parental rights to her child is more than just the actions of the child's father. They don't take children from the mom just because the dad is a piece of garbage. There must be more to the child and the mom versus what is going on in this video. It is definitely a shame as a child deserves to have 2 loving parents and to lose both yet both parents still being alive is a burden the child will carry for the rest of their life. Even if they have the most amazing parents adopt the child depending on the age they'll always have that thought in the back of their mind at times questioning why their mother didn't fight for them or what not. It's just sad.

      My guess is she has a messy life and doesn’t always make good decisions. However messy her life may be, she should be free from harassment by this mentally ill person. Now, if she has had any willing contact with him after the PPO was in place, then she is part of her own problem.

      @@ScubaFanatic60 generally speaking, do review the file before testifying. I wonder if this officer was just so certain he recalled everything he didn’t think he needed to?
      As to why officers or other expert witnesses have to review their reports when testifying, how well do you remember everything you’ve done on every shift you’ve worked for the past year? Or the past five or six years? If you had to deal with an incident that took up multiple pages of shorthand notes and you had to talk about it weeks or months later, do you think even after reviewing your report you would remember every detail? And if remembering it correctly could mean the difference between justice being done or a guilty party walking free, if you weren’t 100% certain you were remembering a detail correctly, would you want to double check your notes or would you just take the chance?

      @@Katchi_ You are 100% wrong. IMHO. Incarceration stops EACH defendant from re-offending while they are in jail. Show me your ample proof. The problem is not incarceration, it is judges who are too lenient and keep letting criminals off easy. I worked as a Correctional Officer and I have seen very little proof of rehabilitation being effective. Look up the cases where, not only do defendants re-offend while on probation/parole, they also do it on pre-trial release. Up to and including murder.

But I'd like to disagree with your assertion that 'rehabilitation isn't effective.' First of all, of COURSE rehabilitation is effective. Recidivism occurs when rehabilitation was not successful. Why might rehabilitation fail? For the reasons you mention - parole is an imperfect system, judges can be hesitant to levy bigger sentences for repeat offenses... But further, recidivism happens when the accused is mentally ill, and does not receive any mental health treatment (or neglects treatment under a system which fails to hold them accountable.) Obviously in this case we're discussing, the stalker is LITERALLY mentally ill. No impulse control whatsoever, no self-preservation, no regrets or understanding. Punishment is not going to fix this person, and your anecdotal evidence (the time you spent as a CO) wouldn't convince most of us otherwise.

    Judge Middleton is probably my favorite judge out of all the judges I watch. When somebody s*** stinks he will not hesitate to tell them. That cop was not ready for court and he said yeah you probably should have read that before you testified and came here to the courthouse

      Mi wasted all their computer budget years ago when they paid millions for a software program to flag people for unemployment fraud. Too bad the system flagged several hundred innocent people, while the state automatically denied their appeals, fined them 10x the amount the faulty program said they stole. This resulted many bankruptcies, some divorces, and at least one suicide. So be thankful the computer system isn't working.

If you commit a petty crime, they’ll do their best to watch you like a hawk and make your life hell and they will do an awesome job of keeping you in check. But if you are a serious criminal, they won’t do anything. Real violent criminals roam free in Michigan. Our courts are a joke.

    The woman in essence gave up her child for an abusive man. Most mother's will fight to the death to protect their children and these two subjected him to chaos and fear.       I do not think that is what happened. I think the child was taken away b/c the household was violent. Clearly, he knows how to manipulate the system--he has at least 4 active DV cases, including a civil PPO, and no one is protecting her. He used the system to continue to haunt her from the inside of a mental hospital. That is calculated. She is not safe.

      I don't see how any of that is the judge's fault. Debbie should have been more careful to protect her witness at the courthouse. That isn't the judge's job. Judges can only deny bond in pretty extreme cases - the defendant is innocent until proven guilty, so can't be jailed just because they've been accused of a crime.

    She is mad at the system for terminating her parental rights, well then grow up and act like a adult. Do what you need to do to get the child back. If you are able to. She is acting like a child..she got mad at the system so she left? Maybe she should be brought up on contempt charges. Her lawyer has to understand, and Im sure she does, but it doesnt seem like it listening to her. HER client has violated the PPO as well. You dont want contact, you dont let him come back and live with you after he has surgery. Who knows if there was other times this happened, this is one example. Its clear he doesnt care what the judge says since he said he wants to reconcile with her. What does she want? This one is just a big mess

    This case is a mess. There is only so much the criminal justice system can do with domestic violence victims that want to continue to have relationships with their assailants. The victim is an adult and, at some point, has to be held responsible for her own decisions (it seems the family court did exactly that).
    It is notable that nobody said who approached who in the parking lot. That makes me think the victim initiated the contact. The defendant should never have gone out there knowing she had just left (so the judge was justified in revoking bond), but it does seem the contact was mutual. It is also very clear that she was already leaving, so him following her out was not the cause of her not testifying. Debbie asserted that the prior contact between them was the reason, but offered nothing to substantiate that. This doesn't seem to be a case of witness intimidation. It is simply a victim that doesn't want to pursue charges.
    The judge clearly suspects that all the charges in all the cases will end up being dropped because the victim won't cooperate, which is why he was reluctant to revoke bond (but ended up doing so because it makes a mockery of the court orders if there are no consequences to violating them). He's probably right. This case is probably going nowhere.

