Yeah, that’s definitely a thought provoking question - one that formed my chief reason for not wanting to study law at all.😅 I’m going to try not to overthink my response and just say what’s at the top of my head because I think sometimes, that’s what’s most authentic. What I’ve learned so far about the criminal justice system is that everybody has the right to a fair trial. This is a constitutional right that cannot be limited, at all. In criminal cases, it’s the job of the State to prove the guilt of the accused behind a reasonable doubt (it’s a pretty high standard), and your job as the accused’s legal practitioner is to defend your client to the best of your abilities - in ways that are legal, honorable and transparent. Now, the reality is, that’s not always what happens. People sometimes do use dubious methods to get their clients acquitted (the more you learn about the criminal Justice system, the more you’ll realise how flawed it actually is😢). The way I like to view it is (and my mind could change, I’m only a second year student), - do your job in an honorable and honest way. The televisation of the legal profession has created A LOT of misconceptions about the legal justice system. You’ll watch a lot of films and series where they make it seem like defense lawyers are allowed to lie to the court, where they’re allowed to hide files and facts. That is not allowed in the profession. It does happen (like I said the system is flawed) but it’s not legal. So going back to what I said, try to do your job in a honorable way. (Perhaps I’m being idealistic, I do not know). Going back to the being Christian thing, I think it ties in with doing your job in an honorable way. As a future Christian lawyer, I would like to keep my standards close. Would God want me to lie? If I feel pushed to lie in a case then is this really a case I should be dealing with? The Christian walk is not easy. I’ve had family members laugh at me for supporting lawyers who don’t bribe judges. A lot of people think it’s the easy way, and a good way to make money. But I guess you need to ask yourself, what’s most important to you?
Additionally, I think when lawyers prioritize “winning” over ethical standards, that’s when the trouble begins. We live in a capitalist society - cash is king. Law firms need cash. Happy clients bring cash. I have many friends who don’t want to do criminal law because of the many ethical dilemmas that spring up. Personally, I’d like to avoid criminal law, but I know I cannot make it disappear. I’ll be involved in it somehow somehow. I guess right now I just pray for strength to know what to do in the difficult situations, even if that means dethroning “cash”.
