The first thing you can expect as a beneficiary of a Trust is to be ripped off !!

What can I do if it’s been about 10 years and I have yet to receive anything from the executor on behalf of my aunts will with me being the beneficiary?

My father died 6 years ago. 2 weeks after he died my stepmother changed the will. My stepmother died 13 months ago. We were sent a letter, from the attorney, giving us the option to have an accounting or not. We requested an accounting. The accounting has been going on for 4 months. We have requested an update as to when the estate will be settled. The attorney has never spoken to us. My step mother's daughter (executor) has been less than forthcoming as to what the delay is. She keeps stating she has to get paperwork from the bank. Blames us for wanting an accounting. We talk to her and she is rude and condescending. At what point do we retain an attorney to represent our interests? We have just requested a date when process will be completed.

My question is is when the trust agreement is created in the original document, are beneficiaries named?

Can you be required to sign away your rights to get a distribution as a beneficiary.

At what point in time is it appropriate to request an accounting? I received notice a month ago.

In the state of California an accounting is automatically a part of the administration process. The accounting occurs at least 120 days after the trustee has sent notifications to the beneficiaries but there are many variables that can delay an accounting. You should contact the trustee for questions in your specific situation.

I get a small chunk of money once a year how often do I have the right to know where the money is and how much is left. The person left in charge of the money in the trust is are responsible and used to spending large sums of money I am scared I live in California the money is in a trust she is trying to move the money out of the California Chase Bank to Nevada where she lives can she really just take the money and do whatever she wants

Norman, if you are a beneficiary, you should have an attorney request a quarterly formal accounting of Trust. This is your right as a beneficiary. Also, I would ask for monthly distributions, not yearly.

I am a trustee and live out of state of where the money and the beneficiary are located. I have considered transfering the money to one of my local banks to make it easier to deal with money transfers. But there are easier ways of doing the same thing, such as electronic transfers which go directly to the beneficiaries residence although I haven't looked into how that exactly works.