    Judge Middleton is extremely nice and he is typically a good judge, but when a victim’s physical and psychological safety is concerned, his tendency to believe things that defendants like this say in court is very dangerous. I have watched him “deal” with this defendant over a year now, and Middleton, in my opinion, has consistently endangered the victim by mollycoddling this defendant. He said at the beginning that the victim has been “hot and cold”. If he truly understood anything about abusive relationships and narcissistic behavior, he would understand the fear that victims have and the reason why they tend to refuse to participate in the legal system. He has truly failed this woman, and I hope he learns a little something about abusers before a victim truly gets hurt. Sorry to say this, but he has been way too lenient in this case.

    Do judges not understand how difficult it is for woman to stand up in court against these men? She did not get mad and left, she got scared and left.

      I think his point is that it sounded like she was leaving before the contact. I understand that the eye contact would be plenty but can also understand that hearing about them having a confrontation in the parking lot sounds like she was on the way out prior to contact

      She left because shewas mad they took her parental rights away. They took them away because she kept fuc%ing with this loser and not putting her child and her own safety first. This punk hasbeen locked up for huge amounts of time andshe has done nothing to get away from him. She welcomes him back into her everytime. Domestic violence education and resources have been out there for decades. At some point you have to stand up and say "no more" no matter how scared you are.

    Sounds like he's a frequent flyer at the psych hospital where he probably beats up the staff while he's there and gets there by threatening harm to himself or others. Just a guess.....

    The first and reason I’ve got hooked on court cases was because of Judge Middleton and Prosecutor Debra Davis when she caught a dude in the house of the victim! Wondering if this is the same yahoo and prosecutors dropped the ball? It is not. Just watched inside addition 3/21 his name was Colby or Cody Harris.

    When judge told officer he should’ve reviewed his report before testimony, thought to myself right before judge mentioned. One night not retain dates but retain after reviewing about the phone call.

    Why did the judge need so much time, deep thought, and testimony to come to that decision? He blatantly and repeatedly defied his bond conditions and vowed to continue to do so. That should have been all the information he needed.

    Did Deb say her rights were terminated to her child? I played it back 50 times and I think that’s what she said…how sad
    Wow. Just imagine losing your poor, innocent child because you couldn’t stay away from his abusive father. Judge was right “that’s about as sad as it gets” I know the system is jacked up, but how could both of them not see what was at stake?!

      Very well said. I did a lot of work in juvenile court and all I can say is jump thru the hoops, do what you’re supposed to do, put the child first. These two don’t deserve this baby. Sadly, there are so many kids in such situations.😢

      Because a lot of us live in a world where we believe The right thing will happen. But instead we live in a world where police, prosecutors and judges have the power to do as they will to you and your family. Don't forget what happened in New York seven children taken from their mother because she didn't trust public schools and wanted to homeschool them. We're losing our rights everyday and people coming on being cheerleaders about it or the real problem. If Debbie Davis didn't get so much UA-cam stardom from these cases she wouldn't do them.

    I know he wasn’t happy about sending him to jail, but that is precisely where he needed to go right then. He won’t follow directions, something even little kids are taught to do, and basically said he wasn’t going to. I’d be willing to bet he’s going to follow the rules in jail, though!

    He ignored every personal protection and no contact order that was issued against him and he even stated that no matter how many orders were made by the court that he WOULD continue to see her and then he is surprised that the judge had him locked up. I can understand that it would be sort of confusing for him because she was sending mixed signals but where he made his mistake was in thinking that because SHE possibly didn't mean it when she told him to stay away, the Court certainly DID mean it. If the only way to keep him away from her is to lock him up then so be it!

    Cop can’t remember anything without his notes.
    Prosecutor isn’t good at setting a foundation or leading her own witness.
    Defense basically says, it is what it is judge but can he get another slap on the wrist please.

      Its not unusual. Do you remember every interaction you had in the last 90 days? Without writing notes or reports to refer back to its highly unlikely any officer would remember everything they could be called to testify about. What I would like to see though is that instead of them testifying they just play the bodycam and then fill in the blanks.

      It's allowed to ensure the officer doesn't lie or state anything to make them end up on the Brady List.
      However, many judges want a prepared witness, especially law enforcement witnesses.
      If a report is submitted as evidence and is admitted, it can we used.
      However, it's part of the job to know and enforce the laws.
      The officer must be able to speak factually based off their memory as a witness.
      An unprepared officer is their own worst enemy!

    I love judge MIddleton. But I don't understand his hesitance to throw this pos in jail.
    It is true that his victim has the all too familiar problems about giving evidence, but that problem is quite well understood by courts and the legal system these days.

    Unfortunately, Debra Davis was fired from the Prosecutor's Office because of this case. She has made statements defending her position. Ms. Davis is a great attorney, and the People will be the ones that suffer in the end. 😢

    Agreed with you, he should of thought about all this, they both should have BEFORE it got out of hand and they lost custody. What about what the kid wants? ok, he is four, do you think its going to be confusing for him seeing this guy again before he is adopted?
